Advocate\n\nHon'ble Imtiyaz Murtaza,J.\n<\/pre>\n<p>Hon&#8217;ble Shri Kant Tripathi,J.\n<\/p>\n<p>Heard learned counsel for the petitioners and also learned A.G.A. appearing<br \/>\nfor the State.\n<\/p>\n<p>The argument substantially is that fraught relation emanating from<br \/>\nmatrimonial bickering escalated into launching of criminal proceeding vide<br \/>\nF.I.R. which was registered at case crime No. 73 of 2009 under sections 498-<br \/>\nA, 323, 504 and 506 IPC and section \u00be of Dowry Prohibition Act, P.S.<br \/>\nMahila Thana, District Rampur.\n<\/p>\n<p>Having considered the arguments advanced across the bar, we have a feeling<br \/>\nthat Court owes a duty to the society to strain to the utmost to repair the<br \/>\nfrayed relations between the parties so that the wounded situation may be<br \/>\nhealed into a healthy rapprochement. The matter in hand also appears to be<br \/>\none of those cases in which reconciliation should be tried between the<br \/>\ndisputing parties.\n<\/p>\n<p>While referring the matter to Mediation Centre with the consent of the<br \/>\npetitioners, it is directed that Petitioner No. 1 shall deposit a sum of Rs. 5000\/-<br \/>\nwith the Mediation Centre by way of Bank draft drawn in favour of Opp party<br \/>\nno. 4. The Bank draft aforesaid, it is further directed, shall be handed over to<br \/>\nthe Opp party No. 4 on her appearing before the Mediation Centre on the date<br \/>\nfixed. The amount aforesaid, it may be clarified, are meant to meet expenses<br \/>\nto be incurred for attending mediation sessions at Allahabad for the Opp.<br \/>\nParty no. 4 and the person escorting her.\n<\/p>\n<p>The office upon deposit of the Bank draft shall issue notice within one week<br \/>\nto respondent no. 4, i.e the wife calling upon her to appear in the Mediation<br \/>\nCentre at Allahabad High Court on a date to be indicated in the said notice<br \/>\nstating therein that the Bank draft deposited by the petitioner shall be<br \/>\ndelivered to her whenever she appears in the Mediation centre on the date<br \/>\nfixed. The said notice shall be served upon the respondent no. 4 through<br \/>\nC.J.M concerned. It needs hardly be said that both the parties shall appear<br \/>\neither on the date fixed or on a future date as may be agreed before the<br \/>\nMediation Centre for reconciliation.\n<\/p>\n<p>The centre shall submit a report within one month from the date of parties<br \/>\nappearing before it for reconciliation. The case shall be listed in the first week<br \/>\nof March, 2010 alongwith report of Mediation Centre.<br \/>\nIn the meanwhile, the arrest of the petitioners in the aforesaid case shall<br \/>\nremain stayed.\n<\/p>\n<p>It may made clear that in case, there occurs default by the husband either in<br \/>\ndepositing the amount or in appearing before the Mediation Centre on the date<br \/>\nor dates fixed, the interim order staying arrest shall cease to be operative and<br \/>\nthe Mediation Centre shall immediately communicate with the office which in<br \/>\nturn shall list the case within a week before the Bench concerned for passing<br \/>\nappropriate order in the matter.\n<\/p>\n<p> It may be clarified that the case will not be treated as tied up to this Bench<br \/>\nshall be listed before the appropriate Bench.\n<\/p>\n<p>Copy of this order will not be issued unless steps are taken.<br \/>\nOrder Date :- 4.1.2010<br \/>\nRKSh\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Ghulam Fareed And Others vs State Of U.P.
