No.19784 of 2010\n        GIRINENDRA KUMAR @ GIRINENDRA KUMAR JHA @ LUTTU\n                              Versus\n                          STATE OF BIHAR\n                           -----------\n<\/pre>\n<p>2   23.06.2010           Heard learned counsel appearing on behalf<\/p>\n<p>                of the petitioner and learned counsel appearing<\/p>\n<p>                on behalf of the State.\n<\/p>\n<p>                           The petitioner is in custody in connection<\/p>\n<p>                with      Mithanpura       P.S.     Case    No.78    of    2009    for<\/p>\n<p>                offences punishable under Sections 489-A, 489-B,<\/p>\n<p>                489-C, 420 and 120-B of the Indian Penal Code.<\/p>\n<p>                           Learned        counsel    with     reference      to   the<\/p>\n<p>                statement of allegation as set out in the F.I.R.<\/p>\n<p>                submits that the alleged recovery is said to be<\/p>\n<p>                of three notes of Rs.1000\/- denomination, five<\/p>\n<p>                notes of Rs.500\/- denominations and five notes of<\/p>\n<p>                Rs. 50\/- denominations and which according to the<\/p>\n<p>                informant, appeared to be counterfeit.                       Learned<\/p>\n<p>                counsel submits that the statements are incorrect<\/p>\n<p>                and the petitioner has been taken into custody<\/p>\n<p>                merely on the basis of suspicion.                         He submits<\/p>\n<p>                that      apart    from     the     present   case    he    is    also<\/p>\n<p>                involved in other case bearing Mushari P.S. Case<\/p>\n<p>                No. 16 of 2008 for the offence punishable under<\/p>\n<p>                Section 307 of the Indian Penal Code and in which<\/p>\n<p>                he   is    on     bail.      Learned       counsel   submits      that<\/p>\n<p>                despite the fact that the petitioner was taken<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>          into    custody     on    23.5.2009       no    report      has       been<\/p>\n<p>          submitted in respect of alleged seizure.<\/p>\n<p>                    Having         regard      to        the        submissions<\/p>\n<p>          aforesaid, let the petitioner, namely, Girinendra<\/p>\n<p>          Kumar @ Girinendra Kumar Jha @ Lattu be released<\/p>\n<p>          on bail on furnishing bail bond of Rs. 10,000\/-<\/p>\n<p>          with    two    sureties      of    the    like    amount         to   the<\/p>\n<p>          satisfaction        of     the     learned       Chief      Judicial<\/p>\n<p>          Magistrate,         Muzaffarpur          in    connection             with<\/p>\n<p>          Mithanpura P.S. Case No. 78 of 2009 subject to<\/p>\n<p>          the following conditions:-\n<\/p>\n<p>                       (1) One of the close relatives of the<\/p>\n<p>          petitioner would stand as one of the bailors and<\/p>\n<p>          would    ensure     his     attendance         before      the    Court<\/p>\n<p>          below<\/p>\n<p>                        (2) The petitioner shall be attending<\/p>\n<p>          the trial of the case on each and every date<\/p>\n<p>          fixed without any break and the failure on the<\/p>\n<p>          part of the petitioner to attend the Court below<\/p>\n<p>          on     two    consecutive        dates    fixed      in    the        case<\/p>\n<p>          without       any       reasonable       explanation         to        the<\/p>\n<p>          satisfaction of the trial Court, would                       entitle<\/p>\n<p>          the Court concerned to initiate proceedings for<\/p>\n<p>          cancellation of his bail bond and for taking him<\/p>\n<p>          into custody.\n<\/p>\n<pre>Bibhash                                             ( Jyoti Saran, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Girinendra Kumar @ Girinendra &#8230; vs State Of Bihar on 23 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
