A short question that arises for consideration    <\/p>\n
is:\n<\/p>\n
Whether the Famiiy Court .’
\nallowing the Petition in o  Nae; 75.\/zoos-[__=–v.
\nand directing the appe11ant–i:no\u00abtheru to give: the V
\ncustody of the ward   Ashtiyin\ufb01umarvvto <\/p>\n
the custody of the .respondentr.lfa\u00a7Lhet’cv?f,   _<\/p>\n
2. Our answef point  in the negative for the<\/p>\n
following reasons: .\n<\/p>\n
Learned Counsel’ fof  Va{\u00a7:pe.1i’ant–mother submits that after
\ndissolution of. mariciagve,’ the i”es15ondent was given visiting rights,
\nbut iater onathe respondentgot married for the second time and<\/p>\n
the    to go and therefore the appellant did not<\/p>\n
 the boy  her W111 to the respondent–father. On that<\/p>\n
“score;-\u00bb.the respondent filed a Petition in G 8: W C No.17\/6\/2006<\/p>\n
 hand  Court, without taking into consideration the Welfare of<\/p>\n
H  and the circumstances under which the ward refused to<\/p>\n
L<\/p>\n
go, as per the earlier visiting arrangement, the trial Court has<\/p>\n
mechanically allowed the Petition.\n<\/p>\n
On the other hand, learned Counsel for the  _<\/p>\n
submits that as the boy was not sent as per it <\/p>\n
given earlier, the respondent–father filed :aa _.lPeti.tion”-  it<\/p>\n
custodian of the minor ward andVgtln_.e trial_
\nconsideration all the materials place:d~.Vl’Von. rightly
\nallowed the Petition directing  ..to.v.dl’\u00a7ive theldiciistody of
\nthe child with visiting Arightsvgtoihthe  there is no<\/p>\n
illegality or in\ufb01rmity”   reds or_der\u00a7”l.’ ” <\/p>\n
The learned Judgegof formulated a point <\/p>\n
  lwhetheiathe petitionepfather had made
\n   slufficient lllll “ground to appoint him as
\n   the minor child K P Ashwin
\n“.iiamat  so, whether the petition was<\/p>\n
rriairitainable :2<\/p>\n
  formulated for consideration by the Family Court<\/p>\n
.. regarding appointment of a guardian of the minor child.<\/p>\n
L<\/p>\n
Since the father is a natural guardian, the question of appointing<\/p>\n
father as a guardian does not arise. The marriage of the appellant<\/p>\n
with the respondent has been dissolved by mutual coniseiitl,’ _<\/p>\n
trial court has not gone into the question asmto whet1’1erifthere was ”<\/p>\n
any need for change of custody of the wardfrornlrno”ther.lto lfathelrhvs f<\/p>\n
On our request, the boy was produced befo_re’lus’:\u00a7and we<\/p>\n
enquired with the boy in–carne1*a..”Tl1e{l\u00a7boy yoategorieallyvsaild that he
\nis willing to go to the respondenthjiatiierilorieehl jviifvo months. He
\nalso stated that he  land  living with his
\nmother. As on  v’:ablo’s\u00a7it’l ll years 1 month 18
\ndays. Welfare of    sole criteria for giving
\ncustody of thelchildl.  has not made out any good<\/p>\n
ground toydisturl)’ hcustodly of the ward. Therefore, the<\/p>\n
ifnypugned”‘*ordei1* calls for interference by this Court.<\/p>\n
3.’ \u00bb.Iylearnedi’:*.yClounsel for the appellant submits that the<\/p>\n
“–\u00abl’fte’.splondent ”  agreed to pay Rs.500\/- per month as<\/p>\n
 but since January 2006 upto date’ (August 2009),<\/p>\n
 Comes to Rs.22,000\/ -, has not been paid yet.<\/p>\n

4. Learned counsel for the respondent submits that since<\/p>\n
visiting rights were not given, as agreed upon, he has not paidithe<\/p>\n
maintenance amount of Rs.500\/~ per month from January’ it <\/p>\n
5. The marriage of the appellant  <\/p>\n
dissolved by mutual consent and the.4_appe1lant, who–“–lis.v’worl{in”gi<\/p>\n
and earning, has not sought for any rnain*tenanee._for–l1erself: The
\ncontention of the learned Coiinsel _for_ respondent “that the
\nappellant has not filed any applicationseeki_ng”n*\u00a7ain.tenance is not<\/p>\n
a good ground to deiiyllsuch e.  in  of the minor<\/p>\n
