The<br \/>\ndescription of which is to be found on the said agreement. During the<br \/>\ncourse of execution of such works, dispute arose between the parties.<br \/>\nIt is the case of the petitioner that it had discharged its<br \/>\nobligations under the agreement. Delay in execution of the work, if<br \/>\nany, was on account of foundation work which is beyond its control<br \/>\nand attributable to the respondent in carrying out its obligations<br \/>\nagainst the agreements. Despite this, the respondent did not release<br \/>\nthe payment for the work done. The petitioner Company, therefore,<br \/>\nissued a notice dated 12.2.2010 and demanded the respondent Company<br \/>\nto settle the disputes within 30 days, failing which, the petitioner<br \/>\nmay seek reference to an Arbitrator. It is the case of the petitioner<br \/>\nthat no reply was received to such a notice. The petitioner Company,<br \/>\ntherefore, issued another notice dated 7.6.2010 calling upon the<br \/>\nrespondent Company to agree to one of the three names suggested to be<br \/>\nappointed as sole Arbitrator, failing which, it would move the High<br \/>\nCourt for appointment of an Arbitrator.\n<\/p>\n<p>3.\tIt<br \/>\nis not in dispute that the agreement between the parties contained an<br \/>\narbitration clause which reads as under :-\n<\/p>\n<p>  Arbitration<br \/>\n: Any dispute or difference<br \/>\narising out of contract shall be settled amicably by mutual<br \/>\ndiscussion and negotiation. If that fails, such disputes or<br \/>\ndifferences shall be settled as per provisions of Indian Arbitration<br \/>\nAct, 1940 (X of 1940). The venue of such arbitration will be INDORE<br \/>\ncity.\n<\/p>\n<p>4.\tThe<br \/>\nrespondent Company does not dispute having received notices from the<br \/>\npetitioner. Counsel, however, submitted that the P.F. department has<br \/>\nissued a prohibitory order preventing the Company from making any<br \/>\npayment.\n<\/p>\n<p>5.\tAt<br \/>\nthis stage, I am only concerned with the appointment of an<br \/>\nArbitrator. What defences that the respondent Company may raise<br \/>\nbefore the Arbitrator is not the subject matter of consideration in<br \/>\nthis application. When I find that there is a clear arbitration<br \/>\nclause between the parties and when the petitioner had issued a<br \/>\nnotice calling upon the respondent to appoint an Arbitrator in terms<br \/>\nof the said agreement and within the time indicated, the respondent<br \/>\ndid not conquer with any of the names suggested, in terms of Section<br \/>\n11 of the Arbitration and Conciliation Act, 1996, this is a fit case<br \/>\nwhere power should be exercised for appointment of an Arbitrator.\n<\/p>\n<p>6.\tIn<br \/>\nthe result, Hon&#8217;ble Mr. Justice C.K. Buch (Retd.) is appointed as a<br \/>\nsole Arbitrator to resolve all disputes between the parties arise out<br \/>\nof the agreement arises dated 21.2.2008.
