The\n for fastening the\nliability' Jon'  Company and also for\n\nawarding thejust\" compensation.\n\n   the learned counsel for the parties and\n\niperusecl t'hjei..appeaI papers.\n\n as  3\";:With regard to the accident, which occurred on\n\n \/\"if\/2006, the Tribunal after quantifying the\n\nit \"compensation has held that the Insurance Company\n\nwould not be liable to pay the compensation. In this\n\ni\n52\nis\n\nwwtr\n\naw'\n\n=*\u00a2\n\n\n\nregard, the Tribunal in fact has proceeded on the basis\n\nthat the fare paying passengers in the vehicle wouldnot\n\nbe covered under the policy. In that context, \n\nreferred to have been considered by the   hi\n\nthis regard, the fact which cannot  &_disp;L1te'd_is\"that';\n\nthe claimant is the mother of thefirstilrespondent; <\/pre>\n

\nvehicle, when the acci’dent_\u00ab”hade–:lO.C-curred and she has
\ntendered her evidence as .V.hile_~.considering the<\/p>\n
evidence tendered:’bylihergther  has considered<\/p>\n
as if  staitieldlthat she was travelling
\nin the vehicle \u00abrare. In fact, perusal of the<\/p>\n
evidence wloulid ‘in’dic’ate”:that she was only travelling in<\/p>\n
itV.”-the”=vehic1el’ and  the mother of the owner of the<\/p>\n
7–.ve;lf1iclev..:’in”question. Hence paying fare in any event<\/p>\n
would no’t.arise. In that event, she would only travel as<\/p>\n
 Vlphipermitted passenger of the owner of the vehicle. if that<\/p>\n
r._l’b_le”the position, nature of the policy requires to be<\/p>\n
 “e\u00a7\u00a7amined. The Tribunal in fact has taken note of the<\/p>\n
policy, which was marked as EX.Rl. As the documents<\/p>\n
is available before this Court, the Lower Appellate Court<\/p>\n
have been received, a perusal of the policy would<\/p>\n
indicate that it is a package policy in respec’ti:’of’p:’-the<\/p>\n
vehicle in question. Though initially, thereuyverretiyi if<\/p>\n
contention even with regard to the “pacl<'i:ageipo}icy;–:the1<\/p>\n
position is now accepted by <\/p>\n
that in respect of the packageT"p.olicy,*–the- of V<\/p>\n
the vehicle would be.coyerethiTheref0.If\u20ac, invthis instant
\ncase, the judgement of the extent of<\/p>\n
exonerating the'~lrisuranCe–~Co1npai*1yis set aside and it<\/p>\n
is held iiii iithat} _pthe'fr4ii"1ns:irance"WCompany is liable to
\nreimburse the conipensatitorj.\n<\/p>\n
 With ._:re’gard.”tolvthe quantum compensation as<\/p>\n
i the Tribunal, it seen that the nature of the<\/p>\n
 established by the documents at<\/p>\n
Ex.P.5, \u00a7vl1eAr*ein the claimant had suffered fracture and<\/p>\n
 :jv.Ias_ also  patient for about six days. After taking note<\/p>\n
_i ofiitlte injuries sustained and evidence tendered, the<\/p>\n
  “disability has also been reckoned and in respect of the<\/p>\n
heads of loss of future earning and pain and suffering<\/p>\n
o<\/p>\n
LA<\/p>\n
the compensation awarded is appropriate. However, in<\/p>\n
respect of the head of loss of arnenitiels;:if”L–\u00ab.tE*i.\u00a2<\/p>\n
compensation is awarded on the lower side   ii<\/p>\n
