            Second petitioner is the second<\/p>\n
accused  in    C.C.76\/1992                on       the   file of<\/p>\n
Judicial    First              Class              Magistrate-II,<\/p>\n
Kottayam. He was convicted and sentenced<\/p>\n
for  the  offence            under          Section       324 of<\/p>\n
Indian  Penal          Code          along            with  first<\/p>\n
petitioner\/first           accused.                Though    they<\/p>\n
challenged   the         conviction                and   sentence<\/p>\n
before   Sessions              Court,              Kottayam    in<\/p>\n
Crl.A.138\/1997, learned Additional Sessions<\/p>\n
Judge  on     re-appreciation                       of   evidence<\/p>\n
confirmed the conviction and sentence and<\/p>\n
dismissed the appeal. It is challenged in<\/p>\n
the  revision.          When          the         revision    was<\/p>\n
pending, first revision petitioner died on<\/p>\n
CRRP 229\/02               2<\/span><\/p>\n
11\/1\/2005. Consequently charge as against the<\/p>\n
first     revision  petitioner  has   abated.  The<\/p>\n
question which      survives for consideration is<\/p>\n
only whether the conviction and sentence for<\/p>\n
the offence under Section 324 read with Section<\/p>\n
34 of      Indian Penal Code as against the second<\/p>\n
petitioner is legal and proper.\n<\/p>\n
           2. Prosecution   case   is    that   on\n\n1\/10\/1988     at  about   8.45  p.m,  due  to  the\n\nprevious      enmity  of  the   accused  to   PW5,\n\n<\/pre>\n
petitioners poured acid on PW2, while he was<\/p>\n
standing near the gate of house of PW5 and<\/p>\n
thereby committed the offence under Sections<\/p>\n
308 and 326 read with Section 34 of         Indian<\/p>\n
Penal Code. Though learned Magistrate committed<\/p>\n
the case to Sessions court, Kottayam which was<\/p>\n
taken on file as S.C.29\/1989, learned     Sessions<\/p>\n
Judge finding that an offence under Section 308<\/p>\n
of Indian Penal Code exclusively triable by the<\/p>\n
CRRP 229\/02            3<\/span><\/p>\n
Sessions Court is not involved, sent back the<\/p>\n
records to Chief Judicial  Magistrate for trial<\/p>\n
after, framing the charge for the offence under<\/p>\n
Section 326 read with Section 34 of Indian<\/p>\n
Penal Code. Learned Chief Judicial   Magistrate<\/p>\n
made over the case to Judicial First Class<\/p>\n
Magistrate-II, Kottayam. Learned Magistrate on<\/p>\n
the evidence of Pws.1 to 11 and Exts.P1 to P6 ,<\/p>\n
called upon the petitioner to enter on his<\/p>\n
defence    and adduce evidence.   Accused  then<\/p>\n
examined    DW1 and   marked  Ext.D1.   Learned<\/p>\n
Magistrate   on the  evidence  found  that  the<\/p>\n
accused poured acid on PW2 in furtherance of<\/p>\n
their common intention and voluntarily caused<\/p>\n
hurt and thereby committed the offence under<\/p>\n
Section 324 read with Section 34 of      Indian<\/p>\n
Penal Code. Accused were sentenced to simple<\/p>\n
imprisonment for one month. Learned    Sessions<\/p>\n
Judge re-appreciated the evidence and confirmed<\/p>\n
CRRP 229\/02               4<\/span><\/p>\n
the     conviction.   Argument  of  the   learned<\/p>\n
counsel     appearing  for  the  second  revision<\/p>\n
petitioner is that evidence was not properly<\/p>\n
appreciated by the courts below and evidence of<\/p>\n
DW1 with     Ext.D1 should have been accepted by<\/p>\n
the courts below and it should have been   found<\/p>\n
that PW2 sustained injuries not from the hands<\/p>\n
of the accused but when PW2 and others poured<\/p>\n
acid on the house of the accused while causing<\/p>\n
damage to the house and in such circumstances,<\/p>\n
conviction is not sustainable.\n<\/p>\n
           3. Evidence of PW7, the doctor with<\/p>\n
Ext.P3 wound certificate establish that at 9<\/p>\n
p.m     on   1\/10\/1988,  immediately  after  the<\/p>\n
incident, PW2 was examined by the doctor from<\/p>\n
District     Hospital, Kottayam  and  the doctor<\/p>\n
noted burns on his face, left shoulder, left<\/p>\n
arm, left ear, neck and left eye. Left cornea<\/p>\n
was found hazy. Considering the condition of<\/p>\n

the    patient,   he  was  referred  to   Medical<\/p>\n
College,    Hospital. Alleged   cause  of  injury<\/p>\n
disclosed to the doctor was sustained when acid<\/p>\n
was poured        at about 8.55 p.m at Erettu<\/p>\n
Kadavu.    Ext.P6  discharge  certificate  issued<\/p>\n
from the      Medical College Hospital, Kottayam<\/p>\n
proved by the evidence of PW11, who identified<\/p>\n
the      signature of Professor of Ophthalmology<\/p>\n
who was not then in a service, establish that<\/p>\n
PW2 was treated in the hospital as an inpatient<\/p>\n
from 1\/10\/1988 to 24\/10\/1988. Evidence of PW7<\/p>\n
with Ext.P3      wound certificate establish that<\/p>\n
PW2 sustained hurt and the hurt was caused when<\/p>\n
acid was poured on PW2. Even suggestion given<\/p>\n
to PW7 the doctor was that those injuries were<\/p>\n
caused, when acid fell on PW2, evidently in<\/p>\n
tune with the defence case that PW2 and others<\/p>\n
attempted    to  cause damage  to  the  house  of<\/p>\n
accused and during that acts, acid was poured<\/p>\n

which accidentally fell on PW2. Therefore, it<\/p>\n
is conclusively proved that PW2 sustained hurt<\/p>\n
when acid fell on PW2. The only question is,<\/p>\n
whether it was poured by the accused or it had<\/p>\n
accidentally fallen on PW2 when PW2 and others,<\/p>\n
were committing damages to the house of the<\/p>\n
accused as canvassed by the defence.<\/p>\n
           4. I have  gone  through  the   entire<\/p>\n
evidence in the    light of the defence raised by<\/p>\n
the    petitioners.  As  rightly  found  by   the<\/p>\n
learned Magistrate and learned    Sessions Judge,<\/p>\n
it is absolutely clear from the evidence that<\/p>\n
PW2 did not     sustain injuries as canvassed by<\/p>\n
the    accused.  Though  crime  No.396\/1988   was<\/p>\n
registered in respect of the incident in which<\/p>\n
damages     were caused  to  the  house  of   the<\/p>\n
accused, there is no evidence to establish that<\/p>\n
it was in that incident PW2 sustained injury.<\/p>\n
Evidence of injured and Pws.3 and 4 the eye<\/p>\n

witnesses     were  properly appreciated  by  the<\/p>\n
courts below and I find no reason to differ<\/p>\n
with    the  findings  based on  appreciation  of<\/p>\n
evidence. Evidence conclusively establish that<\/p>\n
accused     voluntarily caused  hurt  to  PW2  by<\/p>\n
pouring acid which is corrosive substance on<\/p>\n
him in furtherance of their common intention.<\/p>\n
Therefore, conviction of the accused for the<\/p>\n
offence under Section 324 read with Section 34<\/p>\n
of   Indian Penal Code     is perfectly legal and<\/p>\n
warrants no interference.\n<\/p>\n
           5. Then the only question is regarding<\/p>\n
the sentence. Argument of the learned     counsel<\/p>\n
appearing for the second revision petitioner is<\/p>\n
that incident was in 1988 and at this distant<\/p>\n
point of time, second revision petitioner may<\/p>\n
not be sent to prison and PW2 is now no more<\/p>\n
and therefore, he is disabled from compounding<\/p>\n
the offence and as evidence establish that PW2<\/p>\n

sustained only simple burns     with no deformity<\/p>\n
in the interest of justice sentence may be<\/p>\n
modified to    fine.\n<\/p>\n
           6. Unfortunately prosecution  did  not<\/p>\n
adduce the evidence, which should have been<\/p>\n
adduced.      PW2   the  injured  has  not  given<\/p>\n
evidence     that  he  sustained  any   deformity<\/p>\n
consequent    to  the  burn  sustained.  PW7  the<\/p>\n
doctor had only seen PW2 on the date of the<\/p>\n
incident and referred him to Medical College.<\/p>\n
Therefore, PW7 is not in a position to give the<\/p>\n
details of the treatment or the consequence of<\/p>\n
the injuries. Though PW11 was examined, he did<\/p>\n
not treat PW2 and only identified the signature<\/p>\n
to formally prove Ext.P6 discharge certificate.<\/p>\n
Learned Magistrate has also not recorded that<\/p>\n
when     PW2 was   examined  he  could  find  any<\/p>\n
deformity on PW2. Ordinarily, it would not have<\/p>\n
been omitted to be taken note of by the learned<\/p>\n
CRRP 229\/02               9<\/span><\/p>\n
Magistrate      if   there   was   any   deformity.<\/p>\n
Considering the fact that the incident was in<\/p>\n
1988 and there is no evidence to prove that PW2<\/p>\n
suffered     any  deformity   and  the  threat   of<\/p>\n
imprisonment was hanging over the head of the<\/p>\n
petitioner for the last more than two decades,<\/p>\n
interest     of  justice  will   be  met,  if  the<\/p>\n
sentence     is  modified   to  imprisonment   till<\/p>\n
rising of court and compensation of Rs.15,000\/-<\/p>\n
to be paid to PW2 or is legal heirs. Sentence<\/p>\n
is accordingly modified.\n<\/p>\n
           Revision petition is allowed in part.<\/p>\n
Conviction     of  the   second  petitioner\/second<\/p>\n
accused in C.C.76\/92 on the file of Judicial<\/p>\n
First     Class  Magistrate-II,  Koyyayam  for  the<\/p>\n
offence under Section 324 read with Section 34<\/p>\n
of    Indian Penal Code     is confirmed. Sentence<\/p>\n
is modified. In supersession of the sentence<\/p>\n
awarded by the learned Magistrate and confirmed<\/p>\n
CRRP 229\/02              10<\/span><\/p>\n
by learned      Sessions Judge, second petitioner<\/p>\n
is sentenced to imprisonment till rising of<\/p>\n
court and compensation of Rs,15,000\/- (Rupees<\/p>\n
Fifteen thousand only) and in default simple<\/p>\n
imprisonment for one month. Second petitioner<\/p>\n
is directed to appear before the Judicial First<\/p>\n
Class     Magistrate-II, Kottayam  on  30\/8\/2010.<\/p>\n
Learned Magistrate     is directed to execute the<\/p>\n
sentence.\n<\/p>\n<\/p>\n
