The petitioner is located<br \/>\n\tat Gujarat. The Apparel House was projected and is constructed by<br \/>\n\tApparel Export Promotion Council (hereinafter referred to as the<br \/>\n\t Council ). The petitioner applied for allotment of space in<br \/>\n\tsuch Apparel House, which is located at Gurgaon. It appears that the<br \/>\n\tapplication of the petitioner was accepted, and the provisional<br \/>\n\tallotment letter was issued by the Council on 11.6.2007, whereby the<br \/>\n\tpetitioner was called upon to make payment of Rs. 12,29,970\/-, and<br \/>\n\tit was also conveyed to the petitioner that the possession shall be<br \/>\n\thanded over on leave &amp; license basis, but the agreement will<br \/>\n\thave to be entered for such purpose. As per the petitioner, the<br \/>\n\tpayment in part was made, and the request was made to handover the<br \/>\n\tpossession. Whereas, it is the case of the respondent Council that<br \/>\n\tpayment was not made as per the terms and condition, and therefore,<br \/>\n\tthe possession was not handed over. The aforesaid resulted into<br \/>\n\tdispute between the petitioner and the respondent Council, which has<br \/>\n\tled the petitioner to file the present petition before this Court.\n<\/p>\n<p>Heard<br \/>\n\tMr. Ansari learned Counsel for the petitioner, Mr. Pranav Trivedi<br \/>\n\twith Mr. Desai learned Counsel for respondent Nos. 2, 3, and Ms.<br \/>\n\tMandavia learned Counsel for respondent Nos. 1,4 and 5.\n<\/p>\n<p>The<br \/>\n\taspect, which deserves consideration in the present petition is the<br \/>\n\tpoint of jurisdiction of this Court under Article 226 of the<br \/>\n\tConstitution. It has been contended by learned Counsel for the<br \/>\n\tpetitioner that this Court has the jurisdiction, since the<br \/>\n\tpetitioner is located at Anand of Gujarat State, is doing business<br \/>\n\tat Gujarat, and is having factory at Gujarat, and he has no capacity<br \/>\n\tto file petition at High Court of Delhi or the High Court Punjab and<br \/>\n\tHaryana, and the cause of action has in part accrued within the<br \/>\n\tterritory of Gujarat.\n<\/p>\n<p>Whereas<br \/>\n\ton behalf of the respondent Council, it has been contended that the<br \/>\n\tcause of action has accrued only in territory of Punjab and Haryana<br \/>\n\tHigh Court, since the Apparel House is located at Gurgaon, or in any<br \/>\n\tcase since the registered office of the respondent Council is<br \/>\n\tlocated at Delhi, the petitioner has to ventilate grievance by<br \/>\n\tfiling appropriate petition, if permissible in law before the High<br \/>\n\tCourt of Punjab and Haryana or at High Court of Delhi and this Court<br \/>\n\tmay not have the territorial jurisdiction.\n<\/p>\n<p>It<br \/>\n\tappears that it is an admitted position that the Apparel House is a<br \/>\n\tplace where the showroom was to be allotted to the petitioner on<br \/>\n\tpayment of requisite amount. Further, the application of the<br \/>\n\tpetitioner for allotment of the showroom at the Apparel House,<br \/>\n\tthough made from Gujarat is processed at Delhi. The communication<br \/>\n\tfor provisional allotment is made from Delhi to the petitioner, but<br \/>\n\tthe provisional allotment cannot be termed as concluded contract. It<br \/>\n\tis only after the requisite payment is made by the petitioner and<br \/>\n\tthe leave and license agreement is entered into, and the possession<br \/>\n\tis handed over, it would be concluded contract. The payment to be<br \/>\n\tmade was at Delhi and leave and license agreement could be at Delhi<br \/>\n\tor at Gurgaon. In any case the possession of the property was to be<br \/>\n\thanded over at Gurgaon.\n<\/p>\n<p>Under<br \/>\n\tthese circumstances, it can be said that the cause of action has<br \/>\n\taccrued outside the territory of Gujarat State. Further, the<br \/>\n\tcancellation of the allotment, which is the basis for the present<br \/>\n\tpetition is relating to property located within the territory of<br \/>\n\tHigh Court of Punjab and Haryana at Gurgaon.\n<\/p>\n<p>Under<br \/>\n\tthese circumstances, as the cause of action cannot be said as having<br \/>\n\taccrued within the territory of Gujarat State, this Court will have<br \/>\n\tno territorial jurisdiction to entertain the dispute, which is<br \/>\n\traised in the present petition by the petitioner.\n<\/p>\n<p>The<br \/>\n\treference may be made to the decision of Apex Court in case of<br \/>\n\t<a href=\"\/doc\/1876565\/\">Kusum Ingots &amp; Allyes Ltd., v. Union of India and<\/a> another<br \/>\n\treported at 2004(6)SCC 254 and in case of the <a href=\"\/doc\/1307808\/\">Union of<br \/>\n\tIndia and others v. Adani Exports Ltd., and<\/a> another reported at<br \/>\n\t2002(1)SCC567.\n<\/p>\n<p>Under<br \/>\n\tthese circumstances, as this Court is having no territorial<br \/>\n\tjurisdiction for the cause, which is subject matter of the present<br \/>\n\tpetition, the petition cannot be entertained.\n<\/p>\n<p>Hence,<br \/>\n\tthe present petition is dismissed. Rule discharged.
