\nhave heard Mr N V Anjaria, learned counsel for the appellant and Mr B
\nP Gupta, learned counsel for the respondent.  Mr Anjaria has very
\nfairly informed the court that the appellant Municipality has taken
\ndecision not to retire any employee compulsorily in future on the
\nground that it will cause financial burden on the Municipality.  Mr
\nAnjaria, learned counsel requests that since the respondent has
\nalready retired, this appeal may be dismissed as having become
\ninfructuous but this order shall not be treated as precedent.  We
\naccept the request of Mr Anjaria and dismiss the appeal as having
\nbecome infructuous.  This order shall not be treated as precedent.\n<\/p>\n
