Oza, learned standing counsel for the Central Government<br \/>\nwaives service of Rule for the respondents.\n<\/p>\n<p>2.\t\tIn<br \/>\nthis petition under Article 226 of the Constitution, the petitioners,<br \/>\ni.e. Choksi Silk Mils and one of its partners, have challenged the<br \/>\norders dated 09.08.2007, 15.10.2007, 20.11.2007 and 27.03.2008<br \/>\n(Annexures A, B, C and H respectively) of the Customs, Excise and<br \/>\nService Tax Appellate Tribunal, Ahmedabad Bench in Appeal Nos.E\/643<br \/>\nand 644 of 2007 and the stay applications made therein.\n<\/p>\n<p>3.\t\tIn<br \/>\nview of the order that we propose to pass, it is not necessary to set<br \/>\nout the facts in detail.\n<\/p>\n<p>\t\tRespondent<br \/>\nNo.3 passed an order-in-original confirming the demand of Cenvat<br \/>\ncredit of Rs.93,64,004\/- and also imposed penalty of an equal<br \/>\namount. The said order dated 30.10.2006 also demanded interest<br \/>\nfrom petitioner No.1 from the due date. Personal penalty was also<br \/>\nimposed on petitioner No.2. The petitioners challenged the said<br \/>\norders before the Tribunal and preferred stay applications. By order<br \/>\ndated 09.08.2007, the Tribunal directed the petitioners to make<br \/>\npre-deposit of Rs.40 lacs in addition to the payment of Rs.4 lacs<br \/>\nalready made during the course of the investigation.  For making such<br \/>\ndeposit, eight weeks time was granted. The modification applications<br \/>\nmade by the petitioners came to be rejected on 15.10.2007, but the<br \/>\ntime for making pre-deposit was extended and compliance was to be<br \/>\nreported on 20.11.2007.  The petitioners did not comply with the<br \/>\norder of pre-deposit but, again, made an application for modification<br \/>\nof that order.  Again, while rejecting the modification application,<br \/>\nthe Tribunal granted further extension of two weeks and compliance<br \/>\nwas to be reported on 04.12.2007.  In the writ petition, filed by the<br \/>\npetitioners before this Court, by order dated 19.12.2007, the<br \/>\npetitioners were directed to make the deposit of Rs.40 lacs within<br \/>\nthree months and till then, the Tribunal was directed not to dismiss<br \/>\nthe appeals.\n<\/p>\n<p>4.\t\tBy<br \/>\n18.03.2008, the petitioners deposited only Rs.12,78,000\/- and filed<br \/>\nMisc. Civil Application No.1116 of 2008 before this Court for<br \/>\nextension of time limit for depositing the balance amount of<br \/>\nRs.27,22,000\/-. After the said application was preferred before this<br \/>\nCourt on 18.12.2007, the petitioners requested the Tribunal by<br \/>\napplication dated 19.03.2008 to grant some more time for reporting<br \/>\ncompliance.  It appears that the petitioners requested the Tribunal<br \/>\nto defer the hearing for some more time, because the M.C.A. filed<br \/>\nbefore this Court for extension of time limit was fixed for hearing<br \/>\non 28.03.2008. However,  the Tribunal dismissed the appeals on<br \/>\n27.03.2008 on the ground of non-compliance of the pre-deposit order.<br \/>\nThus, that M.C.A. came to be disposed of by this Court on 15.04.2008<br \/>\non the ground that the application had become infructuous.  The<br \/>\napplication was allowed to be withdrawn with liberty to challenge the<br \/>\nconcerned orders in a substantive writ petition.\n<\/p>\n<p>5.\t\tThe<br \/>\npetitioners have, now, moved this Court with the present petition<br \/>\nsubmitting that when the petitioners&#8217; application for extension being<br \/>\nM.C.A. No.1116 of 2008 was pending before this Court and was fixed<br \/>\nfor hearing on 28.03.2008, the Tribunal ought not to have dismissed<br \/>\nthe appeal on 27.03.2008 on the ground of non-compliance of the<br \/>\npre-deposit order.\n<\/p>\n<p>6.\t\tAt the first<br \/>\nhearing of this petition, learned counsel for the petitioners had<br \/>\nstated that undertaking that over and above Rs.12,78,000\/- already<br \/>\ndeposited earlier towards the liability under consideration<br \/>\n(including adjustment of Rs.5,00,000\/- against the refund sanctioned<br \/>\nby the Assistant Commissioner, Central Excise Division \u00fd  1, Surat<br \/>\non 10.03.2008), petitioner No.1 would deposit a further sum of<br \/>\nRs.5,00,000\/- by 01.05.2008 and the remaining sum of Rs.22,22,000\/-<br \/>\nwill be deposited by 31.07.2008.  This Court issued notice and<br \/>\ngranted ad-interim stay against coercive recovery.\n<\/p>\n<p>7.\t\tMr.R.J. Oza,<br \/>\nlearned standing counsel appears for the respondent authorities and<br \/>\nopposes the petition on the ground that the Tribunal itself had<br \/>\ngranted several extensions and this Court had also granted three<br \/>\nmonths&#8217; time to make the pre-deposit. It is submitted that the<br \/>\npetitioners having failed to avail of these opportunities, no further<br \/>\nindulgence may be granted.\n<\/p>\n<p>8.\t\tHaving heard the<br \/>\nlearned counsel for the parties, it appears that several<br \/>\nopportunities were granted to the petitioners to comply with the<br \/>\npre-deposit order. The learned counsel for the petitioners, however,<br \/>\nsubmits that it was on account of the financial difficulties<br \/>\nthat the petitioners were not in a position to comply with the<br \/>\npre-deposit order and that, for the delay in complying with the<br \/>\npre-deposit order, the petitioners are prepared to deposit some<br \/>\nadditional amount, which may be treated as deposit towards the<br \/>\ndisputed liability.\n<\/p>\n<p>9.\t\tIn view of the<br \/>\nabove submissions, we are of the view that the interests of justice<br \/>\nwould be served if the petitioners are directed to deposit additional<br \/>\nsum of Rs.4 lacs over and above the amount of Rs.40 lacs as<br \/>\nstipulated in the pre-deposit order of the Tribunal.\n<\/p>\n<p>10.\t\tMr.Nanavati,<br \/>\nlearned counsel for the petitioners, however, submits that since the<br \/>\npetitioners are required to pay the remaining sum of Rs.22,22,000\/-<br \/>\non the basis of the pre-deposit order of the Tribunal, and now, there<br \/>\nwill be additional liability of Rs.4 lacs for paying the amount of<br \/>\nRs.26,22,000\/-, the petitioners may be granted some longer time.\n<\/p>\n<p>\tThe request appears<br \/>\nto be reasonable.\n<\/p>\n<p>11.\tIn view of the<br \/>\nabove discussion, we direct that the petitioners shall deposit a<br \/>\ntotal amount of Rs.44 lacs including the amount of Rs.12,78,000\/-<br \/>\nlacs already deposited by the petitioners earlier.  We further direct<br \/>\nthat the remaining amount of Rs.26,22,000\/- shall be deposited by the<br \/>\npetitioners in four equal monthly installments. The first installment<br \/>\nshall be paid by 07.07.2008 and the subsequent installments shall be<br \/>\npaid on the 7th day of each succeeding months.  The<br \/>\npetitioners shall file the revised undertaking on the aforesaid basis<br \/>\nwithin one week from today. After the petitioners file such under<br \/>\ntaking, the Tribunal shall restore Appeal Nos. E\/643 and 644 of 2007<br \/>\nand shall hear them at the earliest after the petitioners deposit<br \/>\nRs.26,22,000\/- within the above time limit.\n<\/p>\n<p>\t\tSubject to the above<br \/>\ndirections, the impugned orders dated  09.08.2007, 15.10.2007,<br \/>\n20.11.2007 and 27.03.2008 are hereby set aside and shall be<br \/>\nsubstituted by the aforesaid directions.  In case, the petitioners<br \/>\nfail to comply with the above directions, the orders passed by the<br \/>\nTribunal shall stand restored.\n<\/p>\n<p>12.\t\tRule is made<br \/>\nabsolute in the aforesaid terms.\n<\/p>\n<p>\tIn the facts and<br \/>\ncircumstances of the case, the petitioners are directed to pay the<br \/>\nrespondents costs of Rs.2,000\/- in one set within one month from<br \/>\ntoday.\n<\/p>\n<p>(M.S.
