S.J. MUKHOPADHAYA)<\/p>\n<p>ORDER<br \/>\nIN CA NO.4466\/2011:\n<\/p>\n<p>\tThis<br \/>\napplication is filed for condonation of delay of 51 days in<br \/>\npreferring the appeal against the order dated 13th December 2010<br \/>\npassed by the learned Single Judge in Special Civil Application No.<br \/>\n15089 of 2010.  The petitioner has given details as to when he<br \/>\napplied for the certified copy (14th December 2010) which was<br \/>\ndelivered to the counsel on 21st January 2010.  Thereafter, some time<br \/>\nwas taken by the lawyer to prefer the appeal.\n<\/p>\n<p>\tHaving<br \/>\nheard learned counsel for the parties, and being satisfied with the<br \/>\nexplanation given, delay of 51 days in preferring the appeal is<br \/>\ncondoned.  Civil Application stands disposed of.\n<\/p>\n<p>ORDER<br \/>\nIN LPA NO.552\/2011 &amp; CA NO.5309\/2011:\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the appellant and Mr. Umang Oza, counsel<br \/>\nappearing for the respondent.  From the impugned order dated 13th<br \/>\nDecember 2010 it will be evident that the impugned order is a<br \/>\nnon-speaking order passed by the learned Single Judge, which reads as<br \/>\nfollows:-\n<\/p>\n<p>&#8220;1.0\tHeard<br \/>\nlearned advocate Mr. Saurabh G. Amin for the petitioner.  The learned<br \/>\nadvocate for the petitioner states that, before reaching to the stage<br \/>\nof High Court, an amount of Rs.31,450\/- is spent towards legal<br \/>\nservices, whereas, an amount of Rs.20,000\/- is spent for the legal<br \/>\nservices at the High Court.\n<\/p>\n<p>2.0\tThe<br \/>\norder passed by the Tribunal is of discretionary in nature and this<br \/>\nCourt deems it proper not to interfere with the same.  Hence, the<br \/>\npetition is dismissed.&#8221;\n<\/p>\n<p>\tFor<br \/>\nthe reasons aforesaid, we set aside the order dated 13th December<br \/>\n2010 and remit the case, Special Civil Application No. 15089 of 2010<br \/>\nto the learned Single Judge for decision on merit.
