Secy. &#8230; on 19 July, 2010<\/div>\n<pre>                                      1\n\n                                                                  Court No. 1\n\nWrit Petition No. 6691 (MB) of 2010\nM\/s Rakesh Yadav\nVs.\nThe State of U.P. and others.\n\n\nHon'ble Pradeep Kant, J.\n<\/pre>\n<p>Hon&#8217;ble Ritu Raj Awasthi, J.\n<\/p>\n<p>       Heard the counsel for the petitioner Miss Parul Kant and Sri Shishir<br \/>\nJain for respondents no. 2 and 3.\n<\/p>\n<p>       The petitioner was awarded contract for construction and<br \/>\nmaintenance of roads in district Sitapur by U.P. Rajkiya Nirman Nigam Ltd.<br \/>\non 15.4.08.\n<\/p>\n<p>       The petitioner feels aggrieved by encashment of bank guarantee as<br \/>\nis evident by the letter written by Additional Project Manager to the Senior<br \/>\nBranch Manager, Vijaya Bank, Navyug Market, Ghaziabad on 3.7.2010.\n<\/p>\n<p>       Learned counsel for the petitioner submits that without giving any<br \/>\ninformation and without disclosing the reason as to why the bank guarantee<br \/>\nis being encashed, the aforesaid effort is being made.\n<\/p>\n<p>       Sri Shishir Jain has produced before us a photocopy of the letter<br \/>\ndated 27.10.09, which is addressed to M\/s Rakesh Yadav, the present<br \/>\npetitioner, and has been sent by registered post. Photocopy of the registered<br \/>\npostal receipt showing the aforesaid dispatch has also been produced before<br \/>\nus. Both the documents are being placed on record.\n<\/p>\n<p>       The aforesaid letter says that according to the contract bond, the date<br \/>\nof completion of work was 31.1.09 but even upto 30.6.09 less than 30% of<br \/>\nthe work has been done. The letter further says that the petitioner was<br \/>\ncautioned and reminded though various letters by the Engineer Incharge but<br \/>\nall in vain and that the petitioner has violated the provisions of the contract<br \/>\nand committed breach of contract and, therefore, its contract bond is being<br \/>\nterminated.\n<\/p>\n<p>       Learned counsel for the petitioner again submitted that this letter<br \/>\nsince was not received by the petitioner, therefore, she is not aware about<br \/>\nthe same.\n<\/p>\n<p>       Firstly, there is presumption of service of such a letter, which has<br \/>\nbeen sent by registered post and secondly, writ petition against encashment<br \/>\nof bank guarantee, in a matter where contract bond has been cancelled,<br \/>\n<span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>would not lie, under Article 226 of the Constitution.\n<\/p>\n<p>       The relief claimed thus, cannot be granted in writ jurisdiction.<br \/>\n       The petitioner has the remedy of approaching any other forum, as<br \/>\nmay be available under law.\n<\/p>\n<p>       The petition is dismissed, subject to aforesaid liberty.\n<\/p>\n<p>Dated: 19.7.2010<br \/>\nMFA\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court M\/S Rakesh Yadav Through Its Prop. vs State Of U.P.Through Prin.
