He had requested CPWD to provide him guest<br \/>\naccommodation from 23rd to 28th, May, 2009 at their Guest House at<br \/>\nGangtok. He, however, was not provided the guest accommodation and<br \/>\nwas accommodated in transit accommodation only for two days, as against<br \/>\nhis requirements of 06 days for which he had made the advance payment.<br \/>\nIn this connection, vide his RTI application dated 16.6.2009, he had<br \/>\nrequested for information on the following 03 paragraphs :-<br \/>\n&#8220;(i) The details of accommodation available in guest house etc. and<br \/>\n       entries# in the guest house register (including transit<br \/>\n       accommodation) for the period from 23.5.2009 to 28.5.2009;\n<\/p>\n<p>(ii)   Copies of applications received for booking for this period<br \/>\n       (23.5.2009 to 28.5.2009).\n<\/p>\n<p>(iii) Applicants denied\/regretted accommodation for this period.&#8221;\n<\/p>\n<p>2.    The information was provided to him vide letter dated 9.12.2009.<br \/>\nAggrieved with the above order, he has filed the present appeal.\n<\/p>\n<p>3.      Heard on 17.3.2010. Appellant present. The public authority is<br \/>\nrepresented by the officer named above. It is the submission of the<br \/>\nappellant that first he had difficulty in filing the RTI application. After his<br \/>\nRTI application was accepted it was diverted to SE, CPWD, Siliguri for<br \/>\nappropriate action sometime in July, 2009 but he got the response only in<br \/>\nDecember, 2009, that is, after a gap about 05 months, as against the<br \/>\nprescribed time of 30 days. It is also his submission that complete<br \/>\ninformation has not been provided to him. He admits that a copy of the<br \/>\nGuest House Register was sent to him but the entries are incomplete and<br \/>\nillegible.\n<\/p>\n<p>4.     To this, Shri Bansal would respond that copy of the Guest House<br \/>\nRegister has already been provided and no other record is being<br \/>\nmaintained. He is agreeable to provide copies of the available applications<br \/>\nreceived for accommodation in the relevant period.\n<\/p>\n<p>                                 DECISION\n<\/p>\n<p>5.     The public authority can provide only that information which is held<br \/>\nby it. If the documents are not being held by the public authority, copies<br \/>\nthereof can not be provided to the appellant. Be that as it may, the CPIO is<br \/>\nhereby directed to provide copies of all the available applications received<br \/>\nfor accommodation during the relevant period.\n<\/p>\n<p>6.
