After a full-fledged inquiry and finding<br \/>\nof serious misconduct on the part of the respondent, an order of<br \/>\npunishment was made, which was taken in review by the appellant<br \/>\nitself and finally, the respondent was visited<br \/>\nwith punishment of stoppage of four increments with permanent effect.<br \/>\nAfter exhausting departmental appeals, respondent had approached the<br \/>\nIndustrial Tribunal with Reference in the year 1985 which was<br \/>\nregistered as Reference (I.T.) No. 99 of 1991. Thereafter, another<br \/>\nReference for the same dispute appears to have been made which came<br \/>\nto be registered as Reference (I.T.) No. 71 of 1997. The Industrial<br \/>\nTribunal, Bhavnagar, consolidated both the References, and by the<br \/>\naward dated 14.09.1998, set aside the order of punishment only on the<br \/>\nground that the appellant had failed to produce record of the<br \/>\ndepartmental inquiry, due to which adverse inference had to be drawn<br \/>\nagainst the appellant. When that awarded and order of the Industrial<br \/>\nTribunal was challenged before learned Single Judge of this Court,<br \/>\nthe petition was dismissed by the impugned order.\n<\/p>\n<p>3.\tThere<br \/>\nis no dispute about the fact that the departmental inquiry against<br \/>\nthe respondent, for the charge of              re-issuing tickets to<br \/>\nfive passengers, was initiated in the year 1980 and both the<br \/>\nreference cases pending before the Tribunal had remained dormant<br \/>\ntill the year 1997.\n<\/p>\n<p>It was on 31.07.1997 that the respondent obtained an order for<br \/>\nproduction of the record of inquiry and the record could not be<br \/>\nproduced on account of it having been destroyed in the meantime. On<br \/>\nthe other hand, the respondent himself had submitted a pursis before<br \/>\nthe Tribunal to state that he was not challenging legality of the<br \/>\ninquiry proceeding but only the finding and the punishment were<br \/>\ncalled into question.\n<\/p>\n<p>4.\tIt<br \/>\nis clear from the peculiar facts of the case that not only that the<br \/>\nrespondent had his dispute referred twice but the first Reference<br \/>\nremained pending in the Tribunal for seven years. It was nearly after<br \/>\nfifteen years of the disciplinary action that the record was called<br \/>\nupon to be produced. Thus, the respondent stood to benefit from the<br \/>\nunexplained delay in the proceedings before the Industrial Tribunal.<br \/>\nEven as the appellant would have so many cases pending against it and<br \/>\nso much other records to preserve, the respondent would have his own<br \/>\nrecord of the inquiry and proceedings and he  ought to have produced<br \/>\nthem before the<br \/>\nTribunal to discharge the primary burden of evidence which rested on<br \/>\nhim. Instead, practically even in absence of any evidence in favour<br \/>\nof the respondent and only on the basis of the failure of the<br \/>\nappellant to produce the record that the award was made by the<br \/>\nTribunal. Therefore, the award was required to be set aside as<br \/>\nperverse and illegal.\n<\/p>\n<p>5.\tLearned<br \/>\nSingle Judge erred in observing, while upholding the award, that the<br \/>\nTribunal had no other option,                in absence of the<br \/>\nrecord, but to pass the appropriate order granting relief in favour<br \/>\nof the respondent-workman. The Tribunal was required to resolve the<br \/>\nindustrial dispute in a reasonable and rational manner, taking into<br \/>\nconsideration all the relevant facts including the fact of the<br \/>\nrespondent having delayed his demand for the documents till the fag<br \/>\nend of the proceeding before the Tribunal.\n<\/p>\n<p>6.\tIt<br \/>\nwas vehemently argued by learned counsel, Mr. Pathak that an officer<br \/>\nof the appellant had admitted in his deposition before the Tribunal<br \/>\nthat as long las the departmental appeals were pending, the records<br \/>\nwere not destroyed and it was within six months of such departmental<br \/>\nproceedings that reference of the industrial dispute was made.<br \/>\nTherefore, the appellants were not justified in not producing the<br \/>\nrecord of the departmental inquiry, according to his submission.<br \/>\nHowever, such contention could not derogate from the fact that<br \/>\nexcessive time had elapsed before the respondent first demanded the<br \/>\nrecord and he himself could have produced the relevant documents<br \/>\nwhich he ought to have preserved.\n<\/p>\n<p>7.\tIn<br \/>\nthe facts and for the reasons discussed hereinabove, the appeal is<br \/>\nallowed. The impugned judgement of learned Single Judge passed in<br \/>\nSpecial Civil Application No. 5060 of 1999 as well as the award and<br \/>\norder dated 14.09.1998 of the Industrial Tribunal, Bhavnagar, in<br \/>\nreference (I.T.)
