KAPADIA\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>1.\tChallenge in this appeal is to the order passed by a<br \/>\nDivision Bench of the Rajasthan High Court, Jaipur Bench,<br \/>\ndismissing the special leave filed by the appellant.\n<\/p>\n<p>2.\tBackground facts in a nutshell are as follows:\n<\/p>\n<p>\tRespondent was engaged as a casual labourer by the<br \/>\nAssistant Engineer of the Microwave Project Borabas for the<br \/>\njob of fixing of nuts and bolts in the Microwave Tower.  After<br \/>\ncompletion of the work and commissioning of the Microwave<br \/>\nTowers, respondent was relieved from his job on 1.12.1987.<br \/>\nOffice of the Microwave, Kota, was also abolished as there was<br \/>\nno need of work and in any event it was only of casual nature.<br \/>\nRespondent raised a dispute to the effect that there was<br \/>\ntermination of his services which is illegal. The Labour<br \/>\nMinistry, Govt. of India vide order dated 30.9.1991 referred the<br \/>\nfollowing dispute under Section 10(1) of the Industrial<br \/>\nDisputes Act, 1947 (in short the &#8216;Act&#8217;) to the Industrial<br \/>\nTribunal (Central) Kota, Rajasthan.\n<\/p>\n<p>&#8220;Whether the action of the AEN<br \/>\nMicrowave Project, Kota &amp; LET, Jaipur in<br \/>\nterminating the services of Shri Ramesh<br \/>\nChand, S\/o Shri Jankidas, Casual Labour<br \/>\nunder AEN Microwave Project, Kota at<br \/>\nLawatbhata w.e.f. 1.12. 1987 is justified?  If<br \/>\nnot, to what relief the concerned workman is<br \/>\nentitled?&#8221;\n<\/p>\n<p>3.\tOn behalf of the applicant it was pleaded that he had<br \/>\nbeen engaged as casual labourer on 8.12.1986 and, therefore,<br \/>\nhe having worked for more than 240 days in 12 calendar<br \/>\nmonths could not have been terminated. The appellant took<br \/>\nthe stand that the respondent was engaged for doing a<br \/>\nparticular work on a casual labour basis. Since the<br \/>\nestablishment itself was closed after completion of the work<br \/>\nthere was no scope for accepting the prayer of the respondent.<br \/>\nThe Tribunal held that since the respondent worked for 240<br \/>\ndays in the establishment of the present appellant, his<br \/>\ntermination will be bad as there was violation of the<br \/>\nmandatory requirements of Section 25-F of the Act.  Removal<br \/>\nfrom service amounted to retrenchment under Section 2 (oo) of<br \/>\nthe Act. With these conclusions it was held that the<br \/>\nrespondent was entitled to be re-employed to continue to be in<br \/>\nservice along with the 30% back wages.  A writ petition was<br \/>\nfiled before the High Court.  A learned Single Judge by a very<br \/>\ncryptic order held that the Labour Court has held that there<br \/>\nwas violation of the requirements of Section 25-F of the Act<br \/>\nand, therefore, there was no legality. The Division Bench came<br \/>\nto the similar conclusions.\n<\/p>\n<p>4.\tIn support of the appeal learned counsel for the appellant<br \/>\nsubmitted that there is no dispute that the engagement was<br \/>\nfor a specific project. The Tribunal has categorically noted<br \/>\nabout these aspects but granted relief to the respondent.  It<br \/>\nwas noted that the office of the present appellant was under<br \/>\nthe Jaipur Division and the new Kota Division has been<br \/>\ncreated after bifurcation of the Division.\n<\/p>\n<p>5.\tIn response, learned counsel for the respondent<br \/>\nsubmitted that it should be accepted that the project has been<br \/>\ncompleted, yet in view of the fact that there was bifurcation,<br \/>\nthe Tribunal was justified in its conclusion.\n<\/p>\n<p>6.\tWe find that the Tribunal failed to consider the issues in<br \/>\nproper perspective. The effect of Section 2(oo)(bb) has been<br \/>\ncompletely lost sight of. There was no dispute that the<br \/>\nemployment was for a specific project. There was no<br \/>\ndiscussion of the various materials produced before the<br \/>\nTribunal.  The orders of the High Court proceeded on the basis<br \/>\nthat because there was non-compliance with the requirements<br \/>\nof Section 25-F, the Award was justified.  The  question  of<br \/>\nthe applicability of Section 25-F of the  Act  would be<br \/>\ndependent  upon  the  basic  question relating to applicability<br \/>\nof Section 2(oo)(bb) of  the  Act.  That  aspect has been lost<br \/>\nsight of. We, therefore, think it appropriate to remit the matter<br \/>\nto the Tribunal for fresh consideration. Parties will be<br \/>\npermitted to place material in support of their respective<br \/>\nstand.
