Justice V.GIRI\n\n Dated :16\/01\/2008\n\n O R D E R\n                               V.GIRI, J\n\n                             -------------------\n\n                         W.P.(C).1889\/2008\n\n                            --------------------\n\n           Dated this  the  16th  day of January, 2008\n\n\n                             JUDGMENT\n<\/pre>\n<p>      There   is   a   dispute     as   to   whether     the   amount<\/p>\n<p>received     by   the   petitioner,   a   member   of   the   scheduled<\/p>\n<p>caste,  under the Indira Avaz  Yojana,  for construction of a<\/p>\n<p>building   in her own land,     is a grant   or a subsidy   or a<\/p>\n<p>loan.     The   averments   made     in   the   writ   petition,     reveal<\/p>\n<p>acute   penury  when the   petitioner is not in a position to<\/p>\n<p>even   complete   the   construction.     But   in   the   meanwhile,<\/p>\n<p>steps have been taken to recover an amount of Rs.30,002\/-\n<\/p>\n<p>from  the   petitioner   as  evidenced  by   Ext.P1   issued   by   the<\/p>\n<p>Block     Development   Officer.     Thereafter,       it   has   been<\/p>\n<p>followed  by  proceedings under the Revenue Recovery Act<\/p>\n<p>as evidenced by Ext.P2.\n<\/p>\n<p>2.    After   having   heard   the   learned   counsel   for   the<\/p>\n<p>petitioner and the   learned  senior  Government  Pleader,   I<\/p>\n<p>am of the view that the petitioner&#8217;s grievance  ought to be<\/p>\n<p>considered by the  Government in the first instance.\n<\/p>\n<p>W.P.(C).1889\/2008<\/p>\n<p><span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>3.      In   the   result,     writ   petition   is   disposed   of   in   the<\/p>\n<p>following terms:-\n<\/p>\n<p>4.      Petitioner   may   prefer   a   detailed   representation<\/p>\n<p>before the first  respondent within one month from today<\/p>\n<p>indicating   her   contention     as   to   whether   the   amount<\/p>\n<p>disbursed   to   her     was   either   a   loan     or   a   grant   or   a<\/p>\n<p>subsidy.     On   receipt   of   such   representation     first<\/p>\n<p>respondent shall conduct  necessary  enquiries   and take<\/p>\n<p>appropriate decision thereon within six months from the<\/p>\n<p>date of receipt of representation.  All further proceedings<\/p>\n<p>pursuant     to   Ext.P2     shall   be   kept   in   abeyance     till   the<\/p>\n<p>Government             takes   a   decision            in   the   manner<\/p>\n<p>aforementioned.
