Justice K.K.DENESAN\n\n Dated :24\/01\/2007\n\n O R D E R\n                                  K.K.DENESAN, J.\n\n                     -----------------------------\n\n                               WP(C)No. 30874 OF 2005\n\n                     -----------------------------\n\n                  Dated this the 24th January, 2007.\n\n\n\n                                        JUDGMENT\n<\/pre>\n<p>        The petitioner was placed under suspension with effect<\/p>\n<p>from         22.7.1999         while         he         was         working         as         Junior<\/p>\n<p>Superintendent   in   the   Panchayat   department.     He   was   facing<\/p>\n<p>criminal   proceedings   during   the   period   of   suspension.     The<\/p>\n<p>trial   court   found   him   guilty   and   convicted   and   sentenced<\/p>\n<p>him   for   the   offence   proved   against   him.     Immediately   after<\/p>\n<p>the   order   of   conviction   and   sentence,     he   was   dismissed<\/p>\n<p>from service as per order passed on 21.4.2002. However, the<\/p>\n<p>criminal   appeal   filed   by   him   was   allowed   setting   aside   the<\/p>\n<p>order of conviction and sentence.    On the strength of the<\/p>\n<p>appellate   order   he   filed   a   representation   to   the   second<\/p>\n<p>respondent   to   reinstate   him   in   service   with   all   attendant<\/p>\n<p>benefits.     Since   no   order   was   passed,   he   has   sought   for<\/p>\n<p>directions from this Court to reinstate him in service.   As<\/p>\n<p>per   the   orders   passed   by   this   Court,   the   petitioner   was<\/p>\n<p>reinstated   in   service   vide   Ext.P4   order   dated   12.12.2005.\n<\/p>\n<p>Immediately   thereafter,   i.e   on   14.12.2005,   the   petitioner<\/p>\n<p>rejoined   duty.     He   continued   in   service   and   got   promotion<\/p>\n<p>to the post of Special Grade Secretary and superannuated on<\/p>\n<p>31.12.2006.     The   second   respondent   has   not   regularised   the<\/p>\n<p>period   of   suspension   or   the   period   between   the   order   of<\/p>\n<p><span class=\"hidden_text\">WPC 30874\/2005                       2<\/span><\/p>\n<p>dismissal   and   his   reporting   for   duty   on   reinstatement.     In<\/p>\n<p>the   above   circumstances,   Ext.P5   representation   has   been<\/p>\n<p>filed   by   the   petitioner   before   the   second   respondent.\n<\/p>\n<p>Counsel   for   the   petitioner   submits   that   the   second<\/p>\n<p>respondent   has   got   a   duty   to   consider   and   pass   orders   on<\/p>\n<p>Ext.P5.\n<\/p>\n<p>      2.  I have heard the Govt. Pleader for the respondents.\n<\/p>\n<p>It   is   submitted   that   orders   will   be   passed   on   Ext.P5<\/p>\n<p>without delay.  In the circumstances, the   writ petition is<\/p>\n<p>disposed   of   directing   the   second   respondent   to   consider<\/p>\n<p>Ext.P5,   pass   orders   regularising   the   period   of   suspension<\/p>\n<p>from 22.7.1999 to 20.4.2002 as also the period during which<\/p>\n<p>the   petitioner   was   out   of   service   consequent   on   the   order<\/p>\n<p>of   dismissal   from   21.4.2002   till   14.12.2005.
