 This appeal<\/p>\n
by the Indian Airlines is directed<\/p>\n
against the order of the Uttar Pradesh State Consumer Disputes Redressal<\/p>\n
Commission holding it liable for the negligence<\/p>\n
of its agent in issuing confirmed air ticket from Lucknow to Delhi when there<\/p>\n
was no flight on that particular date.<\/p>\n
On a complaint filed by the first respondent- complainant S.N. Seth State Commission awarded him<\/p>\n
compensation of Rs.10,000\/-, Rs.1,210\/-<\/p>\n
being price of the air ticket with interest @ 18% per annum being the refund of the price of the ticket<\/p>\n
and Rs.500\/- as costs. State Commission<\/p>\n
passed this order not only against the<\/p>\n
Appellants-Indian Airlines but also<\/p>\n
against its authorised<\/p>\n
travel agent viz. M\/s. Continental Travel Service <\/p>\n
\u00a0 <\/p>\n
(Delhi) Pvt. Ltd. who is respondent No.3 in this appeal. It is this third respondent who had issued<\/p>\n
the air tickets through the second<\/p>\n
respondent also working as travel<\/p>\n
agent.\n<\/p>\n
 Seth is a<\/p>\n
pensioner and is a retired officer of Indian Administrative Service. On 19.5.1995 he purchased tickets of the<\/p>\n
Indian Airlines for the journey from<\/p>\n
Delhi to Lucknow for 23.5.95 and from Lucknow<\/p>\n
to Delhi for 25.9.94. It is not disputed that the third respondent Continental Travel Service (Delhi) Pvt. Ltd.<\/p>\n
was the authorised travel agent of the Indian Airlines. Seth paid Rs.3024\/- being the price of the<\/p>\n
two tickets, the flight from Lucknow to Delhi being return flight. When he reached Lucknow airport<\/p>\n
on that day he was told<\/p>\n
that there was no flight on that day<\/p>\n
which undoubtedly caused him great deal<\/p>\n
of harassment, inconvenience and expense.<\/p>\n
 Seth has<\/p>\n
submitted in his written arguments that<\/p>\n
when he reached the airport staff of<\/p>\n
the Indian Airlines instead of being<\/p>\n
sympathetic to him since he was holding a confirmed air<\/p>\n
ticket they rather laughed at him and offered no help. Seth wrote to the Indian Airlines who<\/p>\n
accepted the lapse on the part of their travel agent and in turn said that<\/p>\n
travel agent has been asked to apologize to<\/p>\n
him. Indian Airlines also offered<\/p>\n
Seth and his wife two complimentary<\/p>\n
air tickets from Lucknow to Delhi and back. Offer of apology and<\/p>\n
two complimentary air tickets was<\/p>\n
not accepted by Seth.\n<\/p>\n
He made a claim for Rs.5.00 lakhs<\/p>\n
towards damages.\n<\/p>\n
 Now in the<\/p>\n
written version stand of the Indian Airlines was that Continental Travel Service (Delhi) Pvt. Ltd. was<\/p>\n
ticketing agent to a<\/p>\n
limited extent to sell Indian<\/p>\n
Airlines tickets in accordance with the flight operation schedules and timings notified by the<\/p>\n
Indian airlines. In issuing wrong confirmed ticket regarding the<\/p>\n
date\/day of flight in question <\/p>\n
\u00a0 <\/p>\n
due to inadvertence, negligence<\/p>\n
or otherwise Continental Travel Service (Delhi) Pvt. Ltd. acted contrary<\/p>\n
to the instructions of the Indian<\/p>\n
Airlines and in such<\/p>\n
circumstances Indian airlines shall not<\/p>\n
be responsible for any consequential loss to the complainant as action of the<\/p>\n
said travel agent was beyond the scope of his authority. This defense of the Indian Airlines did not find acceptance<\/p>\n
by the State Commission. Stand of the Indian Airlines was that summer schedule of its flight was introduced w.e.f. 7.5.1995 and<\/p>\n
there was no flight from Lucknow to Delhi<\/p>\n
on every Thursday and that this information was placed on<\/p>\n
reservation system of the Indian<\/p>\n
Airlines and all the travel agents<\/p>\n
and interline partners were<\/p>\n
informed about it well in advance and<\/p>\n
that under these circumstances it was not possible to place any requisition for<\/p>\n
reservation or reservation system of the Airlines for the flight in question<\/p>\n
when on that particular date flight was not to operate. Further stand of the Indian airlines was that Continental Travel Service (Delhi)<\/p>\n
Pvt. Ltd. had acted in dual<\/p>\n
capacity, first as an agent of the complainant and secondly<\/p>\n
as a ticketing agent to sell the<\/p>\n
tickets to the limited extent of the Indian Airlines. <\/p>\n
 State<\/p>\n
Commission after examining the whole aspect of the matter found both the Indian<\/p>\n
Airlines and the Continental Travel<\/p>\n
Service (Delhi) Pvt. Ltd. deficient in<\/p>\n
service and awarded compensation as aforesaid. It was submitted by the<\/p>\n
learned counsel for the Indian airlines that it was the travel agent who was at<\/p>\n
fault and no liability could be imposed on the Indian Airlines. In support of her submission she referred to<\/p>\n
two decisions earlier rendered by this<\/p>\n
Commission in the case of Indian Airlines Corporation Vs. Patel Ramubhai<\/p>\n
Shanker Lal & Anr. – II (1993) CPJ 205 (NC) and Chief Commercial<\/p>\n
Officer, Indian Airlines & Anr. Vs. P. Lalchand & Anr. – II (1996) CPJ<\/p>\n
61 (NC). It was, therefore, submitted<\/p>\n
that the <\/p>\n
\u00a0 <\/p>\n
\u00a0 <\/p>\n
order of the State Commission was against the law laid down by the<\/p>\n
National Commission and the impugned order therefore could not stand.<\/p>\n
 We have<\/p>\n
examined these two judgments and in our view these judgments would confine to<\/p>\n
the facts of those cases. We have not<\/p>\n
been shown as to what were the terms of<\/p>\n
agency of Continental Travel Service<\/p>\n
(Delhi) Pvt. Ltd. Agency agreement has not been placed on<\/p>\n
record. To say that Continental Travel<\/p>\n
Service (Delhi) Pvt. Ltd. was travel<\/p>\n
agent only to a limited extent is not<\/p>\n
enough. The terms of the agency<\/p>\n
agreement were well within the<\/p>\n
knowledge of the Indian Airlines which<\/p>\n
have not been brought on record. In<\/p>\n
the correspondence that ensued between Seth<\/p>\n
and Indian Airlines before<\/p>\n
filing the complaint, it was not the case of the Indian Airlines that it<\/p>\n
was not responsible under the agency<\/p>\n
agreement with Continental Travel<\/p>\n
Service (Delhi) Pvt. Ltd.\n<\/p>\n
It has to be held that travel agent is the agent of the Indian Airlines<\/p>\n
and it acts on behalf of its principal,<\/p>\n
the Indian airlines. If for any negligent act of agent loss is caused<\/p>\n
to the third party principal is<\/p>\n
certainly liable. Issuing air ticket on behalf of the Indian Airlines<\/p>\n
a contract has been entered into between Seth and Indian airlines. In such circumstances principal would<\/p>\n
certainly be bound by the terms of the<\/p>\n
contract. Section 230 of the<\/p>\n
Indian Contact Act<\/p>\n
provides that In the absence of any contract to that effect an agent<\/p>\n
cannot personally enforce contracts entered into by him on behalf of his<\/p>\n
principal, nor is he personally bound by them. In number of cases this Commission has taken decision based on<\/p>\n
the Law of Contract and contractual<\/p>\n
terms that no liability can lay<\/p>\n
on the agent who can neither sue or be sued<\/p>\n
and it <\/p>\n
\u00a0 <\/p>\n
\u00a0 <\/p>\n
is the principal who is answerable. <\/p>\n
 Supreme<\/p>\n
Court in the case of Marine Container<\/p>\n
Services South Pvt . Ltd.\n<\/p>\n
Vs. GO GO Garments –\n<\/p>\n
(1998) 3 SCC<\/p>\n
247 has clearly<\/p>\n
stated in <\/p>\n
unmistakable language that Contract Act applies to the complaints filed under the Consumer protection Act, 1986. This is how the supreme Court observed:<\/p>\n
We are not a<\/p>\n
little surprised to read that the Contract Act does not apply to complaints<\/p>\n
filed under the Consumer Protection Act.<\/p>\n
The Contract Act applies to all the litigants before the Commission<\/p>\n
under the Consumer Protection Act included.<\/p>\n
Whether in proceedings before the Commission or otherwise, an agent is<\/p>\n
entitled to invoke the provisions of Section 230 of the Contract Act and, if<\/p>\n
the facts found support him, his<\/p>\n
defence based thereon cannot be brushed away.<\/p>\n
\u00a0 <\/p>\n
 It could be<\/p>\n
said that we are deviating in this case from the principle of law laid by this Commission earlier in two cases<\/p>\n
aforesaid. National Commission or<\/p>\n
Consumer Forum under the Consumer<\/p>\n
Protection Act, has no power of review<\/p>\n
as held by Supreme Court in the case<\/p>\n
In Jyotsana Arvind Kumar Shah &<\/p>\n
Ors. Vs. Bombay Hospital Trust – 1999<\/p>\n
(4) SCC 325. That would apply to that<\/p>\n
case itself and if we find that decision earlier rendered was contrary to the law<\/p>\n
as laid by the Supreme Court it can certainly take a different view. <\/p>\n
  We have not been shown any statutory<\/p>\n
provision under which Indian Airlines can be absolved of its responsibility for<\/p>\n
the acts of its agent when acting within the scope of its authority. In the present case, Continental Travel<\/p>\n
Service (Delhi) Pvt. Ltd., an<\/p>\n
agent, has issued confirmed<\/p>\n
ticket from Lucknow to Delhi on a day when there was no flight. It is a clear case of deficiency in service<\/p>\n
for which Indian Airlines, the<\/p>\n
principal is liable. The order of<\/p>\n
the State Commission is correct; we affirm the same and would dismiss the<\/p>\n
appeal with cost.\n<\/p>\n
 Though<\/p>\n
complainant-respondent No.1 did not<\/p>\n
appear in person but he wrote that<\/p>\n
being a retired officer with meager pension he could not come to Delhi as one visit costs<\/p>\n
Rs.5,000\/-. He, therefore, sent<\/p>\n
written notes of submissions. He is,<\/p>\n
therefore, entitled to cost which we<\/p>\n
assess at Rs.2,000\/-.\n<\/p>\n
