Commission<br \/>\nconducted the hearing from its New Delhi office.\n<\/p>\n<p>2.   Appellant, through his RTI-application dated 20.02.2009, made a<br \/>\nrequest for the following information:-\n<\/p>\n<blockquote><p>     &#8220;Ref:- Letter No.Nil Dated 28.01.2009 issued by Joint Registrar,<br \/>\n     CIC (Copy enclosed) [sic] regarding safety and security of<br \/>\n     Md.Muzibur Rahman as follows:-\n<\/p><\/blockquote>\n<blockquote><p>     1.     Kindly provide me ATR on above reference letter with file<br \/>\n            noting.\n<\/p><\/blockquote>\n<blockquote><p>     2.     Date of receipt of above letter in SECL (HQ).\n<\/p><\/blockquote>\n<blockquote><p>     3.     Certified copy of comments given by Shri R.S. Singh,<br \/>\n            Director (P) &amp; CMD, SECL (HQ) on above letter.\n<\/p><\/blockquote>\n<blockquote><p>     4.     Certified copies of reply to the CIC by SECL, and other<br \/>\n            department on above letter.\n<\/p><\/blockquote>\n<blockquote><p>     5.     No. of security guards \/ gunman.\n<\/p><\/blockquote>\n<blockquote><p>     6.     If no action has been taken within 15 days of the issue of<br \/>\n            above letter on above matter kindly provide me name and<br \/>\n            designation of responsible officials and public authority.\n<\/p><\/blockquote>\n<blockquote><p>     7.     Copies of Rules \/ Circulars of penalty \/ action on violation<br \/>\n            of Govt. Order \/ Direction.\n<\/p><\/blockquote>\n<blockquote><p>     8.     If unfortunate incident happen on me and my family then<br \/>\n            kindly provide me name &amp; designation of responsible<br \/>\n            officials.&#8221;\n<\/p><\/blockquote>\n<p>3.   Replies were furnished to the appellant through CPIO&#8217;s<br \/>\ncommunication dated 10.03.2009 and the decision of the Appellate<br \/>\nAuthority dated 03\/06.03.2009.\n<\/p>\n<p>AT-31072009-16.doc<br \/>\n<span class=\"hidden_text\">                                                             Page 1 of 3<\/span>\n<\/p>\n<p> 4.     At the beginning of the hearing, appellant stated that presently<br \/>\nhis second-appeal was limited to receiving copies of file-notings and<br \/>\ncertified copies of the disclosed documents including file-notings.\n<\/p>\n<p>5.     Respondents pointed out that appellant was contradicting himself<br \/>\nas he, having said earlier that replies to the queries at Sl.Nos.1, 3, 4, 5,<br \/>\n6, 7, 8 were not provided to him, now states that only file-notings and<br \/>\ncertified copies were not provided to him. Respondents wanted the<br \/>\nCommission to note the attitude of the appellant.\n<\/p>\n<p>6.    Appellant stated that the information he had requested through<br \/>\nhis RTI-application related to his personal safety and security and,<br \/>\ntherefore, ought to have been provided to him within 48 hours under<br \/>\nthe proviso to Section 7(1) of the RTI Act. He requested Commission to<br \/>\ndraw up proceedings against the respondents for their failure to do so.\n<\/p>\n<p>7.     On the main plea of the appellant in the second-appeal \u23af now<br \/>\nlimited to disclosure of file-notings in the subject-file and certified<br \/>\ncopies of the documents disclosed \u23af CPIO pointed out that there was<br \/>\nno file-notings, as file-notings are ordinarily understood, in respect of<br \/>\nthe subject mentioned and the documents cited by the appellant. The<br \/>\ncorrespondence was received by the CMD, SECL from the CIC, on which<br \/>\nthe CMD made certain remarks and transmitted the document to the<br \/>\nDirector (Personnel) for action at his end.\n<\/p>\n<p>8.    Respondents stated that they had no objection to providing to the<br \/>\nappellant a copy of the letter from the Central Information Commission<br \/>\nwith the observations of the CMD, SECL recorded thereon.\n<\/p>\n<p>9.    As regards certified copies of the documents, CPIO stated that<br \/>\nthese were supplied to the appellant along with his reply as Annexes.<br \/>\nAppellant countered saying that he did not receive the Annexes.\n<\/p>\n<p>10. It is accordingly directed that CPIO, within two weeks of the<br \/>\nreceipt of this order, will provide to the appellant copies of the above-<br \/>\nmentioned record as well as certified copies of the requested<br \/>\ndocuments after collecting from the appellant requisite fees for<br \/>\ncertified copies as per Section 76 of the Indian Evidence Act read with<br \/>\nthe RTI Act.\n<\/p>\n<p>11.   Appeal disposed of with these directions.\n<\/p>\n<p>AT-31072009-16.doc<br \/>\n<span class=\"hidden_text\">                                                                Page 2 of 3<\/span><br \/>\n Complaint<\/p>\n<p>12. Appellant has raised a complaint against the CPIO for failure to<br \/>\nprovide to him the requested information within 48 hours as it<br \/>\nconcerned appellant&#8217;s life and personal safety.\n<\/p>\n<p>13. CPIO stated that contrary to what appellant thought about the<br \/>\nrequested information, in the understanding of the public authority, it<br \/>\nwas not about life, safety and liberty of the appellant as the<br \/>\ncorrespondence between two public authorities about whether or not to<br \/>\ntake any action to provide security to a petitioner, as demanded by him<br \/>\non account of alleged threat to his life \u23af itself could not be a matter of<br \/>\nlife and liberty of such person. These concerns were unilaterally raised<br \/>\nby appellant and needed to be examined under the Rules by the public<br \/>\nauthority. It was, therefore, incorrect for him to claim that it was a<br \/>\nmatter of his life and personal liberty. Demand for provision of security<br \/>\nby an employee of the public authority alone would not mean that the<br \/>\ndemand would be accepted as it was needed to be critically reviewed<br \/>\nunder the Rules and guidelines.\n<\/p>\n<p>14. I find that in spite of appellant making the claim that the matters<br \/>\nin his RTI-application related to his life and personal safety, there is<br \/>\nsubstance in the respondents&#8217; plea that any claim by an appellant about<br \/>\nsafety of his life did not automatically transform the request to be one<br \/>\nof life and liberty under Section 7(1) of the RTI Act. All requests for<br \/>\nsuch security by employees of a public authority need to be examined<br \/>\nby the public authority as to whether the security demanded by the<br \/>\npetitioners at-all needed to be provided. This is not a process that<br \/>\ncould be completed within 48 hours regardless of the concerns of the<br \/>\napplicant.\n<\/p>\n<p>15. I, therefore, hold that respondents were right in treating this<br \/>\napplication as one within Section 7(1) and not under the proviso to<br \/>\nSection 7(1) of the RTI Act.\n<\/p>\n<p>16.   As such, there shall be no complaint proceeding in this regard.\n<\/p>\n<p>17.
