M. SAHAI)<\/a><\/p>\n<p>1.\t\tWe<br \/>\nhave heard Mr. Pathak, learned counsel appearing for the petitioners,<br \/>\nMr. Qureshi, learned counsel appearing for respondents nos. 1 to 3<br \/>\nand Mr. Shalin Mehta, learned counsel appearing for Mr. Shrimali, for<br \/>\nrespondents nos. 4 and 5.\n<\/p>\n<p>2.\t\tThis<br \/>\npetition has been filed by the petitioners challenging the judgment<br \/>\nand order dated 18.07.2000 passed in O.A. No. 149 of 2000 and<br \/>\njudgment and order  dated 17.10.2000 passed in Review Application No.<br \/>\n49 of 2000.\n<\/p>\n<p>3.<br \/>\nThe main grievance of the petitioners is that when the selection of<br \/>\n&#8216;Peon&#8217; was held, the petitioners were selected candidates. Their<br \/>\nselection was challenged by respondents nos. 4 and 5 on the ground<br \/>\nthat proper procedure was not followed and that none of the selected<br \/>\ncandidates were impleaded. Therefore the candidates were impleaded as<br \/>\nparty in OA No. 149 of 2000. The Tribunal by order dated 18.07.2000<br \/>\nallowed the said OA and set aside the selection of the present<br \/>\npetitioners on the ground that selection procedure was not properly<br \/>\nfollowed and was ab-initio. Since the petitioners were not<br \/>\nheard, they preferred an application for review being Review<br \/>\nApplication no. 49 of 2000 inter alia contending that they<br \/>\nwere the necessary party and without hearing them the selection could<br \/>\nnot be quashed by the Tribunal. The Tribunal vide order dated<br \/>\n17.10.2000 rejected the review application on the ground that there<br \/>\nis no error apparent on the face of the record and the scope of<br \/>\nreview being very limited, no interference was called for in the<br \/>\njudgment of the Tribunal.\n<\/p>\n<p>3.1.\t\tMr.\n<\/p>\n<p>Mehta, learned counsel appearing with Mr. Shrimali, for respondents<br \/>\nnos. 4 and 5 urged that the writ petition filed by the Union of India<br \/>\nhas been dismissed summarily.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard the learned counsel for the respective parties, we are of the<br \/>\nopinion that the petitioners had no choice except to bring to the<br \/>\nnotice of the Tribunal by way of filing review application that they<br \/>\nwere the necessary party and in any case the proper parties and<br \/>\nwithout impleading them or some of the selected candidates, the<br \/>\nTribunal could not set aside the entire selection of the selected<br \/>\ncandidates and prima facie the Tribunal rejected the review<br \/>\napplication. The Apex Court in the case of GRIJESH SHRIVASTAVA &amp;<br \/>\nORS. v. STATE OF MADHYA PRADESH &amp; ORS. (2010) 10 SCC 707, in<br \/>\nparagraphs nos. 20 to 23 has held as under :-\n<\/p>\n<p>&#8220;20.\n<\/p>\n<p>The next point urged by the appellants, that they had never been<br \/>\nimpleaded in the two petitions, even as orders passed by the High<br \/>\nCourt had a direct effect on their livelihood, also goes to the root<br \/>\nof the matter as it violates the principle of audi alteram partem.\n<\/p>\n<p>21.<br \/>\nThis Court in Prabodh Verma and others vs.State of Uttar Pradesh and<br \/>\nothers,[(1984) 4 SCC 251 at p. 273 para 28]<\/p>\n<p>&#8220;28. &#8230;&#8230; A High Court ought not to decide a writ petition<br \/>\nunder Article 226 of the Constitution without the persons who would<br \/>\nbe vitally affected by its judgment being before it as<br \/>\nrespondents&#8230;&#8221;.\n<\/p>\n<p>22.<br \/>\n Similarly this Court in Ramarao and others vs. All India Backward<br \/>\nClass Bank Employees Welfare Association and others,[(2004) 2 SCC 76,<br \/>\nat pp 86-87 said (SCC para 27)<\/p>\n<p>\t&#8220;27.\n<\/p>\n<p>&#8230;&#8230;An order issued against a person without impleading him as<br \/>\na party and thus, without giving an opportunity of hearing must be<br \/>\nheld to be bad in law. The appellants herein, keeping in view the<br \/>\nfact that by reason of the impugned direction, the orders of<br \/>\npromotion effected in their favour had been directed to be withdrawn,<br \/>\nindisputably were necessary parties. In their absence, therefore, the<br \/>\nwrit petition could not have been effectively adjudicated upon.\n<\/p>\n<p>23.<br \/>\nAlso in <a href=\"\/doc\/1114006\/\">B. Ramanjini and others v. State of Andhra Pradesh and<br \/>\nothers<\/a>, [(2002) 5 SCC 533 at pp 542-43, para 9]<\/p>\n<p>\t&#8220;19.\n<\/p>\n<p>Selection of certain teachers was challenged without impleading them,<br \/>\nthis Court held, &#8220;Selection process had commenced long back as<br \/>\nearly as in 1998 and it had been completed. The persons selected were<br \/>\nappointed pursuant to the selections made and had been performing<br \/>\ntheir duties. However, the selected candidates had not been impleaded<br \/>\nas parties to the proceedings either in their individual capacity or<br \/>\nin any representative capacity. In that view of the matter, the High<br \/>\nCourt ought not to have examined any of the questions raised before<br \/>\nit in the proceedings initiated before it. The writ petitions filed<br \/>\nby the respondents concerned ought to have been dismissed which are<br \/>\nmore or less in the nature of a public interest litigation.&#8221;\n<\/p>\n<p>5.\t\tIn<br \/>\nview of the aforesaid decision, some of the selected candidates ought<br \/>\nto have been impleaded as respondents in OA No. 149 of 2000. In their<br \/>\nabsence the selection could not be quashed. In this view of the<br \/>\nmatter, since no selected candidates were employed with the<br \/>\nrespondents, the order of the Tribunal passed in OA No 149 of 2000<br \/>\nand the order passed in Review Application cannot be maintained.\n<\/p>\n<p>6.\t\tIn<br \/>\nthe result, the petition succeeds and is allowed. The judgment and<br \/>\norder dated 18.07.2000 passed in O.A. No. 149 of 2000 and judgment<br \/>\nand order dated 17.10.2000 passed in Review Application No. 49 of<br \/>\n2000 are quashed and set aside.  The Tribunal is directed to decide<br \/>\nthe matter afresh after permitting the petitioners to implead<br \/>\nselected candidates and respondents and after serving the<br \/>\nrespondents. We made it clear that we have not decided the matter on<br \/>\nmerits, which shall be decided by the Tribunal. However, the<br \/>\nappointment of the selected candidates which was allowed by this<br \/>\nCourt by way interim order shall be subject to final decision of the<br \/>\nTribunal.
