The appellants\nfiled  objections under s. 15 of the Arbitration Act,  1940,\nand  the Civil Judge modified the award.  On appeal  by\t the\nrespondents,  the  District Court held that the\t appeal\t was\nmaintainable  and that the Civil Judge was not justified  in\nmodifying the award.  A revision petition to the High  Court\nfiled by the appellants was dismissed.\nIn appeal to this Court, it was contended that s. 39 of\t the\nArbitration  Act, which provides for appeals does not  apply\nto arbitrations under s. 37 of the U.P. Act.\nHELD:The  decision of the Civil Judge modifying,  the  award\nwas appealable under s. 39 of the Arbitration Act. [67 A].\nThe effect of s. 37 of the U.P. Act read with ss. 46 and  47\nof  the\t Arbitration Act is, to apply ss. 15 and 39  of\t the\nArbitration  Act to the proceedings under the U.P. Act;\t and\nunder  s.  12(5) of the U.P. The Judgment of the Court was delivered by
\nSikri,\tJ. This appeal by special leave is directed  against
\nthe  judgment of Dhavan, J., in Civil Revision No.  1209  of
\n1957.  The
\n64<\/span>
\nlearned\t Judge,\t following  Sarju  Prasad  v.  Civil  Judge,
\nFarrukhabad(1)\theld  that  an\torder of  the  Court  on  an
\nobjection against an award made under S. 12(4) of the  Uttar
\nPradesh\t Consolidation of Holdings Act (U.P. Act V of  1954)
\n(hereinafter  called the Act) was appealable under S. 39  of
\nthe  Arbitration  Act (X of 1940) Mr. J. P.  Goyal,  learned
\nCounsel\t for the appellant urges that this decision  of\t the
\nAllahabad High Court is wrong.\n<\/p>\n
In  order to appreciate the contentions of Mr. Goyal, it  is
\nnecessary  to  give  a few facts and set  out  the  relevant
\nstatutory  provisions, During consolidation  proceedings  in
\nvillage\t Dharaki-Garhi,\t a  question of\t title\tarose.\t The
\nConsolidation  Officer,\t acting under S. 12(4) of  the\tAct,
\nreferred the question of title to the Civil Judge,  Aligarh,
\nwho referred the same to the arbitrator, Shri Vikram  Singh,
\nwho  had  been appointed under S. 37 of\t the  Act.   Section
\n12(4) reads as under:\n<\/p>\n
\t      “12(4)  Where the objection filed\t under\tsub-
\n\t      section  (1) involves a question of title\t and
\n\t      such question has not already been  determined
\n\t      by   a  competent\t Court,\t the   Consolidation
\n\t      Officer\tshall\trefer\tthe   question\t for
\n\t      determination   to  the  Civil  Judge   having
\n\t      jurisdiction  who shall thereupon refer it  to
\n\t      the Arbitrator.”\n<\/p><\/blockquote>\n
\t      Section 37 provides:\n<\/p><\/blockquote>\n
\t      “37.  Arbitration-(1) Where any matter is,  by
\n\t      or under this Act, directed to be referred  to
\n\t      an    Arbitrator\t for   determination,\t the
\n\t      Arbitrator  will\tbe appointed  by  the  State
\n\t      Government  from amongst Civil Judicial  Offi-
\n\t      cers or Assistant Collector of the I class  of
\n\t      not less than five years’ standing and in\t all
\n\t      other respects the matter shall be  determined
\n\t      in  accordance  with  the\t provisions  of\t the
\n\t      Arbitration Act, 1940.\n<\/p><\/blockquote>\n
\t      (2)   The\t appointment of an Arbitrator  under
\n\t      sub. section (1) may be made either  generally
\n\t      or in respect of any particular case or  class
\n\t      of  cases or in respect of any specified\tarea
\n\t      or areas.”\n<\/p><\/blockquote>\n
The arbitrator gave his award on May 14, 1956, and submitted
\nthe same to the Civil Court for final decision.\t On May\t 19,
\n1956,  Charan Singh, Dungar Singh, Maharaj Singh  and  Lajja
\nRam, appellants before us, filed objections before the Civil
\nJudge,\tAligarh.   The Civil Judge, on\tSeptember  8,  1956,
\nmodified  the  award dated May 14, 1956.   Babu\t Lal,  Mohar
\nSingh  and  Ram Piyari filed an appeal before  the  District
\nJudge against the order of the Civil Judge, dated  September
\n8, 1956.  Before the District Judge, a preliminary objection
\nwas raised. that no appeal lay
\n(1)  I.L.R. [1959] 1 All. 354.\n<\/p>\n
65<\/span><\/p>\n
against\t the order of the Civil Judge.\tThe  District  Judge
\noverruled the objection.  On the merits, the District  Judge
\nheld that the Civil Judge was not justified, under s. 15  of
\nthe  Arbitration Act, in modifying the award merely  because
\nhe  disagreed with the finding.\t He, therefore, allowed\t the
\nappeal and set aside the order of the Civil Judge  modifying
\nthe award, and the award announced by Shri Vikram Singh\t was
\naccepted.\n<\/p>\n
Charan\tSingh,\tMaharaj Singh, Doonger Singh and  Lajja\t Ram
\nfiled  a petition before the High Court under s. 115 of\t the
\nCivil\tProcedure  Code.   As  stated  above,  Dhavan,\t J.,
\ndismissed  the\tpetition on the ground that  an\t appeal\t lay
\nunder  s.  39 of the Arbitration Act.\tThis  Court  granted
\nspecial leave and now the matter is before us.
\nMr. Goyal contends that s. 37 of the Act applies the  provi-
\nsions  of  the Arbitration Act only as far as  procedure  is
\nconcerned,  and s. 39 of the Arbitration Act which  provides
\nfor appeals does not apply to arbitrations referred to in s.
\n37  of the Act.\t He relies strongly on s. 12(6) of  the\t Act
\nwhich  provides\t that the decision of the  arbitrator  under
\nsub-s.\t(4)  shall  be final.  We have already\tset  out  S.
\n12(4).\tHe, however, does not contend that the provisions of
\ns.  15\tof  the Arbitration Act do  not\t apply\tbecause\t the
\nappellants  had\t apparently  applied  under  s.\t 15  of\t the
\nArbitration  Act  to the Court to modify the award  made  by
\nVikram\tSingh  and they had succeeded in  getting  an  order
\nmodifying the award in their favour.\n<\/p>\n
In  our opinion, the High Court arrived at the correct\tcon-
\nclusion\t in Sarju Prasad v. Civil Judge,  Farrukhbad(1)\t and
\nSayeed\t Ullah\tKhan  v.  The  Temporary  Civil\t  Judge\t  of
\nSultanpur.(2)  Section\t12(4)  of the  Act  provides  for  a
\nstatutory arbitration and S. 37 of the Act provides for\t the
\nappointment  of an arbitrator by the State  Government.\t  It
\nseems  to us that apart from the question of appointment  of
\nthe  arbitrator, in all other respects the  matter  referred
\nto,  i.e. the question of title referred to under  s.  12(4)
\nshall be determined in accordance with the provisions of the
\nArbitration  Act.  Section 37 of the Act does not  make\t any
\ndistinction  between provisions like s. 39 and s. 15 of\t the
\nArbitration Act.  Further, the effect of s. 46 and s. 47  of
\nthe  Arbitration  Act  is that all  the\t provisions  of\t the
\nArbitration Act except sub-section (1) of section 6, ss.  7,
\n12, 36 and 37, apply to arbitrations under the Consolidation
\nof  Holdings Act.  Section 37 of the Act cannot be  held  as
\nproviding anything inconsistent with this.  In our  opinion,
\nthe  effect of s. 37 of the Act, read with ss. 46 and 47  of
\nthe Arbitration Act, is inter alia to apply ss. 15 and 39 of
\nthe Arbitration Act to the proceedings under the Act.  It is
\nnot necessary to rely
\n(1) I.L.R. (1959) 1 All. 354.\n<\/p>\n
(2) I.L.R. (1959) 1 All. 331.\n<\/p>\n
66<\/span><\/p>\n
on  ff.\t 63  and 64 of the Uttar  Pradesh  Consolidation  of
\nHoldings  Rules, 1954, but we may mention that they  proceed
\non  the basis that ss. 15, 16 and 30 of the Arbitration\t Act
\napply to the arbitration proceedings under the Act.
\nMr.  Goyal then urges that this Court in the case  of  Attar
\nSingh v. The State of U.P.<\/a>(1) understood s. 37 of the Act to
\nmean  that  it makes the Arbitration Act applicable  to\t the
\nproceedings before the arbitrator in the matter of procedure
\nonly.\tIt is true that at p. 935 of the judgment,  Wanchoo,
\nJ., observed:\n<\/p>\n
\t      “Further s. 12 provides that where there is  a
\n\t      dispute as to title and such question has\t not
\n\t      already  been  determined\t by  any   competent
\n\t      Court, the Consolidation Officer has to  refer
\n\t      the  question for determination to  the  Civil
\n\t      Judge  who  thereafter will refer\t it  to\t the
\n\t      arbitrator.   The arbitrator then proceeds  in
\n\t      the  manner  provided by r. 73  (sic  63)\t and
\n\t      gives  a\thearing\t to the\t parties  and  takes
\n\t      evidence\tboth  oral  and\t documentary  before
\n\t      making  his award; and s. 37 of the Act  makes
\n\t      the   Arbitration\t  Act  applicable   to\t the
\n\t      proceedings  before  the\tarbitrator  in\t the
\n\t      matter of procedure.”\n<\/p><\/blockquote>\n
We  are unable to agree with Mr. Goyal that this passage  in
\nany manner decides the point which is before us.  This Court
\nin Attar Singh’s(1) case was concerned with the validity  of
\nthe  Act, and ground No. 2 which was urged before the  Court
\nwas:\n<\/p>\n
\t      “Sections\t 8, 9 and 10 read with s. 49 of\t the
\n\t      Act provide a procedure for the correction and
\n\t      revision of revenue records for villages under
\n\t      consolidation, which is vitally different from
\n\t      that   applicable\t  to  villages\t not   under
\n\t      consolidation,\t and\tthere\t is\tthus
\n\t      discrimination  which offends art. 14  of\t the
\n\t      Constitution.”\n<\/p><\/blockquote>\n
In   dealing  with  this  ground,  Wanchoo,  J.,  made\t the
\nobservations  which have been set out above.  There  was  no
\nquestion there of considering the effect of ss. 46 and 47 of
\nthe  Arbitration  Act, or considering whether s. 39  of\t the
\nArbitration  Act applies to arbitrations under s.  12(4)  of
\nthe Act.\n<\/p>\n
Mr. Goyal also laid a great deal of emphasis on s. 12(6)  of
\nthe  Act which provides that the decision of the  arbitrator
\nunder  sub-s. (4) shall be final.  In our opinion, s.  12(6)
\nmust be read with s. 37 of the Act, and if it is so read  it
\nis  quite clear that what is made final is the\tdecision  of
\nthe arbitrator as it emerges after appropriate\tproceedings,
\nif  any,  have\tbeen  taken  under  the\t provisions  of\t the
\nArbitration Act.\n<\/p>\n

In  the\t result\t we hold that the High\tCourt  is  right  in
\nholding\t that the decision of the Civil Judge modifying\t the
\naward  was  appealable under s. 39 of the  Arbitration\tAct.
\nThe appeal accordingly fails and is dismissed with costs.
