The respondent no. 2<br \/>\nissued directions insisting that in addition to license for sale,<br \/>\nstock and distribution every person indenting to sell, stock or<br \/>\ndistribute insecticides and pesticides within the State of Gujarat<br \/>\nshould obtain permission form it.  The petitioners addressed letters<br \/>\nto various state governments pointing out that insistence on dealers<br \/>\nfor obtaining permission for sale of registered pesticides is<br \/>\nnon-statutory.  However, being aggrieved by the insistence on the<br \/>\npart of the respondent authorities, the present petition is<br \/>\npreferred.\n<\/p>\n<p>3.\tThis<br \/>\nmatter was admitted on 09.08.2004 only on the ground that in a<br \/>\npetition filed by the petitioners and others in the High Court of<br \/>\nBombay, being Writ Petition No. 4597\/02, the Bombay High Court<br \/>\ngranted ad-interim relief.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate for the respondent has placed on record the copy of the<br \/>\ndecision of the Bombay High Court wherein the petition is dismissed.<br \/>\nParas 2 &amp; 3 of the said judgement read as under:\n<\/p>\n<p>&#8220;2.\n<\/p>\n<p>Affidavit in reply has been filed only to reiterate what has been<br \/>\nprovided for by Rules 10(3) and (4) of the Insecticides Rules, 1971.<br \/>\nIn a rejoinder filed to this reply today, a very clear mention is<br \/>\nmade which is not controverted that for each established in the State<br \/>\nof Maharashtra the petitioners hold a valid licence\/permission as<br \/>\ncontemplated by Rule 10(4) of the Insecticides Rules 1971.\n<\/p>\n<p>3.<br \/>\nIn view of this factual situation there is no cause for the<br \/>\npetitioner to make the above mentioned prayers.  There is no proof on<br \/>\nrecord that there is any insistence for obtaining any other licence<br \/>\nthan one mentioned in Rule 10(4) of the Insecticides Rules 1971.\n<\/p>\n<p>4.<br \/>\nIn this view of the matter, there is no reason to interfere.<br \/>\nPetition dismissed.&#8221;\n<\/p>\n<p>5.\tAs<br \/>\na result of hearing and perusal of records, this court is of the<br \/>\nopinion that the decision of the Bombay High Court will be applicable<br \/>\nto the facts and circumstances of the present case.  Thus no further<br \/>\norders are required to be passed.  Petition stands disposed of<br \/>\naccordingly.  Rule is discharged.
