No. 126\/90 recorded conviction of<br \/>\naccused\/appellant under Section 307 of Indian Penal<br \/>\nCode,      sentenced       him       to   undergo       rigorous<br \/>\nimprisonment for five years and to pay fine of Rs.<br \/>\n200\/-, in default to suffer rigorous imprisonment for<br \/>\nthree months. Being aggrieved,appellant has preferred<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>this appeal under Section 374(2) of Code of Criminal<br \/>\nProcedure.\n<\/p>\n<p>2.            It is undisputed that appellant\/accused<br \/>\nRaghuvir Singh was prosecuted along with, co-<br \/>\naccused Jashwant Singh S\/o Chhatar Singh,                   Bade<br \/>\nBhai @ Motiram S\/o Chhatar Singh, Halke Bhai @<br \/>\nThansingh S\/o Chhatar Singh, Pooran Singh S\/o.<br \/>\nKhuman Singh under Section 148, 307 read with<br \/>\nSection 149 and 324 read with Section 149 of Indian<br \/>\nPenal Code but after trial other all co-accused have<br \/>\nbeen acquitted by the learned Trial Court.\n<\/p>\n<p>3.            Facts in brief are that on 5.3.90 at about<br \/>\n3.30    the    cattle   of    Ganesh       Singh    (PW2)    S\/o<br \/>\ncomplainant Rajaram (PW1) entered in the filed of<br \/>\nChhatar Singh (father of co-accused Jashwant Singh,<br \/>\nBade Bhai and Halke Bhai). So,             Bade Bhai abused<br \/>\nGanesh Singh, at the same time his other brothers<br \/>\nHalke Bhai and Jashwant Singh came there and an<br \/>\naltercation      between Ganesh Singh and sons of<br \/>\nChhatar Singh was going on. At this juncture,<br \/>\nappellant     Raghuvir       Singh   and    other   co-accused<br \/>\nPooran Singh also came there. Appellant Raghuvir<br \/>\nSingh having an axe and Bade Bhai, Halke Bhai and<br \/>\nJashwant Singh having Khaderua (heavy wooden piece<br \/>\nof teak) then appellant Raghuvir assaulted Ganesh<br \/>\nSingh   (PW2) on head by an Axe. Ganesh Singh fell<br \/>\ndown, at this juncture, Lakhan Singh (PW3), Hakam<br \/>\nSingh (PW4) and complainant Rajaram (PW1) rushed<br \/>\nto rescue.      Bade Bhai assaulted Lakhan Singh by<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>Khaderua. Halke Bhai assaulted Hakam Singh by<br \/>\nKhaderua, Bade Bhai assaulted Rajaram by Khaderua.<br \/>\nOn the instigation of appellant Raghuvir Singh,<br \/>\nPooran Singh and Bade Bhai, accused persons<br \/>\nattempted    to   kill   Ganesh     Singh.    Incident      was<br \/>\nwitnessed by Pooran (PW6) and Madhosingh (PW5).\n<\/p>\n<p>4.          Complainant     Rajaram        lodged    a    report<br \/>\nEx.P\/2 at 8.10 p.m. at Police Station Sultanganj.<br \/>\nCrime was registered and injured persons were sent<br \/>\nfor medical examination.\n<\/p>\n<p>5.          Dr. G.V. Nair (PW8) examined them and<br \/>\nfound grievous injury on the head of Ganesh Singh<br \/>\nand simple injuries on the body of Rajaram, Lakhan<br \/>\nSingh and Hakam Singh. Sub Inspector A.M. Khan<br \/>\n(PW7) prepared the site map (Ex.P\/3) on 6.3.90, seized<br \/>\nthe blood stained and plain earth\/simple soil vide<br \/>\nseizure memo Ex.P\/4. After arresting the accused<br \/>\npersons,    appellant     charge-sheeted        along      with<br \/>\nacquitted co-accused (stand acquitted).\n<\/p>\n<p>6.          Accused\/appellant        abjured        the    guilt<br \/>\nhowever,    the    Additional      Sessions     Judge       vide<br \/>\nimpugned      judgment      dated     11.10.95        recorded<br \/>\nconviction and sentence as mentioned herein above.\n<\/p>\n<p>7.          Learned      counsel     for     the     appellant<br \/>\nsubmitted that trial Court has failed to appreciate the<br \/>\nevidence in their true perspectives. All witnesses were<br \/>\nclosely related and there were enough contradictions<br \/>\n<span class=\"hidden_text\">                               4<\/span><\/p>\n<p>in their statements. Their testimony could not be<br \/>\naccepted as reliable. In alternative, he also submitted<br \/>\nthat looking to the nature of injuries, no offence under<br \/>\nSection 307 IPC was made out. At the most, an<br \/>\noffence punishable under Section 324 IPC is made<br \/>\nout.\n<\/p>\n<p>8.         On the other hand, learned counsel for the<br \/>\nState has supported the impugned judgment and<br \/>\nfinding of the Trial Court.\n<\/p>\n<p>9.         It is true that injured Ganesh Singh (PW2),<br \/>\nhis father complainant Rajaram (PW1) and his brother<br \/>\nHakam Singh (PW4) are closely related witnesses, but<br \/>\nit is settled position of law that testimony of related<br \/>\nwitnesses cannot be discarded only on the basis of<br \/>\ntheir relations to the victim, but their statements<br \/>\nshould be tightly scrutinized. After keeping above<br \/>\nprinciple in mind,    I find that all above mentioned<br \/>\nwitnesses improved their statements in the Court as<br \/>\nregard to the facts that appellant intending to assault<br \/>\non the neck of Ganesh Singh, but due to alertness, he<br \/>\ncould hit only on the head of Ganesh Singh. But this<br \/>\nparticular fact did not find place in there respective<br \/>\npolice statements recorded under Section 161 Code of<br \/>\nCriminal Procedure. This fact further find support<br \/>\nfrom the testimony of independent witness Lakhan<br \/>\nSingh (PW3), who only stated that Ganesh Singh<br \/>\nassaulted by Raghuvir Singh by an axe. He did not say<br \/>\nthat appellant was intended to assault on the neck of<br \/>\nGanesh Singh. Further this fact is not find place in<br \/>\n<span class=\"hidden_text\">                                5<\/span><\/p>\n<p>FIR Ex.P\/2.\n<\/p>\n<p>10.         In     these     circumstances,          prosecution<br \/>\nsucceeded to prove by the testimony of injured<br \/>\nwitnesses   Ganesh         Singh     (PW2),   Rajaram     (PW1),<br \/>\nHakam Singh (PW4) and Lakhan Singh (PW3) that<br \/>\nduring   the     altercation appellant Raghuvir Singh<br \/>\ncaused injury on the head of Ganesh Singh by an axe.\n<\/p>\n<p>11.         This      vary    fact    also    corroborated   by<br \/>\nindependent witness Madho Singh (PW5). Further<br \/>\ncorroborated by medical evidence of Dr.G.V. Nair<br \/>\n(PW8), who found incised wound on the right parietal<br \/>\nregion of head of the        size 4&#8243; x 1&#8243; x bone deep and<br \/>\nopined that injury was grievous in nature. His report<br \/>\nis Ex.P\/5. Above mentioned facts also substantially<br \/>\ncorroborated by FIR Ex.P\/2.\n<\/p>\n<p>12.         Learned        counsel      for    the     appellant<br \/>\ncontended that doctor had not opined,                that injury<br \/>\nwas   sufficient in ordinary course of nature to cause<br \/>\ndeath. In this circumstance, no offence under Section<br \/>\n307 of IPC is made out. At the most only offence under<br \/>\nSection 324 of IPC is made out.\n<\/p>\n<p>13.         Learned counsel for the appellant placed<br \/>\nreliance on AIR 1993 SC 1256, Pashora Singh Vs.<br \/>\nState of Punjab. In this case, the Apex Court<br \/>\nobserved that accused persons having no intention to<br \/>\ncause death of any person nor any injury found which<br \/>\nwas sufficient in ordinary course of nature to cause<br \/>\n<span class=\"hidden_text\">                               6<\/span><\/p>\n<p>death then accused would be only liable to convicted<br \/>\nunder Section 326 of IPC, in stead of under Section<br \/>\n307 of IPC. But fact of that case was not identical as<br \/>\nregard to the authorship of infliction of injury. In that<br \/>\ncase, it was not established as to which of two<br \/>\naccused, had inflicted injury on the head of deceased,<br \/>\nwhich was described as dangerous to life.\n<\/p>\n<p>14.           But in the instant case, as discussed herein<br \/>\nabove, authorship is undisputed, and it is proved that<br \/>\nappellant Raghuvir Singh caused grievous injury on<br \/>\nthe parietal region of the head of Ganesh Singh.\n<\/p>\n<p>15.           It is true that there was no fracture in<br \/>\nparietal bone and the occurrence took place during<br \/>\naltercation     between    the    parties   and    suddenly<br \/>\nappellant     Raghuvir    Singh   had   came      there   and<br \/>\nassaulted Ganesh Singh. But he chose to hit on the<br \/>\nhead which is vital part of the body though the force<br \/>\nhe used was not very strong so as to cause fractures<br \/>\nin the parietal bone.\n<\/p>\n<p>16.           In the above circumstances, he is liable to<br \/>\nbe convicted under Section 308 of IPC, instead of<br \/>\nunder Section 307 of IPC as if the victim had died, he<br \/>\nwould be guilty of culpable homicide not amount to<br \/>\nmurder.\n<\/p>\n<p>17.           Therefore, setting aside the conviction and<br \/>\nsentence of the appellant for the offence under Section<br \/>\n307 IPC, I alter his conviction and hold him guilty of the<br \/>\n<span class=\"hidden_text\">                                7<\/span><\/p>\n<p>offence under Section 308 of IPC and convict him to<br \/>\nundergo three years rigorous imprisonment with fine of<br \/>\nRs.    200\/-,   in   default   he   further    suffer   rigorous<br \/>\nimprisonment for one month.\n<\/p>\n<p>18.         To the limited extent stated herein above,<br \/>\nappeal is partly allowed.\n<\/p>\n<p>19.         Accused\/appellant is on bail. His bail bond<br \/>\nstand canceled. He is directed to surrender himself<br \/>\nbefore the trial Court on 20.9.2010 for serving out the<br \/>\nremaining part of the sentence.\n<\/p>\n<p>                                              (G.S.
