Notice to<\/p>\n<p>respondents  dispensed  with  preserving  their<\/p>\n<p>right  to  move  for  rehearing  of  this  writ<\/p>\n<p>petition, if aggrieved.\n<\/p>\n<p>   2. On the strength of an assignment in its<\/p>\n<p>favour, the petitioner applied for change of<\/p>\n<p>the  name  of  the  owner  of  the  building  in<\/p>\n<p>question, in the assessment register of the<\/p>\n<p>Grama Panchayat. Going by the impugned Ext.P3,<\/p>\n<p>the Secretary of Grama panchayat records that<\/p>\n<p>the rights of the erstwhile owner has been<\/p>\n<p>transferred to the petitioner. But, the change<\/p>\n<p>of  the  entries  in  the  assessment  register<\/p>\n<p>regarding the name of the owner is refused on<\/p>\n<p>the ground that the petitioner is likely to put<\/p>\n<p><span class=\"hidden_text\">Wpc 35096\/09            2<\/span><\/p>\n<p>up a resort and on local inspection it has come<\/p>\n<p>out that the petitioner&#8217;s intention is to put<\/p>\n<p>up a resort. That is not a ground to refuse to<\/p>\n<p>make     entry regarding change  of  ownership.<\/p>\n<p>Putting up a resort or putting the land to any<\/p>\n<p>other use by making constructions would be a<\/p>\n<p>matter that would arise for decision only when<\/p>\n<p>request for permission in that regard comes up<\/p>\n<p>for consideration. The impugned order and the<\/p>\n<p>reasons stated therein, essentially affects the<\/p>\n<p>rights of the petitioner under the Panchayat<\/p>\n<p>Raj Act and also fundamental rights referable<\/p>\n<p>to Part III of the Constitution. There is no<\/p>\n<p>prohibition either in Panchayat Raj Act or in<\/p>\n<p>Transfer of Property Act pointed out by the<\/p>\n<p>Secretary, in terms of which transfer in favour<\/p>\n<p>of the petitioner is void.\n<\/p>\n<p>     3. For the aforesaid reasons, this writ<\/p>\n<p>petition is allowed quashing Ext.P5 directing<\/p>\n<p><span class=\"hidden_text\">Wpc 35096\/09            3<\/span><\/p>\n<p>the Grama Panchayat Secretary to take up the<\/p>\n<p>request of the petitioner for change of the<\/p>\n<p>name of the owner in the assessment register<\/p>\n<p>and    issue  decision on  such  request  without<\/p>\n<p>reference to the reasons stated in Ext.P3.
