Admit.\n<\/p>\n<p>                                These appeals have been preferred by the<br \/>\n                   State of Bihar under Clause 10 of the Letters Patent<br \/>\n                   against the common judgment and order dated 8th<br \/>\n                   January 2010 passed by the learned single Judge in a<br \/>\n                   group of writ petitions. The learned single Judge has<br \/>\n                   directed to renew the quarry lease earlier awarded to the<br \/>\n                   writ petitioner Gammon India Limited. The learned<br \/>\n                   single Judge was of the opinion that refusal to renew the<br \/>\n                   lease which had expired on 16th October 2007 was not<br \/>\n                   justified.\n<\/p>\n<p>                                Since the date of the impugned order the<br \/>\n                   Government of Bihar has amended the Bihar Minor<br \/>\n                   mineral Concession Rules, 1972 to impose a complete<br \/>\n                   ban on mining of stone under the amended Rule 53.<br \/>\n                   Nevertheless, the State of Bihar has reserved power to<br \/>\n                   grant such lease in public interest if it is satisfied, &#8220;that<br \/>\n                   quarrying or mining of stone may not adversely affect<br \/>\n                   ecology and environment and further there is<br \/>\n                   requirement of stone for public use&#8221;.\n<\/p>\n<p>                                We are informed that the mining lease given<br \/>\n                   to the writ petitioner was confined to captive use, i.e. the<br \/>\n                   writ petitioner was supposed to utilize the stone quarried<br \/>\n                   by it for the purpose of laying or maintaining the roads.<br \/>\n                   In our opinion, the ends of justice will be met if we,<br \/>\n                   without entering into the larger issue whether the<br \/>\n                   restriction imposed under the amended Rule will apply to<br \/>\n                   the cases like the petitioner&#8217;s, direct the State<br \/>\n<span class=\"hidden_text\">                          -3-<\/span><\/p>\n<p>          Government to consider to relax the restriction, if it is of<br \/>\n          the opinion that construction and maintenance of roads in<br \/>\n          the State of Bihar is in public interest and for public use<br \/>\n          and that the writ petitioner utilizes stone quarried by it<br \/>\n          for that purpose alone and none other.\n<\/p>\n<p>                      In the above circumstances, pending the<br \/>\n          appeal, we direct the District Magistrate, Gaya to<br \/>\n          forward the applications for renewal of lease made by<br \/>\n          the writ petitioner, which are subject matter of the<br \/>\n          present litigation, to the Principal Secretary, Department<br \/>\n          of Mining and Geology, Government of Bihar, Patna<br \/>\n          within three weeks from today. The Principal Secretary,<br \/>\n          Department of Mining and Geology will consider the<br \/>\n          applications in the light of the observations made by the<br \/>\n          learned single Judge and the above referred amended<br \/>\n          Rule 53 of the Rules and complete the exercise and make<br \/>\n          the necessary order within three months from today.\n<\/p>\n<p>                      The order will be placed on the record of this<br \/>\n          Appeal. Stand over to 11th March 2011.\n<\/p>\n<p>                      Copy of this order be given to both the<br \/>\n          learned Advocates.\n<\/p>\n<p>                               (R.M.
