No.2249 OF 2007\n                ----------------------------------------\n           Dated this the 28th day of January, 2009\n\n                        J U D G M E N T\n<\/pre>\n<p>                        ~~~~~~~~~~~<\/p>\n<p>Balakrishnan Nair, J.\n<\/p>\n<\/p>\n<p>     The writ petitioner is the appellant. He approached this<\/p>\n<p>Court, filing the writ petition, challenging Ext.P7 order, as per<\/p>\n<p>which he has been temporarily disqualified from holding the<\/p>\n<p>post of Corporate Manager of the schools managed by Central<\/p>\n<p>Board of Anglo Indian Education, Kochi.\n<\/p>\n<\/p>\n<p>     2.    The brief facts of the case are the following:<\/p>\n<p>     The appellant\/petitioner was elected Corporate Manager<\/p>\n<p>of the schools run by Central Board of Anglo Indian Education,<\/p>\n<p>by the said Educational Agency.          While so, one Mr. Watson<\/p>\n<p>Rodrigues moved the Vigilance Court making certain allegations<\/p>\n<p>against him. The allegations included the charges of bribery<\/p>\n<p>also. The Vigilance Court after holding preliminary enquiry,<\/p>\n<p>directed the Vigilance and Anti Corruption Bureau, Ernakulam<\/p>\n<p>to register a case and investigate it. Pursuant to that, a crime<\/p>\n<p><span class=\"hidden_text\">W.A.No.2249\/2007                  2<\/span><\/p>\n<p>has been registered against the appellant. The Vigilance and Anti<\/p>\n<p>Corruption Bureau moved the Government to take steps to keep<\/p>\n<p>the appellant away from Managership, pending investigation of<\/p>\n<p>the case. The Government forwarded the said request to the<\/p>\n<p>Director of Public Instruction, Trivandrum, for appropriate<\/p>\n<p>action.   The Director, in turn, passed Ext.P7 order dated<\/p>\n<p>23.7.2007, temporarily disqualifying the appellant from holding<\/p>\n<p>the post of Manager. It was also provided in the order that the<\/p>\n<p>same will be reviewed after the finalisation of the vigilance case.<\/p>\n<p>The appellant challenged that order before this Court.          The<\/p>\n<p>learned Single Judge found the order bad, as it was issued<\/p>\n<p>without hearing the appellant. So, the learned Judge ordered<\/p>\n<p>that Ext.P7 shall be treated as a notice and the Director of Public<\/p>\n<p>Instruction was directed to hear the parties, consider the<\/p>\n<p>objections of the appellant and pass final orders in the matter,<\/p>\n<p>expeditiously.    It was also ordered that the temporary<\/p>\n<p>disqualification will continue till a final decision is taken by the<\/p>\n<p>Director.     Mainly aggrieved by the said direction, concerning<\/p>\n<p>continuance of the disqualification, the present appeal is filed.<\/p>\n<p><span class=\"hidden_text\">W.A.No.2249\/2007                 3<\/span><\/p>\n<p>     3.    The learned senior counsel, Mr. K.Ramkumar,<\/p>\n<p>appearing for the appellant submitted that the Director of Public<\/p>\n<p>Instruction has no power to issue an order of temporary<\/p>\n<p>disqualification, as was done under Ext.P7. It is also submitted<\/p>\n<p>that having regard to the provisions of Rule 7(1) of Chapter III of<\/p>\n<p>the K.E.R., purportedly, under which the action was taken, the<\/p>\n<p>appellant should have been issued with notice and his objections<\/p>\n<p>considered before such an order was passed. In other words,<\/p>\n<p>even an order of temporary disqualification can be passed only<\/p>\n<p>after issuing notice. Even assuming, there is power for the same<\/p>\n<p>in the Director, the direction to give the post-decisional hearing<\/p>\n<p>ordered by the learned Single Judge is not proper. The learned<\/p>\n<p>counsel also submitted that the ground taken in Ext.P7 is not a<\/p>\n<p>ground available under Rule 7(1).\n<\/p>\n<\/p>\n<p>     4.    We     heard  the    learned    Government     Pleader,<\/p>\n<p>Smt.R.Bindu, for the official respondents and also M\/s.<\/p>\n<p>S.P.Aravindakshan Pillay, Elvin Peter, Julian Xavier and Paul<\/p>\n<p>Abraham Vakkanal for the party respondents.\n<\/p>\n<p><span class=\"hidden_text\">W.A.No.2249\/2007                   4<\/span><\/p>\n<p>      5.   First, we will deal with the preliminary objection<\/p>\n<p>raised by the learned senior counsel for the appellant.<\/p>\n<p>According to him, the rules do not confer any power on the<\/p>\n<p>Director to temporarily disqualify the Manager. It is well settled<\/p>\n<p>that if a power is conferred on an authority to do something, the<\/p>\n<p>express grant of power will take within its fold, the ancillary or<\/p>\n<p>incidental powers necessary for the effective exercise of the<\/p>\n<p>power expressly conferred. If very serious allegations are raised<\/p>\n<p>against the Manager and the Director finds, prima facie, that<\/p>\n<p>they are sustainable and therefore action is warranted, he should<\/p>\n<p>be conceded freedom to temporarily keep the Manager away<\/p>\n<p>from    Managership, pending finalisation of the proceedings<\/p>\n<p>against him. Therefore, the contention of the learned senior<\/p>\n<p>counsel that the Director does not have the power to pass an<\/p>\n<p>interim order, temporarily suspending the Manager, cannot be<\/p>\n<p>accepted.\n<\/p>\n<\/p>\n<p>      6.   Rule 7(1) of Chapter III K.E.R. reads as follows:<\/p>\n<blockquote><p>            &#8220;7.  Action against Manager or Educational<br \/>\n            Agency in the event of mismanagement etc.<\/p>\n<p><span class=\"hidden_text\">W.A.No.2249\/2007                   5<\/span><\/p>\n<p>                  (1)   In the event of mismanagement,<br \/>\n            malpractice, corruption or maladministration,<br \/>\n            gross negligence of duty, or disobedience of<br \/>\n            Departmental instruction on the part of the<br \/>\n            Manager or denial of appointment to a<br \/>\n            qualified thrownout teacher who has a<br \/>\n            rightful claim for reappointment by virtue of<br \/>\n            his\/her holding the post earlier or denial of<br \/>\n            promotion to a teacher who is rightful<br \/>\n            claimant for promotion by the manager or<br \/>\n            conviction of the Manager for an offence<br \/>\n            involving moral turpitude it shall be open to<br \/>\n            the Director, after giving the Manager a<br \/>\n            reasonable opportunity to show cause against<br \/>\n            the action proposed to be taken and after due<br \/>\n            enquiry, to declare him unfit to hold the<br \/>\n            office of Manager in the school or in any<br \/>\n            other aided school and to require the<br \/>\n            educational Agency to appoint a suitable<br \/>\n            person as Manager.&#8221;\n<\/p><\/blockquote>\n<p>Allegations of corruption is one of the grounds available under<\/p>\n<p>Sub rule (1) of Rule 7 quoted above for disqualifying a Manager.<\/p>\n<p>     7.    The impugned order, Ext.P7, reads as follows:<\/p>\n<blockquote><p>            &#8220;As   per   the  letter  read   first  above,<br \/>\n            Government have forwarded the request of<br \/>\n            the V&amp;ACB, Ernakulam Unit for necessary<br \/>\n            action. The V&amp;ACB, Ernakulam Unit has<br \/>\n            informed that Smt.Leslie Bevera, Chairman &amp;<\/p>\n<p><span class=\"hidden_text\">W.A.No.2249\/2007                     6<\/span><\/p>\n<p>            Corporate Manager, Central Board of Anglo<br \/>\n            Indian Education, Kochi has involved in a<br \/>\n            bribery case and FIR submitted before the<br \/>\n            Vigilance Court. The Vigilance Bureau has also<br \/>\n            observed that the continuance of the accused<br \/>\n            in the official position will adversely reflect in<br \/>\n            the   enquiry    by   inducing   witnesses   and<br \/>\n            destroying records of evidentiary value. The<br \/>\n            procedure for the disqualification will take a<br \/>\n            long time and will became against the spirit of<br \/>\n            the request of the V&amp;ACB. So Smt.Leslie<br \/>\n            Bevera, Corporate Manager, Central Board of<br \/>\n            Anglo Indian Education, Kochi is temporally<br \/>\n            disqualified from the managership in terms of<br \/>\n            Rule 7 of Chapter III KER. This order will be<br \/>\n            reviewed after the finalisation of this<br \/>\n            vigilance case.&#8221;\n<\/p><\/blockquote>\n<p>     8.    Going by the above order, the ground taken for<\/p>\n<p>suspension of the Manager is the observation of the Vigilance<\/p>\n<p>and Anti Corruption Bureau that the continuance of the<\/p>\n<p>appellant in the official position will adversely affect the enquiry<\/p>\n<p>by inducing witnesses and          destroying records of evidentiary<\/p>\n<p>value. Since the procedure for disqualification will take a long<\/p>\n<p>time, the Director decided to keep him under temporary<\/p>\n<p>disqualification. It was also said that this order will be reviewed<\/p>\n<p><span class=\"hidden_text\">W.A.No.2249\/2007                   7<\/span><\/p>\n<p>after the finalisation of the vigilance case. The same would show<\/p>\n<p>that the appellant has been temporarily disqualified, relying on<\/p>\n<p>the observation of the Vigilance Anti Corruption Bureau and the<\/p>\n<p>same will remain in force, till the finalisation of the vigilance<\/p>\n<p>case.\n<\/p>\n<\/p>\n<p>     9.     We notice that the ground taken in Ext.P7 is not a<\/p>\n<p>ground available under Rule 7(1). But, based on the materials<\/p>\n<p>produced before the D.P.I., if the said officer feels that the<\/p>\n<p>Manager should be disqualified on the ground of corruption,<\/p>\n<p>notwithstanding the fate of the vigilance case, the D.P.I. can<\/p>\n<p>proceed to disqualify the appellant. While proceeding so, if the<\/p>\n<p>D.P.I. feels that it is necessary to temporarily disqualify him,<\/p>\n<p>pending finalisation of the proceedings against him, the same<\/p>\n<p>can also be done. But, we notice that the above jurisdictional<\/p>\n<p>facts are not available in this case. Ext.P7 is not issued based on<\/p>\n<p>the decision of the Director to disqualify the appellant, in view of<\/p>\n<p>the corruption charges against him.         So, the learned Single<\/p>\n<p>Judge has rightly ordered to treat Ext.P7 only as a notice. The<\/p>\n<p>appellant will be free to raise all his contentions before the D.P.I.<\/p>\n<p><span class=\"hidden_text\">W.A.No.2249\/2007                8<\/span><\/p>\n<p>The said officer, after hearing both sides, shall pass appropriate<\/p>\n<p>orders in the light of the above observations made by us, within<\/p>\n<p>six weeks from the date of production of a copy of this judgment.<\/p>\n<p>Till the matter is decided by the D.P.I., the appellant will be<\/p>\n<p>entitled to continue as Manager, provided the Educational<\/p>\n<p>Agency does not cancel his appointment.\n<\/p>\n<\/p>\n<p>      10. The party respondents herein, who oppose the<\/p>\n<p>continuance of the appellant as Manager, may be given a chance<\/p>\n<p>to represent their case by the D.P.I. But, for giving them a<\/p>\n<p>chance, the hearing shall not be adjourned.
