SIRI JAGAN, J.\n                 -----------------------------------\n                   W.P.(C) No.24453 OF 2010\n              ---------------------------------------\n          Dated this the 16th day of November, 2010\n\n                             JUDGMENT\n<\/pre>\n<p>      The petitioner is the son of late Smt. Annamma P.S., who<\/p>\n<p>died on 22.3.2005 while working as Junior Public Health Nurse in<\/p>\n<p>the Health Service Department of the Government of Kerala. The<\/p>\n<p>petitioner applied for compassionate employment under the<\/p>\n<p>Compassionate Employment Scheme of the Government.                The<\/p>\n<p>Government, by Ext.P7 order, allowed the prayer of the petitioner<\/p>\n<p>and directed the Director of Health Services to take appropriate<\/p>\n<p>action in the matter. But, although that order was passed on<\/p>\n<p>5.5.2008, the petitioner was not given an appointment and<\/p>\n<p>posting in accordance with Ext.P7 order, is the grievance of the<\/p>\n<p>petitioner. On 8.9.2010, I passed the following order:<\/p>\n<blockquote><p>          &#8220;The learned Government Pleader on instructions<br \/>\n          submits   that,  although   the  Government      have<br \/>\n          decided to give compassionate employment to the<br \/>\n          petitioner, at present the petitioner cannot be<br \/>\n          appointed    for  want    of  sufficient    vacancies.<br \/>\n          According to him, only 5% vacancies are set apart<br \/>\n          for giving compassionate employment and the<br \/>\n          petitioner is the 6th in the seniority list.  I am of<br \/>\n          opinion that, such a stand would defeat the very<br \/>\n          purpose    of   the    scheme    of   compassionate<br \/>\n          employment. This court and the Hon&#8217;ble Supreme<br \/>\n          Court has repeatedly held that, the very object of<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.24453\/10                 2<\/span><\/p>\n<p>           the   compassionate  employment     is  to  give<br \/>\n           immediate succor to the family of the deceased<br \/>\n           Government employee which is in distress on<br \/>\n           account  of  the  death   of  the   Government<br \/>\n           employee.   In one case the Hon&#8217;ble Supreme<br \/>\n           Court   has  even   held   that,  if  necessary,<br \/>\n           appointments   shall  be   made    by   creating<br \/>\n           supernumerary    vacancies.     Therefore    the<br \/>\n           government shall consider the matter and give a<br \/>\n           considered opinion on the basis of the above<br \/>\n           observations and the decisions of this court and<br \/>\n           the Hon&#8217;ble Supreme Court within a period of one<br \/>\n           month.\n<\/p><\/blockquote>\n<p>Today, the learned Government Pleader submits that there are<\/p>\n<p>two vacancies in Wayanad District as L.D.Clerk and the<\/p>\n<p>petitioner can be appointed in one of those vacancies.<\/p>\n<p>      Accordingly, this writ petition is disposed of with a<\/p>\n<p>direction to the first respondent to issue to the petitioner an<\/p>\n<p>appointment order appointing the petitioner in one of those<\/p>\n<p>vacancies within one month from the date of receipt of a copy<\/p>\n<p>of this judgment.\n<\/p>\n<\/p>\n<p>                                       S.
