        The writ petition is filed seeking the<\/p>\n
following reliefs.\n<\/p>\n<\/p>\n
        i)  Issue a writ of certiorari calling for<\/p>\n
the  records  relating  to  Ext.P6  and  quash the<\/p>\n
original of the same.\n<\/p>\n<\/p>\n
        ii)  Issue a writ directing the principal<\/p>\n
Sub Judge, Kottayam to allow I.A No. 2275\/2007 in<\/p>\n
O.S No.189\/1997 in the interest of justice.<\/p>\n
        iii)   To grant such other reliefs prayed<\/p>\n
for from time to time including cost of these<\/p>\n
proceedings.\n<\/p>\n

          2.     Petitioner is the plaintiff in O.S<\/p>\n
No.189 of 2007 on the file of the Principal sub<\/p>\n
Court,    Kottayam.       Suit   is    one  for specific<\/p>\n
performance of an agreement of sale.         The case of<\/p>\n
the plaintiff in       brief is that the first defendant<\/p>\n
had executed an agreement of sale over the suit<\/p>\n
property and since there is default on his part to<\/p>\n
complete that agreement, a decree for specific<\/p>\n
performance      has    to  be   passed.     The  second<\/p>\n
defendant, a bank, was also impleaded in the suit<\/p>\n
seeking a relief that whatever charge over the<\/p>\n
property, in favour of second defendant has to be<\/p>\n
got relieved by payment from the sale price due to<\/p>\n
the first defendant.       An application for amendment<\/p>\n
was later moved by the plaintiff to contend that<\/p>\n
the   sale     effected    in   favour    of the  second<\/p>\n
defendant bank in respect of the suit property has<\/p>\n
to be declared as not binding on the plaintiff.<\/p>\n
That amendment was opposed by the second defendant<\/p>\n
bank.     The learned Sub Judge after hearing both<\/p>\n

sides dismissed the application for amendment vide<\/p>\n
Ext.P6 order.      Propriety and correctness of Ext.P6<\/p>\n
order is challenged in the writ petition invoking<\/p>\n
the supervisory jurisdiction vested with this court<\/p>\n
under Article 227 of the Constitution of India.<\/p>\n
          3.     I heard the counsel on both sides.<\/p>\n
Learned counsel, pointing out some mistakes in<\/p>\n
Ext.P6 order of the court below, expressing the<\/p>\n
view that written statement had been filed by the<\/p>\n
second    defendant     which  in   fact  was not  filed<\/p>\n
contended that there was no application of mind       or<\/p>\n
proper appreciating of the amendment moved by the<\/p>\n
plaintiff.      In Ext.P6 order, the court below has<\/p>\n
expressed     a   view   that   the   proposed amendment<\/p>\n
sought for by the plaintiff was to set aside the<\/p>\n
judgment and decree passed in the suit in favour<\/p>\n
of   the    second    defendant    bank.    Actually  no<\/p>\n
such     relief     was    claimed    by   the  proposed<\/p>\n
amendment     is   the submission of the counsel. So<\/p>\n

much so, without applying the mind and appreciating<\/p>\n
the amendment in the proper perspective it was<\/p>\n
dismissed is the grievance canvassed by the learned<\/p>\n
counsel for the petitioner.          On the other hand,<\/p>\n
learned counsel for the second respondent bank<\/p>\n
contended that the suit property was outstanding on<\/p>\n
a mortgage with the bank and on default of the<\/p>\n
first defendant, the debtor, after getting a decree<\/p>\n
in the suit, the property was brought to sale and<\/p>\n
the bank purchased that property in the auction<\/p>\n
held in the year 2001 and delivery was obtained<\/p>\n
through court in November 2006.         When that be the<\/p>\n
case, the present suit instituted by the petitioner<\/p>\n
contending that an agreement of sale was entered<\/p>\n
with    the    first    defendant   in   July  1996 and<\/p>\n
instituting the suit after the property was sold<\/p>\n
through court in favour of the second defendant<\/p>\n
bank, according to the counsel, lack bonafides.<\/p>\n
Perusing Ext.P6 order passed by the court below<\/p>\n
dismissing     the    application   for  amendment  with<\/p>\n
reference to the submissions made by the counsel on<\/p>\n

both sides and also the other materials tendered in<\/p>\n
the writ petition, I find no reason to interfere<\/p>\n
with P6 order.      In a suit for specific performance,<\/p>\n
the court is concerned only with the question<\/p>\n
whether performance of the agreement, an equitable<\/p>\n
relief, has to be granted or not.         Where a relief<\/p>\n
outside the       purview of specific performance is<\/p>\n
sought for in that suit by way of amendment it will<\/p>\n
change the character of the suit.        On that solitary<\/p>\n
ground itself, the proposed amendment sought for by<\/p>\n
the plaintiff was not entertainable without going<\/p>\n
into the other aspects involved.        That being so the<\/p>\n
proposed     amendment   of   the    plaintiff  was   not<\/p>\n
entertainable.       Writ petition lacks merit, and it<\/p>\n
is dismissed.\n<\/p>\n
