Justice S.SIRI JAGAN\n\n Dated :12\/10\/2010\n\n O R D E R\n                          S.SIRI JAGAN, J.\n                         -----------------------\n                     R.P No.896 OF 2010 in\n                       O.P.No.3478 of 2001\n                   ------------------------------------\n           Dated this the 12th day of October, 2010\n\n\n                              O R D E R\n<\/pre>\n<p>      This Review Petition is filed by the State seeking review of<\/p>\n<p>my judgment dated 10.3.2010, which was rendered on the basis<\/p>\n<p>of an admission made by the learned Government Pleader<\/p>\n<p>appearing in the case to the effect that             the service of the<\/p>\n<p>petitioner in the writ petition in the Cochin Dock Labour Board can<\/p>\n<p>also be reckoned for the purpose of retirement benefit due to the<\/p>\n<p>petitioner, if the petitioner pays pro-rata pension contribution<\/p>\n<p>payable by the Cochin Dock Labour Board. The Review Petition is<\/p>\n<p>filed on the basis that the submission made by the learned<\/p>\n<p>Government Pleader was wrong and there is no provision in<\/p>\n<p>Government orders for reckoning service in the Cochin Dock<\/p>\n<p>Labour Board     for the purpose of pension in the Government<\/p>\n<p>service,   even if   pro-rata pension contribution is paid by the<\/p>\n<p>Government employee.\n<\/p>\n<p>      2. I have heard both sides.\n<\/p>\n<p>      In view of the submission that the learned Government<\/p>\n<p>Pleader had made a wrong submission inadvertently, I am<\/p>\n<p>inclined to recall my judgment dated 10.3.2010. Accordingly, the<\/p>\n<p>R.P No.896 OF 2010 in<br \/>\n<span class=\"hidden_text\">O.P.No.3478 of 2001               2<\/span><\/p>\n<p>Review Petition is allowed and the judgment dated 10.3.2010 is<\/p>\n<p>recalled.
