MOHTA, J.\n<\/pre>\n<p>                                                                 th<br \/>\n                                             DATE       :  20  November, 2009.<\/p>\n<pre>\n    \n\n\n\n    ORAL JUDGMENT\n\n    1               Heard finally.\n\n\n\n\n\n    2               The   petitioners   have   invoked   Section   34   of   the   Arbitration \n\n<\/pre>\n<p>    and   Conciliation   Act,   1996   (for   short,   the   Arbitration   Act)   thereby, <\/p>\n<p>    challenged the award whereby, the learned Arbitral Tribunal has granted <\/p>\n<p>    partially   three   claims   i.e.   claim   Nos.   1,   2   and   8   out   of   10   claims   and <\/p>\n<p>    thereby rejected all other claims.<\/p>\n<pre>\n\n\n\n    3               So far as, the submissions with regard to no claim certificate \n\n\n\n\n<span class=\"hidden_text\">                                                                      ::: Downloaded on - 09\/06\/2013 15:19:38 :::<\/span>\n     ndm\n                                              2                                     arbp.545.09.sxw\n\n\n\n\n                                                                                     \n<\/pre>\n<p>    based upon clause 65 of the contract condition, the learned Arbitrator <\/p>\n<p>    after going through the material, as well as, the documents on record, <\/p>\n<p>    has dealt with in detail and rejected the case of the Petitioners for want of <\/p>\n<p>    substantial material to support their case.   The reasoning so given just <\/p>\n<p>    cannot   be   said   to   be   perverse   and   especially   as   it   is   based   upon <\/p>\n<p>    condition of the Contract and the facts and specially when it is based <\/p>\n<p>    upon the judgment of the Apex Court reported in 2008(3) Arbitration LR <\/p>\n<p>    633   (SC)   National   Insurance   Co.   V\/s   Boghara   Polyfab   Pvt.   Ltd., <\/p>\n<p>    whereby  it  has  been held  that the the claim  can be raised even after <\/p>\n<p>    signing the &#8220;No claim certificate&#8221; and\/or &#8220;No further claim&#8221;.  The claim so <\/p>\n<p>    raised after signing of the final bills is distinguished as per the conditions <\/p>\n<p>    in question and hence, is arbitrable as per the principle of equity and fair <\/p>\n<p>    justice.  The submission that, no such claim was raised \/ agitated, on or <\/p>\n<p>    before   the   Officer,   in   the   present   facts   and   circumstances,   is <\/p>\n<p>    unacceptable.\n<\/p>\n<p>    4             With regard to claim Nos. 1, 2 and 8, the submission is that <\/p>\n<p>    the figures, so refers, have no details about the calculations.  The party, <\/p>\n<p>    when moved a claim petition before the Arbitrator, has material to support <\/p>\n<p>    the  claim with figures.    The  Arbitrator  finds  that  the party  has  a case <\/p>\n<p>    based   upon   the   material   and   calculations   available   on   record   and <\/p>\n<p>    accordingly,   accepted   the   same   partially,   and   awarded   the   amount. <\/p>\n<pre>\n\n\n\n\n<span class=\"hidden_text\">                                                             ::: Downloaded on - 09\/06\/2013 15:19:38 :::<\/span>\n     ndm\n                                                  3                                       arbp.545.09.sxw\n\n\n\n\n                                                                                           \n    There   is   no   case   of   want   of   supporting   document   of   bills.     Even \n\n<\/pre>\n<p>    otherwise,   it   is   difficult   to   accept   that   the   claim   of   the   Petitioners   is <\/p>\n<p>    contrary   to   law   and   the   record   for   want   of   contra   material   on   record, <\/p>\n<p>    specially when the submission is only with regard to details of amount so <\/p>\n<p>    awarded.  The Court need to see the award in totality.  Some lacuna or <\/p>\n<p>    lack   of   details   that   itself,   in   the   present   case,   can   not   be   reason   to <\/p>\n<p>    interfere with the award.  It can not be treated as unreasoned award.\n<\/p>\n<p>    5               With   regard   to   interest,   the   Arbitrator   has   awarded   the <\/p>\n<p>                        st<br \/>\n    interest from 01  August, 2001 @ 11% per annum.  The learned counsel <\/p>\n<p>    appearing for the Petitioners conceded to the date of completion of the <\/p>\n<p>    work.   The final bill needs to be submitted within three months and for <\/p>\n<p>    passing after due verification requires six months more.  Therefore, I am<br \/>\n                                                                                              st<br \/>\n    inclined to restrict the interest, on the amount so awarded, from 01  May,<br \/>\n                             st<br \/>\n    2002 instead of 01  August, 2001.  Considering the fact that it is a work <\/p>\n<p>    contract \/ construction contract, the rate of interest restricted @ 9% per<br \/>\n                                                              st<br \/>\n    annum instead of @11% per annum from 01  May, 2002.\n<\/p>\n<p>    6               The learned counsel appearing for the Petitioners has relied<br \/>\n                                  th<br \/>\n    on the order dated 04   September, 2006, passed in Arbitration Petition <\/p>\n<p>    No. 200 of 2006 between the same parties.  It was admittedly, of some <\/p>\n<p>    different contract.  The Court cannot overlook the factual reasoning given <\/p>\n<p><span class=\"hidden_text\">                                                                   ::: Downloaded on &#8211; 09\/06\/2013 15:19:38 :::<\/span><br \/>\n     ndm<br \/>\n                                             4                                    arbp.545.09.sxw<\/p>\n<p>    by   the   learned   Arbitrator   considering   the   material   and   documents   on <\/p>\n<p>    record.  Therefore, also this order is of no assistance to the Petitioners.\n<\/p>\n<p>    7             Resultantly, the petition is partly allowed and the impugned <\/p>\n<p>    award is modified to the above extent, as recorded.  The rest of the award <\/p>\n<p>    is maintained.  There was no other challenge raised.\n<\/p>\n<p><span class=\"hidden_text\">    8<\/span><\/p>\n<p>                  The Petition is accordingly partly allowed, with no order as to <\/p>\n<p>    costs.\n<\/p>\n<p>    9             Learned counsel appearing for the Petitioners is seeking stay <\/p>\n<p>    of this order.
