                Learned counsel for the petitioner submits that<\/p>\n
the controversy involved in the instant writ petition stands<\/p>\n
concluded by the decision of this Court in S.B.Civil Writ<\/p>\n
Petition    No.5894\/2005     “Sanjay      Sukhadia      Vs.    State    of<\/p>\n
Rajasthan and Ors.” and four other writ petitions decided on<\/p>\n
28.5.2008.\n<\/p>\n
              Mr. R.K.Soni, Additional Govt. Counsel appearing<\/p>\n
for the respondents submits that the instant writ petition is<\/p>\n
squarely covered by the order of this Court passed in S.B.Civil
\n                                                                        2<\/span>
\n                                                  S.B.C.W. NO. 2897\/2008
\n                      Smt. Kiran Shukhadia Vs. State of Rajasthan and Others<\/p>\n
Writ Petition No.5894\/2005 “Sanjay Sukhadia Vs. State of<\/p>\n
Rajasthan and Ors.” and therefore, this writ petition may also<\/p>\n
be allowed in terms of the order passed by this Court in<\/p>\n
Sanjay Sukhadia’s case.\n<\/p>\n
           In this view of the matter, the writ petition is<\/p>\n
allowed in terms of the order passed by this Court in S.B.Civil<\/p>\n
Writ Petition No.5894\/2005 “Sanjay Sukhadia Vs. State of<\/p>\n
Rajasthan and Ors.”        decided on 28.5.2008 and it is held<\/p>\n
that :-\n<\/p>\n
(1)The State is bound to proceed as per the Granite Policy,<\/p>\n
  2002 and is restrained from granting mining lease in the<\/p>\n
  Government     land      unless      the   Government         identifies,<\/p>\n
  delineates and notifies the mine in the area by making<\/p>\n
  efforts for exploring the granite from their own officers as<\/p>\n
  required by proviso to clause (1) of the Granite Policy,<\/p>\n
  2002.\n<\/p>\n
(2)exploration   of    granite    by    private    individual    only    in<\/p>\n
  accordance with the provisions under the Granite Policy,<\/p>\n
  2002, when any individual may become entitled to allotment<\/p>\n
  of mining lease under Granite Policy, 2002, then he can be<\/p>\n
  granted mining lease to the extent of his entitlement after<\/p>\n
  carving out the plot for which lease can be granted and to
\n                                                                           3<\/span>

\n                         Smt. Kiran Shukhadia Vs. State of Rajasthan and Others<\/p>\n
       the extent of the area as provided under the Granite Policy,<\/p>\n
       2002.\n<\/p>\n
     (3)the State Government is directed to work out where and<\/p>\n
       how to survey the granite in the Government land and how<\/p>\n
       much area be made available for grant of mining lease for<\/p>\n
       excavation of granite so that proper reservation of the plots<\/p>\n
       may be made in accordance with the Granite Policy, 2002.<\/p>\n
     (4) No order as to costs.\n<\/p>\n<\/p>\n
