DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/08\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThe<br \/>\nwrit petition was filed under Article 227 of the Constitution of<br \/>\nIndia challenging the order dated 19.2.2008 passed below application<br \/>\nExh.43 in Special Civil Suit No.64 of 2007, by which, application<br \/>\nfiled by the plaintiff for attachment before judgment came to be<br \/>\nrejected.\n<\/p>\n<p>2.\tInitially<br \/>\nthis Court passed a detailed order on 16.11.2009.  While admitting<br \/>\nthe matter and upon a statement made by learned advocate on behalf of<br \/>\nrespondents to seek instructions about willingness and readiness of<br \/>\nthe respondents to furnish the adequate security, the matter was<br \/>\nadjourned.\n<\/p>\n<p>3.\tIt<br \/>\nseems that subsequent to this order, the respondents on 10.12.2009<br \/>\nfiled an application Exh.65 in the above Special Civil Suit No.64 of<br \/>\n2007, by which, the respondents submitted two different security<br \/>\nbonds, which came to be objected by the plaintiff vide Exh.70 on<br \/>\n8.1.2010 and after hearing the parties learned Principal Senior Civil<br \/>\nJudge passed an order on 2nd February, 2010, by which<br \/>\nobjections of the plaintiff came to be rejected.  However, directions<br \/>\nwere given to the extent that suit be decided on or before December,<br \/>\n2010.  However, it appears from the order that no specific order was<br \/>\npassed about acceptance of the security furnished by the defendant<br \/>\nbut prior to the operative order it was observed by the trial court<br \/>\nthat for the moment, security furnished by the defendant as per<br \/>\ndirection of the High Court appeared to be adequate.\n<\/p>\n<p>4.\tSince<br \/>\ndirections have already been given by learned Principal Senior Civil<br \/>\nJudge to decide the suit proceedings finally on or before December,<br \/>\n2010 and securities furnished by the defendant is found adequate  and<br \/>\nto remain on record of the proceedings, trial court is directed to<br \/>\ndecide the suit on or before 31st December, 2010.\n<\/p>\n<p>5.\tMeanwhile,<br \/>\nthe defendant is allowed to enter into negotiation with 3rd<br \/>\nparty so as to dispose of the property but shall not create any 3rd<br \/>\nparty rights finally and if necessary, may seek permission of the<br \/>\ntrial court.\n<\/p>\n<p>6.\tWith<br \/>\nthe aforesaid, Special Civil Application along with Civil Application<br \/>\nstand disposed of.  Rule discharged with no order as to costs.  Stay<br \/>\ngranted earlier stands vacated.\n<\/p>\n<p>[ANANT<br \/>\nS.
