Chauhan\n\nHon'ble Ferdino Inacio Rebello,Chief Justice\nHon'ble Amreshwar Pratap Sahi,J.\n<\/pre>\n<p>We have perused the impugned interim order.\n<\/p>\n<p>On an application in a pending petition filed by respondent no. 1,<br \/>\noriginal petitioner, the learned Single Judge has been pleased to<br \/>\ndirect the University to declare his result in which he has appeared.<br \/>\nThere was an earlier interim order dated 07.12.2009 whereby he<br \/>\nwas allowed to appear in the said examination with a clear<br \/>\nstipulation that the results shall not be declared and would abide by<br \/>\nthe final outcome of the petition. Against the said interim order, a<br \/>\nspecial appeal was filed by the University which was dismissed,<br \/>\nagainst which the University has preferred a special leave petition<br \/>\nbefore the Supreme Court wherein notices have been issued to the<br \/>\nrespondents therein including the Dental Council of India.\n<\/p>\n<p>It is the contention of the learned counsel appearing for the<br \/>\nUniversity that the Regulations known as the &#8216;DCI Revised BDS<br \/>\nCourse Regulations, 2007&#8217; specifically sets out that any candidate<br \/>\nwho fails in one subject in any examination is permitted to go to<br \/>\nthe next higher class and appear for the subject and complete it<br \/>\nsuccessfully before he can appear for the next higher examination.<br \/>\nHe points out that considering the clear and express language of<br \/>\nthe Regulations, the students, who have failed in more than one<br \/>\nsubject, cannot be allowed to keep terms for the next higher<br \/>\nexamination.\n<\/p>\n<p>The stand of the respondent student is that there has been a long<br \/>\npractice by which this regulation has not been followed.<br \/>\nThe grievance of the University is against the interim order passed<br \/>\nwhich is in the nature of mandatory direction to declare the results.\n<\/p>\n<p>Considering the controversy, in our opinion, such an order could<br \/>\nnot have been passed as the earlier interim order dated 07.12.2009<br \/>\nitself restrained the University from declaring the results and made<br \/>\n it subject to the final outcome of the writ petition. Further, the<br \/>\nDivision Bench in Special Appeal No. 1956 of 2009 affirmed the<br \/>\nsaid interim order dated 07.12.2009, against which the University<br \/>\nhas approached the Supreme Court.\n<\/p>\n<p>In such a situation, the application on which the impugned interim<br \/>\norder has been passed in the pending matter ought not to have been<br \/>\nentertained and, at the highest, the learned Single Judge could have<br \/>\nproceeded to decide the petition finally.\n<\/p>\n<p>In the light of that, the appeal is finally disposed of with the<br \/>\nfollowing directions:-\n<\/p>\n<p>   1. The impugned order dated 09.06.2010 is set aside.\n<\/p>\n<p>   2. The counsel for the University will file counter<br \/>\n      affidavit in the writ petition within two weeks from<br \/>\n      today.\n<\/p>\n<p>   3. Rejoinder affidavit be filed within two weeks<br \/>\n      thereafter.\n<\/p>\n<p>   4. Considering the fact that the future of the student is<br \/>\n      involved, the learned Single Judge shall make<br \/>\n      endeavour to decide the petition expeditiously.\n<\/p>\n<p>The learned counsel for the University shall inform the learned<br \/>\nSingle Judge about the outcome of the special leave petition<br \/>\npending before the Supreme Court.\n<\/p>\n<p>                                (A.P.
