Justice P.BHAVADASAN\n\n Dated :08\/04\/2010\n\n O R D E R\n<\/pre>\n<p>                      P.BHAVADASAN, J.\n<\/p>\n<p>                 &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n                   WP(C) No.6783 of 2010\n<\/p>\n<p>                 &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>                     Dated 8th April 2010<\/p>\n<p>                            Judgment<\/p>\n<p>           In this Writ Petition filed under Article 227 of the<\/p>\n<p>Constitution of India, the prayer made by the petitioner is to<\/p>\n<p>take back LAR No.39\/04 on file and dispose of the same in<\/p>\n<p>accordance with law.\n<\/p>\n<p>           2. Two acres of land situated in Survey<\/p>\n<p>No.149\/10 of Vizhinjam village along with buildings and<\/p>\n<p>trees thereon, were acquired by the State for the<\/p>\n<p>construction of Kovalam-Neyyattinkara-Byepass Road, for<\/p>\n<p>which compensation was awarded. Dissatisfied with the<\/p>\n<p>compensation awarded by the Land Acquisition Officer, the<\/p>\n<p>petitioner moved a reference as LAR No.39\/04 before the<\/p>\n<p>Sub    Court,   Neyyattinkara,         which       was  posted   to<\/p>\n<p>24.05.2006. Since the petitioner was not well, he could not<\/p>\n<p>appear before the Court on the said date. Consequently,<\/p>\n<p>the reference was dismissed and the award passed by the<\/p>\n<p>Land Acquisition Officer was confirmed.               A copy of the<\/p>\n<p><span class=\"hidden_text\">WPC 6783\/10                      2<\/span><\/p>\n<p>order so passed is produced as Ext.P2. Immediately, the<\/p>\n<p>petitioner filed a restoration application, namely, IA No.792<\/p>\n<p>of 2006. Unfortunately, there was a delay of 50 days in<\/p>\n<p>filing the said IA. Therefore, the Court below directed the<\/p>\n<p>petitioner to pay Rs.500\/- as costS to the respective Legal<\/p>\n<p>Services Authority. It was so paid and obviously, the<\/p>\n<p>petitioner thought, the restoration application would be<\/p>\n<p>allowed. But, to his dismay, the IA filed by him for<\/p>\n<p>restoration was dismissed on the ground that the judgment<\/p>\n<p>is confirming the award. Ext.P4 is the copy of the said<\/p>\n<p>order. Aggrieved by Ext.P4, the petitioner has come up in<\/p>\n<p>Writ Petition before this Court.\n<\/p>\n<p>            3. Obviously, the orders passed by the Court<\/p>\n<p>below are incorrect. After having condoned the delay in<\/p>\n<p>filing the IA for restoration and after having received the<\/p>\n<p>payment made by the petitioner towards costs for the delay<\/p>\n<p>from his part, the application filed by him for restoration<\/p>\n<p>ought to have been allowed, treating the dismissal of<\/p>\n<p>LAR as one for default. The petitioner has submitted<\/p>\n<p><span class=\"hidden_text\">WPC 6783\/10                     3<\/span><\/p>\n<p>that there was no wilful laches or negligence on his part in<\/p>\n<p>not appearing before Court. There is no reason to<\/p>\n<p>disbelieve him. In the result, this Petition is allowed.
