Justice J.M.JAMES\n\n Dated :31\/08\/2006\n\n O R D E R\n                            J.M.JAMES, J.\n\n                              --------------\n\n                           B.A. 5370\/2006\n\n                            ------------------\n\n    DATED THIS THE 31ST DAY OF AUGUST, 2006\n\n\n\n\n                              O R D E R\n<\/pre>\n<p>             The petitioner was working as the Protector of<\/p>\n<p>Emigrants,   in   the   office   at   Thiruvananthapuram.     He<\/p>\n<p>joined the station, on September, 2005.<\/p>\n<p>      2.     The   prosecution   allegation   is   that   the<\/p>\n<p>petitioner,     as   part   of   the   conspiracy   hatched   by   himself<\/p>\n<p>with   seven   travel   agents   of   the   area,   had   cleared   the<\/p>\n<p>emigration   of   many   travellers   to   foreign   countries,   who<\/p>\n<p>had   forged   or   fake   documents;   like   passports,   visa   and<\/p>\n<p>other   travel   documents.     Further   allegation   is   that   the<\/p>\n<p>petitioner had collected  bribe from different travel agents<\/p>\n<p>and   therefore,   his   daily   illegal   collections   surged   to     Rs.<\/p>\n<p>30,000\/- to Rs. 40,000\/- per day.  It is also alleged that the<\/p>\n<p>petitioner   had   opened   an   account   in   HSBC   Bank,<\/p>\n<p>Thiruvananthapuram,   and   deposited   an   amount   of<\/p>\n<p>Rs.11.69   lakhs   between   January   2006   to   April   2006.<\/p>\n<p>When   the   investigation   started,   and   his   premises   in<\/p>\n<p>B.A.5370\/2006<\/p>\n<p><span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>Thiruvananthapuram            and      Vishakhapatanam            were<\/p>\n<p>searched,   he had transferred the said amount,     in the<\/p>\n<p>name   of   one   Salahudin,   another   travel   agent   at<\/p>\n<p>Thiruvananthapuram.     Salahudin     withdrew   the   above<\/p>\n<p>amount,  and deposited  in the account of Surya Rao,  the<\/p>\n<p>account   being   opened     in   an   abridged   name   of   the<\/p>\n<p>petitioner,  in   HSBC Bank.\n<\/p>\n<\/p>\n<p>       3.    The   learned   Standing   counsel   for   the   CBI,<\/p>\n<p>S.Sreekumar,   gave   various   details   of   the     amount<\/p>\n<p>deposited by the petitioner, in his account.   The counsel<\/p>\n<p>therefore,   prayed   that   the   interrogation                of   the<\/p>\n<p>petitioner, in custody,  is necessary.<\/p>\n<p>      4.     The   learned   counsel   Mr.S.Rajeev   had<\/p>\n<p>submitted   that   the   petitioner   had   already   been<\/p>\n<p>interrogated   on   more   than   one   occasion   and   therefore,<\/p>\n<p>further custodial interrogation may not be required.  The<\/p>\n<p>counsel   further   submitted   that   the   petitioner   would<\/p>\n<p>always be available for interrogation and it is because of<\/p>\n<p>the   unscientific   approach   of   the   CBI,     that   he   was   not<\/p>\n<p>able   to   face   them   as   a   free   citizen   and   divulge   every<\/p>\n<p>B.A.5370\/2006<\/p>\n<p><span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>information   in   his     knowledge,   so   that   his   innocence<\/p>\n<p>could  be established.\n<\/p>\n<\/p>\n<p>      5.    After   hearing   both   sides   and   considering   the<\/p>\n<p>materials   that   are   placed   before   me,   I   direct   the<\/p>\n<p>petitioner,   P.V.Surya   Rao,   the   former   Protector   of<\/p>\n<p>Emigrants,   who   is     now   on   suspension,   to   surrender<\/p>\n<p>before   the   Investigating   Officer,   Kochi,   in   crime<\/p>\n<p>No.R.C.13(A)\/2006   of   SPE\/CBI\/Kochi   on   12.9.2006<\/p>\n<p>between   10.00   a.m   and   10.30   a.m.,   as   the   CBI   is<\/p>\n<p>investigating the offence alleged against him and others,<\/p>\n<p>for the offence punishable under Sections 420, 468, 471<\/p>\n<p>and 120B IPC and  also  under  Sections   13(2)  read  with<\/p>\n<p>Section   13(1)(d)   of   the     Prevention   of   Corruption   Act,<\/p>\n<p>1988.\n<\/p>\n<\/p>\n<p>      6.    The Investigating Officer shall interrogate the<\/p>\n<p>petitioner and thereafter, produce him before the Court<\/p>\n<p>below, as per the law.\n<\/p>\n<\/p>\n<p>      7.
