I.,Ram Gopal Tripathi\nHon'ble Sunil Ambwani,J.\n<\/pre>\n<p>Hon&#8217;ble Kashi Nath Pandey,J.\n<\/p>\n<p>Heard Shri Shashi Nandan, Senior Advocate assisted by Shri M.M.<br \/>\nSahai for the petitioner. Sri P.S. Baghel, Senior Advocate appears<br \/>\nfor the University.\n<\/p>\n<p>The petitioner was appointed as Guest Lecturer (Botany) in<br \/>\npursuance to her selection by a Selection Committee after<br \/>\nadvertisement in C.M.P. Degree College, Allahabad affiliated to<br \/>\nUniversity of Allahabad on 27.11.2008. She was permitted to take<br \/>\nclasses from 27.11.2008 to 10.2.2009. The post was advertised<br \/>\nagain for the next academic year in August, 2009. The petitioner<br \/>\nagain applied and was selected by the duly constituted Selection<br \/>\nCommittee. Her term has come to an end in the month of<br \/>\nFebruary, 2010.\n<\/p>\n<p>By this writ petition, the petitioner has prayed for directions to<br \/>\nquash the advertisement dated 10.7.2010 published in Hindi daily<br \/>\n&#8216;Dainik Jagaran&#8217; advertising the same post to be filled up by a<br \/>\nGuest Lecturer in different subjects including the subject of<br \/>\nBotany and has prayed to allow her to continue as guest lecturer<br \/>\nuntil regular selection is made by the University without any claim<br \/>\nfor regularization.\n<\/p>\n<p>Shri Shashi Nandan, Senior Advocate submits that there is no<br \/>\nobject to be achieved and rationale in filling up the post of guest<br \/>\nlecturer every year by selections when a duly qualified and<br \/>\nselected candidate is available with experience of previous year.<br \/>\nThe College should not be allowed to adopt &#8216;hire and fire&#8217;, policy<br \/>\nevery year and to substitute petitioner with another person. The<br \/>\npetitioner is M.Sc. and D. Phil (2001). Since she was awarded D.<br \/>\nPhil in 2001, she is exempted from qualifying the National<br \/>\nEligibility Test. She has been treated arbitrarily in violation of<br \/>\nArticles 14 and 16 of the Constitution of India in requiring her to<br \/>\nappear in selection every year for the same post.\n<\/p>\n<p>Shri Shashi Nandan submits that the Ordinances of the University<br \/>\n applicable to the affiliated Colleges provide that where a person,<br \/>\nreferred to in sub clause (a) of Ordinance XLIV (6), is engaged in<br \/>\nprescribed manner by an academic unit as guest lecturer in an<br \/>\nacademic year, continuous to be eligible for such engagement, he<br \/>\nmay be re-engaged as such by such academic unit for the<br \/>\nimmediately subsequent academic year, without recourse to the<br \/>\nprocedure specified under the provisions of sub clause (g), but<br \/>\nsuch re-engagement without recourse to the said procedure, shall<br \/>\nnot be permissible beyond three consecutive academic years.\n<\/p>\n<p>Shri Shashi Nandan submits that with the outer limit of three<br \/>\nyears, the discretion of the College to engage the guest lecturer<br \/>\nevery year upto the maximum of three years should be exercised<br \/>\nreasonably. The petitioner was duly selected by the Selection<br \/>\nCommittee and is teaching regularly without any complaint against<br \/>\nher. The College, therefore, should be permitted to exercise the<br \/>\ndiscretion to re-engage her for the third year.\n<\/p>\n<p>Shri P.S. Baghel, Senior Advocate appearing for the University of<br \/>\nAllahabad submits that the second proviso to Ordinance XLIV (6)\n<\/p>\n<p>(h) created a serious problems for the University. The members<br \/>\nengaged from sessions to session basis started claiming permanent<br \/>\nemployment as faculty member or engagement as guest lecturer<br \/>\nwithout any interviews. The Executive Council, therefore, decided<br \/>\nin its meeting dated 20.1.2009 to delete the proviso from the<br \/>\nOrdinances after which part time lecturer and guest faculty<br \/>\nmembers have no right to claim re-engagement.\n<\/p>\n<p>Shri Baghel submits, that the petitioner was appointed as Guest<br \/>\nLecturer on a fixed honorarium for specific period. Her<br \/>\nappointment in terms of condition No. 2 of the appointment letter<br \/>\nannexed as Annexure-1 was subject to the provisions laid down in<br \/>\nOrdinance XLIV of the University. She does not have a right to<br \/>\nclaim further engagement for subsequent period without fresh<br \/>\nselection and interviews. He has relied upon judgments of this<br \/>\nCourt in <a href=\"\/doc\/790001\/\">Birendra Bahadur Singh vs. Chancellor, Allahabad<br \/>\nUniversity and others<\/a> 2004 (2) ESC (Allahabad); <a href=\"\/doc\/1965013\/\">Arvind<br \/>\nKumar Singh (Dr.) vs. University of Allahabad and others<\/a><br \/>\n(2007) 1 UPLBEC 677 and Dr. Virendra Kumar Singh vs. Vice<br \/>\nChancellor, Mahatama Jyotiba Phule Rohilkhand University,<br \/>\nBareilly and others 2006 (1) ADJ 438 (All) (DB) in which the<br \/>\nDivision Benches of this Court have not accepted the arguments<br \/>\nthat the part time\/guest\/adhoc lecturer should be allowed to claim<br \/>\nany right to continue on the post from the period of his<br \/>\nengagement on contract. Once the period of contract has come to<br \/>\nan end, the part time lecturer has no right to continue and if he<br \/>\n wants re-engagement, he must appear in the selections.\n<\/p>\n<p>The availability of the substantive post and the condition that the<br \/>\nappointment of Guest Lecturer can be made only on substantive<br \/>\npost cannot be treated as grounds for re-engagement.\n<\/p>\n<p>The procedure for making appointment of a regular lecturer is<br \/>\ndifferent than the procedure for appointment of Guest Lecturer. In<br \/>\ncase of a regular appointment the Visitor of the University<br \/>\nnominates two experts in the selection committee and that a wider<br \/>\nadvertisement is made inviting applications for appointment. In<br \/>\nSecretary, State of Karnataka vs. Uma Devi and other JT 2006<br \/>\n(4) SC 420 the Supreme Court laid emphasis on the adherence to<br \/>\nthe rule of equality in public employment.
