No. 528 OF 2003\n              - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                  Dated this the 20th day of august 2008\n\n                                  JUDGMENT\n<\/pre>\n<p>RAMACHANDRAN NAIR,J<\/p>\n<p>       The appeal is filed against the award of MACT, granting<\/p>\n<p>compensation to the appellants for the death of the first appellant&#8217;s<\/p>\n<p>husband, in a motor accident. The accident occurred as a result of a<\/p>\n<p>collision between the motor vehicle driven by the first appellant&#8217;s<\/p>\n<p>husband and the jeep driven by the first respondent. However, 50%<\/p>\n<p>of the compensation awarded is reduced on account of the<\/p>\n<p>negligence of the deceased who was driving the bike. We notice that<\/p>\n<p>this finding is purely based on the evidence of PW2, who is none<\/p>\n<p>other than the witness of the appellant, who has stated that the jeep<\/p>\n<p>hit on the left side of the motor bike. This is the sole basis on which<\/p>\n<p>MACT held that accident was partly on account of contributory<\/p>\n<p>negligence by the deceased. However, MACT has not considered<\/p>\n<p>remaining evidence furnished by PW2. He has stated that jeep was<\/p>\n<p>driven in a high speed and negligent manner. Moreover, the scene<\/p>\n<p>mahazar and final report furnished by the police are not even<\/p>\n<p>considered by the MACT. Another thing noted by the MACT is that<\/p>\n<p>M.A.C.A.No.528\/2003<br \/>\n<span class=\"hidden_text\">                                  -2-<\/span><\/p>\n<p>the deceased had not exhibited `L&#8217; in the vehicle even though he had<\/p>\n<p>only a learner&#8217;s licence. We do not think the MACT has considered<\/p>\n<p>the entire evidence in the matter, but has solely relied on a<\/p>\n<p>piecemeal statement from one of the witnesses to find contributory<\/p>\n<p>negligence of the deceased.\n<\/p>\n<p>     2.    So far as the challenge against the amount of<\/p>\n<p>compensation is concerned, we are unable to uphold the assumption<\/p>\n<p>of MACT that the wife of the deceased could have carried on the<\/p>\n<p>newspaper agency that the deceased was running. Further finding<\/p>\n<p>that the deceased would not have been engaged in agricultural<\/p>\n<p>operations as he was engaged in other business also is not tenable.<\/p>\n<p>     For the reasons stated above, the award passed by the MACT<\/p>\n<p>is set aside with a direction to the MACT to consider the entire<\/p>\n<p>evidence in the matter, hear both sides and decide the matter on all<\/p>\n<p>issues afresh within a period of three months from the date of receipt<\/p>\n<p>of a copy of this judgment.
