S\/O NOT KNOWN\n         BANMANKHI,P.S.BANMANKHI, DISTT-PURNIA\n                                              -----------\n<\/pre>\n<p>               For the Petitioner:-      Mr. Ajay Kumar Thakur, Adv.\n<\/p>\n<p>                                         Mr. Ravi Ranjan-I, Adv.\n<\/p>\n<p>                                         Mr. Amir Alam, Adv.\n<\/p>\n<p>                                         Mr. Amit Kumar, Adv.\n<\/p>\n<pre>               For the State:-           G.A.-8\n                                -------------\n\n2.   4.11.2010              Heard learned counsel for the petitioner\n\n                 and the State.\n\n<\/pre>\n<p>                            The petitioner is stated to belong to the<\/p>\n<p>                 Reserved Category in the Police service and was<\/p>\n<p>                 appointed as Deputy Superintendent of Police by<\/p>\n<p>                 direct   recruitment   pursuant   to   examination<\/p>\n<p>                 conducted by the B.P.S.C. in 1984.      In the year<\/p>\n<p>                 1994 he was unauthorizedly absent for certain<\/p>\n<p>                 periods stated to be from 5.7.1994 to 10.7.1994.<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>Departmental proceedings were initiated against<\/p>\n<p>him.     The enquiry report has been submitted on<\/p>\n<p>8.2.2008 concluding that no charges were made out.<\/p>\n<p>The disciplinary authority accepted the finding and<\/p>\n<p>by formal order dated 16.9.2008, the charges were<\/p>\n<p>dropped and the proceedings were closed.<\/p>\n<p>             On 17.11.2008 the petitioner is stated to<\/p>\n<p>have represented to be considered for promotion as<\/p>\n<p>Senior    Deputy    Superintendent        of        Police   and<\/p>\n<p>Assistant Superintendent of Police. Further claim is<\/p>\n<p>raised in the writ petition for the grant of 2nd A.C.P.<\/p>\n<p>The petitioner is stated to have again represented on<\/p>\n<p>12.9.2009.    The petitioner is then stated to have<\/p>\n<p>been promoted to the post of Senior Deputy<\/p>\n<p>Superintendent of Police on 27.11.2009.                      The<\/p>\n<p>surviving claim is for promotion to the post of<\/p>\n<p>Assistant Superintendent of Police and 2nd A.C.P.<\/p>\n<p>only.\n<\/p>\n<p>             If the petitioner has been exonerated in<\/p>\n<p>the departmental proceedings and there is no other<\/p>\n<p>legal impediment in consideration of his case for<\/p>\n<p>promotion attributable to the petitioner, let his case<\/p>\n<p>for     promotion       to   the   post        of     Assistant<\/p>\n<p>Superintendent of Police as also for grant of 2nd<\/p>\n<p>A.C.P. be considered within a maximum period of<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>           four months from the date of receipt and\/or<\/p>\n<p>           presentation   of       a   copy   of   this   order   and<\/p>\n<p>           appropriately orders passed in accordance with law.<\/p>\n<p>                      The writ application stands disposed.<\/p>\n<pre>P.
