Consequently, he has been detained in Sub-Jail,<br \/>\nMorbi.\n<\/p>\n<p>3.\tFrom<br \/>\nthe grounds of detention, it appears that two offences have been<br \/>\nregistered against the petitioner ?  detenue : one at Vatva Police<br \/>\nStation being I-CR No.77 of 2006 and the other one at Sola High Court<br \/>\nPolice Station being I-CR No.240 of 2006  and under Sections 454,<br \/>\n457, 380, and 114 of Indian Penal Code wherein it is alleged that the<br \/>\npetitioner is engaged in the illegal activity of theft of Gold<br \/>\nornaments and cash.   On the basis of the registration of these<br \/>\ncases, the detaining authority after recording the subjective<br \/>\nsatisfaction, has come to the conclusion that the  present detenue&#8217;s<br \/>\naforesaid activities are prejudicial to maintenance of &#8216;public order&#8217;<br \/>\nand ultimately passed the impugned order of detention against him<br \/>\nbranding him as a ?SDangerous Person??.\n<\/p>\n<p>4.\tExcept<br \/>\nfew statements of anonymous witnesses, there is no material on record<br \/>\nwhich shows that the petitioner-detenue is carrying on illegal<br \/>\nactivities of theft which is harmful to the health of the public.  In<br \/>\nthe case of  Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai Solanki v. Police<br \/>\nCommissioner, Surat<\/a> [(2001 (1) GLH 393)], having considered<br \/>\nthe decision of the Hon&#8217;ble Apex Court in the case of  Ram<br \/>\nManohar Lohia v. State of Bihar (AIR 1966 SC 740), this Court<br \/>\nheld that the cases wherein the detention orders are passed on the<br \/>\nbasis of the statements of such witnesses fall under the maintenance<br \/>\nof &#8216;Law and Order&#8217; and not &#8216;Public Order&#8217;.\n<\/p>\n<p>5.\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention of a detenue, the detaining authority must come to<br \/>\na definite finding that there is threat to the &#8216;Public Order&#8217; and it<br \/>\nis very clear that the present case would not fall within the<br \/>\ncategory of threat to &#8216;public order&#8217;. In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds, for passing the said<br \/>\norder, cannot be sustained and, therefore, it deserves to be quashed<br \/>\nand set aside.\n<\/p>\n<p>6.\tIn<br \/>\nthe result, this Special Civil Application is allowed. The impugned<br \/>\norder of detention dated 19.3.2008 passed by the Police Commissioner,<br \/>\nAhmedabad City is hereby quashed and set aside. The detenue is<br \/>\nordered to be set at liberty forthwith, if not required in any other<br \/>\ncase. Rule is made absolute accordingly.
