     as filed by the plaintiff-respondent Raja Ram against Krishan<\/p>\n
     Chandra (since deceased and represented by his legal<\/p>\n

     trial by the judgment and decree dated 16.09.2005 as passed<\/p>\n

      Against the judgment and decree aforesaid, this appeal<\/p>\n
has been preferred by the defendants, legal representatives of<\/p>\n
the deceased defendant Krishan Chandra with the appellant<\/p>\n
No. 1\/2 Mahendra son of Krishan Chandra acting as power of<\/p>\n
attorney holder of other appellants.\n<\/p><\/blockquote>\n
      This appeal was admitted for consideration after hearing<\/p>\n
the parties on 05.01.2006 and execution of the impugned<\/p>\n
decree was ordered to remain stayed on the condition of the<\/p>\n
appellants’ depositing half of the decretal amount and future<\/p>\n
mesne profits month by month.\n<\/p>\n
                                3<\/span><\/p>\n
      While   this   appeal   remained     pending    for    other<\/p>\n
proceedings, learned counsel for the parties jointly filed an<\/p>\n
application (IA No. 4642\/2008) on 17.04.2008 with the<\/p>\n
submissions that inspired from the spirit of Lok Adalat, they<\/p>\n
have entered into compromise with the terms of the<\/p>\n
compromise stated in the deed attached to the application.<\/p>\n
The said compromise has duly been verified by the Registrar<\/p>\n
on 23.07.2008, in the presence of the said appellant and<\/p>\n
power of attorney holder Mahendra and the sole respondent<\/p>\n
Raja Ram, identified by their respective counsel.<\/p>\n
      Essentially, the terms of the compromise are to the<\/p>\n
effect that the respondent-plaintiff has agreed that the property<\/p>\n
in question shall remain in possession of the appellant<\/p>\n
Mahendra who shall be entitled to use the same as lawful<\/p>\n
owner and no objection would be raised on the lease deed<\/p>\n
issued by the Municipal Board in favour of Krishan Chandra<\/p>\n
and that by virtue of such compromise, the respondent would<\/p>\n
not press on his suit and the same would be got dismissed as<\/p>\n
not pressed. It has also been stated that the appellant has<\/p>\n
made payment of an amount of Rs.8,70,000\/-                  to the<\/p>\n
respondent through Demand Draft No. 8007 payable at Mandi<\/p>\n
Gharsana.\n<\/p>\n
      Having regard to the facts and circumstances of the<\/p>\n
case, the subject matter of dispute where the respondent-
\n                                          4<\/span><\/p>\n
         plaintiff, who had earlier claimed ownership over the property<\/p>\n
         in dispute and the suit was decreed in his favour for recovery<\/p>\n
         of possession and mesne profits and for mandatory injunction,<\/p>\n
         has now agreed to concede the right and title in favour of the<\/p>\n
         appellants and not to press on his suit any further, the<\/p>\n
         compromise between the parties having been verified, and<\/p>\n
         learned counsel for the parties submitting that the matter may<\/p>\n
         be disposed of in terms of the said compromise, it appears<\/p>\n
         appropriate to dispose of the matter in terms of the<\/p>\n
         compromise between the parties.\n<\/p><\/blockquote>\n
               Therefore, while accepting the compromise as filed by<\/p>\n
         the parties on record, this first appeal stands disposed of; the<\/p>\n
         plaintiff-respondent is permitted not to press on his suit and,<\/p>\n
         accordingly, the civil suit (CO No.67\/2004) stands dismissed;<\/p>\n
         and the impugned judgment and decree dated 16.09.2005 are<\/p>\n
         annulled. The parties are left to bear their own costs.<\/p>\n<\/blockquote>\n
