The prayer in the Application is for dispensing with the condition of predeposit of an amount of Rs.50,000.00 imposed upon the applicant, on the ground that the parts of computers recovered from his residential premises were smuggled. The applicant has denied any involvement in the said goods and has taken a stand that he was staying in a house which is jointly occupied by his brothers. He is residing at the first floor of the house and the goods were recovered from the ground floor. He has been falsely implicated.\n<\/p>\n<p>2. After hearing the learned J.D.R. for the Revenue, I, prima-facie, find force in the applicant&#8217;s submission and accordingly, allow the Stay Petition unconditionally.
