Justice R.BASANT\n\n Dated :12\/07\/2007\n\n O R D E R\n                                    R.BASANT, J\n\n                          ------------------------------------\n\n                              B.A.No.4226 of 2007\n\n                          -------------------------------------\n\n                      Dated this the 12th day of July, 2007\n\n\n                                       ORDER\n<\/pre>\n<p>         Application   for   anticipatory   bail.     The   petitioner   is   the   1st<\/p>\n<p>accused.     The   petitioner   faces   allegations,   inter   alia,   under   Section<\/p>\n<p>420 I.P.C.  The crux of the allegations is that the petitioner along with<\/p>\n<p>the 2nd  accused approached the defacto  complainant with  a  proposal<\/p>\n<p>for   the   marriage   of   the   2nd  accused.     The   defacto   complainant   was<\/p>\n<p>prepared   to   pay   amounts   in   consideration   of   the   marriage.<\/p>\n<p>Deliberately   to   induce   the   defacto   complainant   to   agree   to   the<\/p>\n<p>marriage,   false   assertions   were   made   that   the   2nd  accused   is   a<\/p>\n<p>divorcee.     He   really   had   a   wife   and   children.     This   fraudulent<\/p>\n<p>misrepresentation   was   made   allegedly   to   induce   the   complainant   to<\/p>\n<p>part with amounts and agree to give his daughter in marriage to the<\/p>\n<p>2nd accused.  Crime has been registered.  Investigation is in progress.<\/p>\n<p>The   2nd  accused   has   already   been   arrested.     The   petitioner<\/p>\n<p>apprehends imminent arrest.\n<\/p>\n<\/p>\n<p>         2.    The   learned   counsel   for   the   petitioner   submits   that   the<\/p>\n<p>allegations   raised   are   totally   false   and   incorrect.     There   was   no<\/p>\n<p>intention   to   suppress   any   information   from   the   defacto   complainant.<\/p>\n<p>In   these   circumstances,   the   petitioner   may   be   granted   anticipatory<\/p>\n<p>bail.\n<\/p>\n<\/p>\n<p>         3.    The   learned   Public   Prosecutor     opposes   the   application.<\/p>\n<p>The   learned   Public   Prosecutor     submits   that   in   the   facts   and<\/p>\n<p><span class=\"hidden_text\">B.A.No.4226 of 2007                             2<\/span><\/p>\n<p>circumstances   of   the   case,   there   is   absolutely   no   justification   in   the<\/p>\n<p>prayer   for  invocation  of the extraordinary   equitable discretion  under<\/p>\n<p>Section   438   Cr.P.C.     The   petitioner   may   be   directed   to   surrender<\/p>\n<p>before   the   Investigating   Officer   or   the   learned   Magistrate   having<\/p>\n<p>jurisdiction   and   seek   regular   bail,   submits   the   learned   Public<\/p>\n<p>Prosecutor.\n<\/p>\n<\/p>\n<p>          4.     I   find   merit   in   the   opposition   by   the   learned   Public<\/p>\n<p>Prosecutor .   I am satisfied that this is a fit case,where the petitioner<\/p>\n<p>must   appear   before   the   Investigating   Officer   or   the   learned<\/p>\n<p>Magistrate   having   jurisdiction   and   then   seek   regular   bail   in   the<\/p>\n<p>normal   and   ordinary   course.     No   circumstances   to   justify   the<\/p>\n<p>invocation   of   the   jurisdiction   under   Section   438   Cr.P.C   is   shown   to<\/p>\n<p>exist.\n<\/p>\n<\/p>\n<p>          5.
