No. 1078 of 2009\n        =-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=\n          Dated this the 26th day of March, 2009\n\n                           O R D E R\n<\/pre>\n<p>      Petitioners who are accused 1 and 2 in C.C. No.934\/2007<\/p>\n<p>of Judicial Magistrate of First Class-I, Pathanamthitta for<\/p>\n<p>offences punishable under Sections 20, 21 and 23 of the Kerala<\/p>\n<p>Protection of River Banks and Regulation of Removal of Sand<\/p>\n<p>Act, 2001 challenge the order dated 12-2-2009 passed by the<\/p>\n<p>learned Magistrate issuing process.\n<\/p>\n<p>      2. The contention of the petitioners that the aforesaid<\/p>\n<p>offences are not made out against the petitioners cannot be<\/p>\n<p>considered by this Court in a revision filed against the order<\/p>\n<p>issuing process.  The remedy of the petitioners is to plea for a<\/p>\n<p>discharge with appropriate stage.\n<\/p>\n<p>      3. This revision is, accordingly, dismissed without<\/p>\n<p>prejudice the right of the petitioners to plea for a discharge<\/p>\n<p>before the learned Magistrate. In case the petitioners filing an<\/p>\n<p>application for personal exemption, the learned Magistrate shall<\/p>\n<p>allow the same for the purpose of considering the plea of<\/p>\n<p>discharge raised by the petitioners.\n<\/p>\n<p>                                          V.
