1.\tHeard
\nlearned advocate Mr. Premal S. Rachh appearing on behalf of
\napplicant.\n<\/p>\n
2.\tThe
\npresent application is filed by the wife with a prayer to transfer
\nthe proceedings of Hindu Marriage Petition No.31 of 2008 from the
\nCourt of 3rd Additional Senior Civil Judge, Valsad to the
\nCourt of Senior Civil Judge, Jamnagar in the interest of justice.\n<\/p>\n
3.\tThe
\nnotice initially issued by this Court is served to the respondent,
\nbut, no appearance is filed by respondent. Thereafter, rule is issued
\nby this Court which has been also served to the respondent, but, no
\nappearance is filed by the respondent. Therefore, today, this matter
\nis listed for final hearing. Accordingly, on being merits of learned
\nadvocate Mr. Rachh it has been taken for final hearing.\n<\/p>\n
4.\tConsidering
\nthe submissions made by learned advocate Mr. Rachh and averments made
\nin this application that Hindu Marriage Petition is filed by the
\nhusband being No.31 of 2008 being a direct reaction of earlier two
\nproceedings filed by the wife. One proceeding is filed by the wife
\nunder Section 125 of the Code of Criminal Procedure claiming the
\nmaintenance from the husband which was granted by the competent Court
\nin favour of wife and minor son. That order was challenged in
\nrevision by the husband. Even though, Revision Application No.140 of
\n2007 is also rejected by Sessions Court, Jamnagar. Thereafter, one
\napplication under Section 125(3) of Cr.P.C. is filed by the wife
\nagainst the husband for recovering the arrears of maintenance amount
\nand other relief before the J.M.,F.C. Court, Jamnagar which is
\npending. Meanwhile, aforesaid Hindu Marriage Petition was filed by
\nhusband.\n<\/p>\n
5.\tThe
\nrelevant averments are made in Para 2\/6 and Para 2\/7 which are quoted
\nas under :\n<\/p>\n
\u00fdS2\/6.\tThe
\napplicant humbly submits that in the divorce petition filed by
\nrespondent before Ld.Senior Civil Judge, Valsad, the applicant has to
\nengage an advocate to represent her case and also has to remain
\npersonally present at evidence stage. The applicant submits that for
\nengaging an advocate, the applicant submits that for engaging an
\nadvocates, the applicant has to spend huge amount towards fees and
\nsince the applicant has not received amount even by way of
\nmaintenance form her husband-respondent herein, the applicant finds
\nit very difficult to attend the matter at Valsad by engaging any
\nadvocate. It is relevant to note that applicant is put to great
\nhardships and is finding it very difficult to maintain and manage
\nseveral routine expenses including educational expenses of her minor
\nson. It is pertinent to note that applicant is the only daughter of
\nher parents and father of the applicant has expired way back in the
\nyear 1980. At present, in absence of any financial support from
\nrespondent, applicant is depended on mother of applicant who is
\nserving in Medical College, Jamnagar. But, even the mother of
\napplicant is finding it difficult to maintain applicant and minor son
\nas she is suffering from Cancer and other diseases due to old age.
\nAnnexed hereto and marked as Annexure ‘E’ is the copy of Certificate
\nissued by Doctor.\n<\/p>\n
2.7\t\tIt
\nis submitted that proceedings before civil Court, Valsad are at a
\nvery initial stage wherein notice is issued to the applicant making
\nit returnable on 16.05.2008. Since the applicant is facing great
\nfinancial hardships for the reasons as narrated above, it is very
\ndifficult for the applicant to attend the proceedings at Valsad by
\ntravelling all the way from Jamnagar.\u00fdS<\/p>\n
6.\tIn
\nview of aforesaid averments made in this application and considering
\nthe fact that no counter is filed by the respondent and also
\nconsidering the hardship which has been faced by the applicant \u00fd
\nwife and proceedings which has been initiated by the husband
\napparently just to harass the wife, so, wife may not press the
\napplication filed under Section 125(3) of the Code of Criminal
\nProcedure. So, Hindu Marriage Petition is nothing but just to harass
\nthe wife, respondent has filed proceedings against the wife at
\nValsad. Therefore, this Court is satisfied that prayer made by
\napplicant is genuine and when two proceedings were initiated by the
\nwife at Jamnagar and not objected by the husband to appear at
\nJamnagar, then, there is no other purpose to file the proceedings at
\nValsad except to cause inconvenience and harassment to the wife of
\nrespondent. Looking to the financial condition and minor son, it is
\nvery difficult for the applicant to attend the proceedings at Valsad
\nfrom Jamnagar for such a long distance. Therefore, in the interest of
\njustice, order is passed by this Court.\n<\/p>\n
7.\tAccordingly,
\nprayer made in this application in Para 6(B) is granted.\n<\/p>\n
8.\tThe
\nHindu Marriage Petition No.31 of 2008 is transferred from the Court
\nof 3rd Additional Senior Civil Judge, Valsad to the Court
\nof Senior Civil Judge, Jamnagar and it is directed to Senior Civil
\nJudge, Jamnagar to proceed with Hindu Marriage Petition No.31 of 2008
\nfrom the stage onwards at which the matter is pending before the
\nSenior Civil Judge, Valsad.\n<\/p>\n
9.\tAccordingly,
\nrule is made absolute with no order as to costs.\n<\/p>\n
10.\t\tDirect
\nservice is permitted.\n<\/p>\n
