V\/s Union of India &amp; ors.<br \/>\n2.4.2009<br \/>\n     Hon&#8217;ble the Chief Justice Mr.Deepak Verma<br \/>\n           Hon&#8217;ble Mr.Justice N.P.Gupta<\/p>\n<p>Mr.P.P.Choudhary for the petitioners.<br \/>\nMr.Kuldeep Mathur for respondents no.1,2,3,7 &amp; 8.<br \/>\nMr.R.S.Saluja for respondent no.6.<br \/>\nMr.G.R.Punia, Addl.Advocate General for respondent<br \/>\nno.4.\n<\/p>\n<p>     In      this         public            interest           litigation,<br \/>\npetitioners are raising grievances with regard to<br \/>\nalleged encroachment being made by the respondent-<br \/>\nAir Officer Commanding, Air Force Station, Jodhpur<br \/>\non public road by raising boundary wall, thereby<br \/>\nencroaching 25-30 ft., a public road. According to<br \/>\npetitioners, there existed 120 ft. wide road from<br \/>\nKV   No.1,    Air    Force        to       the     Air    Force      Station<br \/>\nconnecting     several          colonies          situated      on    either<br \/>\nside of it, namely,             Central School Scheme, Arvind<br \/>\nNagar, Anjana Patel Nagar, Vidhya Park etc. It has<br \/>\nfurther been contended that on the western side of<br \/>\nthe road, there exists commercial area adjacent to<br \/>\nthe road.\n<\/p>\n<p>     Notices       were    directed          to    be     issued     to    the<br \/>\nrespondents, returnable on 25.3.2009.\n<\/p>\n<p>     Replies        have        been       filed         by    respondents<br \/>\nno.1,2,3,7     &amp;     8     as     one       set,        respondent        no.4<br \/>\nDistrict     Collector,         Jodhpur          and     respondent       no.6<br \/>\nMunicipal Corporation, Jodhpur. They all have said<br \/>\nin one voice that Air Force Station, Jodhpur is<br \/>\nneither    encroaching          on     any       public       road   nor   is<br \/>\nconstructing boundary wall by encroaching public<br \/>\nroad. It is clearly pleaded that security fencing<br \/>\nincluding           technical                and          administrative<br \/>\n<span class=\"hidden_text\">                                          2<\/span><\/p>\n<p>accommodation for No.8 Provost and Security (Unit)<br \/>\nof the Indian Air Force at Jodhpur was sanctioned<br \/>\nby     the      competent          authority      in     Sept.1981        and<br \/>\naccordingly, the work was completed in the year<br \/>\n1983. Copy of the letter of 17.9.1981 has been<br \/>\nannexed as Annex.R\/1.                    According to them, in the<br \/>\nmonth of June, 2008, Government of India, Ministry<br \/>\nof Defence had issued sanction for construction of<br \/>\nperimeter wall at Air Force Station, Jodhpur. On<br \/>\nreceipt of Government sanction, the perimeter wall<br \/>\nis being constructed as security fencing existed<br \/>\nwhich      was    erected      in    Sept.1981.        It    has    further<br \/>\nbeen contended by respondents that 25 bighas in<br \/>\nKhasra no.795\/685 was physically measured by the<br \/>\nDistrict               Revenue               Officials          alongwith<br \/>\nrepresentative            from       Defence          Estate       Officer,<br \/>\nJodhpur, in which 15 bighas of land was found in<br \/>\nphysical possession of Air Force and rest of 10<br \/>\nbighas was occupied by road and other populated<br \/>\nareas.       They      have    therefore,         contended        that    in<br \/>\nplace of the fencing, which existed earlier, they<br \/>\nare constructing the boundary wall.\n<\/p>\n<p>       A     rejoinder        to    this      reply    was     filed      and<br \/>\nsignificantly            it        was       categorically         admitted<br \/>\ntherein as under:-\n<\/p>\n<blockquote><p>       &#8220;It is stated in the reply that the Air Force<br \/>\n       Provost Headquarter (No.8 Provost and Security<br \/>\n       Unit) was established and barbed fence was<br \/>\n       erected in the year 1981. It is true but it<br \/>\n       goes without saying that it was done without<br \/>\n       any proper demarcation of the land by the<br \/>\n       revenue authorities&#8230;&#8230;&#8230;&#8230;.&#8221;<\/p><\/blockquote>\n<p>       The       District      Collector,         Jodhpur-respondent<br \/>\nno.4       in    his   reply       has       submitted      that    present<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>location of the Air Force Station is in Khasra<br \/>\nno.670 and Khasra no. 670\/1 measuring 40.04 bighas<br \/>\nand   Khasra       no.670\/2     measuring         0.10    bighas,     as<br \/>\nrecorded in the name of Defence in the Jamabandi<br \/>\nand    Khasra      no.670      measuring      154.12        bighas    is<br \/>\nrecorded      as   Government         land   in    the      Jamabandi.<br \/>\nAnnex.R\/4\/1        is    the    report       of    the      Tehsildar,<br \/>\nJodhpur dated 1.4.2009. The Tehsildar has reported<br \/>\nthat there is no settlement map available in the<br \/>\nrecord. The land under occupation of the Air Force<br \/>\nStation was surveyed in 2007 under the orders of<br \/>\nthe Collector, Jodhpur and on the basis of the<br \/>\noccupation of the land of the Air Force Station,<br \/>\nmap    was    prepared.        According          to     him,     Khasra<br \/>\nno.670\/1 is having an area of 40.04 bighas and<br \/>\nKhasra no.670\/2 is having 0.10 bighas of land in<br \/>\nthe name of Defence and Khasra no.670 having area<br \/>\nof 154.12 bigha, is recorded as Government land.\n<\/p>\n<p>      The Municipal Corporation, Jodhpur-respondent<br \/>\nno.6 has replied that pursuant to the directions<br \/>\nof    the    Court,      Assistant     Engineer        of    Municipal<br \/>\nCorporation        had     visited      the       site      and      took<br \/>\nmeasurement. According to the measurement taken,<br \/>\nhe has found that Air Force Station is raising<br \/>\nconstruction of boundary wall within 25 bighas of<br \/>\nland allotted to it. The map produced by the said<br \/>\nAssistant Engineer has been filed by respondent<br \/>\nno.6 as Annex.R\/6\/1. It has further been noted                         in<br \/>\nhis report         that even though the proposed width<br \/>\nfrom Gaurav Path is 120 ft. but at some places,<br \/>\nthe width is fluctuating.\n<\/p>\n<p><span class=\"hidden_text\">                                      4<\/span><\/p>\n<p>     From the documents available on record, it is<br \/>\nneither    reflected          nor        established         that      while<br \/>\nconstructing the boundary wall, Air Force Station,<br \/>\nJodhpur is encroaching on public road. Rather from<br \/>\nthe pleadings referred to above, it is clear that<br \/>\nadmittedly the Air Force Provost Headquarter was<br \/>\nestablished      and        barbed       fencing       was   erected      in<br \/>\n1981. According to respondents no.1,2,3,7 and 8,<br \/>\nthe wall is being constructed at the same place<br \/>\nwhere the barbed fencing existed since inception.\n<\/p>\n<p>     It   was     sought       to    be     contended        by     learned<br \/>\ncounsel for the petitioners on the basis of the<br \/>\ninterim reply filed on behalf of respondent no.4<br \/>\nwherein a dispute has been raised supporting the<br \/>\ncase of the petitioners about title of the land to<br \/>\nbe   vesting     in     the    other       respondents.           It    will<br \/>\nsuffice     to        say     that        this     public         interest<br \/>\nlitigation       is    not    available          for    settling       that<br \/>\ndispute, moreso, when as found above, the barbed<br \/>\nfencing    existed          since    inception         i.e.       1981,   at<br \/>\nwhich     very    place        for       security        reasons,         the<br \/>\nboundary wall is being erected.\n<\/p>\n<p>     In the light of the aforesaid, we are of the<br \/>\nconsidered opinion that no case has been made out<br \/>\nfor issuance of writ in favour of the petitioners.<br \/>\nApart from the above, it is also to be seen that<br \/>\npetitioners have raised several disputed questions<br \/>\nof fact, which cannot be gone into in this writ<br \/>\npetition, which is filed in the nature of public<br \/>\ninterest litigation.\n<\/p>\n<p><span class=\"hidden_text\">                                  5<\/span><\/p>\n<p>       However,    the    petitioners,       if   they    are    so<br \/>\nadvised,     can   go    to    civil   court      for    grant   of<br \/>\nrelief, that may be permissible to be granted to<br \/>\nthem    in   accordance       with   law,   but   in    this    writ<br \/>\npetition, there is no merit or substance.
