Justice ANTONY DOMINIC\n\n Dated :13\/01\/2011\n\n O R D E R\n                        ANTONY DOMINIC, J.\n                      ================\n                   W.P.(C) NO. 32237 OF 2010\n                 =====================\n\n           Dated this the 13th day of January, 2011\n\n                          J U D G M E N T\n<\/pre>\n<p>      Petitioners are President and Vice President of the Parent<\/p>\n<p>Teachers&#8217;     Association,   Government       Boys    High    School,<\/p>\n<p>Tripunithura. In this writ petition, the relief that they are seeking<\/p>\n<p>is to direct the 3rd respondent, the Mahatma Gandhi University, to<\/p>\n<p>shift the University College of Teacher Education from the school<\/p>\n<p>campus to some other place in order to facilitate smooth<\/p>\n<p>functioning of the High School.\n<\/p>\n<p>      2.    Petitioners submit that when the Teachers Training<\/p>\n<p>Center was allotted, for want of other suitable premises,<\/p>\n<p>Government allowed the Training Center to be located in the<\/p>\n<p>school premises. Subsequently, on being satisfied that the school<\/p>\n<p>needed that area also for its smooth functioning, on 26\/3\/2008,<\/p>\n<p>Government issued Ext.P2 order according sanction for leasing 35<\/p>\n<p>cents of land on the northern boundary of Tripunithura High<\/p>\n<p>School adjacent to the existing Teachers Training Center for a<\/p>\n<p>period of 33 years, for constructing building for the Teacher<\/p>\n<p>Training Center, Tripunithura. Subsequently, there was no<\/p>\n<p>WPC No. 32237\/10<br \/>\n<span class=\"hidden_text\">                                 :2 :<\/span><\/p>\n<p>progress for construction of the Teacher Training Center or<\/p>\n<p>shifting the center from the existing place. Therefore petitioners<\/p>\n<p>made representations to various authorities evidenced by Ext.P3.<\/p>\n<p>Finally, by Ext.P5, the University informed them that, on<\/p>\n<p>completing the construction, they will shift out to the new<\/p>\n<p>premises and vacate from the school campus. By Ext.P6,<\/p>\n<p>University also sought permission of the Government to continue<\/p>\n<p>in the existing premises till University constructs its own building.<\/p>\n<p>Despite all the above, there was no progress in the matter and it<\/p>\n<p>is with that complaint the writ petition is filed seeking the reliefs<\/p>\n<p>mentioned above.\n<\/p>\n<p>      3.   On behalf of the 3rd respondent, a counter affidavit has<\/p>\n<p>been filed wherein after substantially admitting the facts stated<\/p>\n<p>by the petitioners, the main difficulty pointed out by the<\/p>\n<p>University is that the land which has been allotted on lease has<\/p>\n<p>not been so far demarcated. It is stated that, therefore, the<\/p>\n<p>University could not obtain building permit or commence<\/p>\n<p>construction of the Teacher Training Center. It is stated that for<\/p>\n<p>getting the land identified and demarcated, steps have been<\/p>\n<p>initiated with the co-operation of the school authorities and the<\/p>\n<p>WPC No. 32237\/10<br \/>\n<span class=\"hidden_text\">                                 :3 :<\/span><\/p>\n<p>Municipal Authorities.\n<\/p>\n<p>      4.    Thus the liability to shift out of the existing premises<\/p>\n<p>once the building is constructed in the land ordered to be leased<\/p>\n<p>out by the Government as per Ext.P2 order is an undisputed fact<\/p>\n<p>and the only difficulty that the University faces is that the land<\/p>\n<p>has not been identified and demarcated. Therefore, once that<\/p>\n<p>issue is solved, the University can proceed further, obtain building<\/p>\n<p>permit and start construction and once the construction is<\/p>\n<p>complete, they can shift out to the new premises. This stale mate<\/p>\n<p>can be sorted out if the University solicits the co-operation of the<\/p>\n<p>1st respondent through its revenue officials.<\/p>\n<p>      5.    Therefore, I direct that, on the production of a copy of<\/p>\n<p>this judgment, the 1st respondent will issue appropriate orders<\/p>\n<p>directing the revenue officials of the locality concerned to identify<\/p>\n<p>the land ordered to be leased out to the University as per Ext.P2<\/p>\n<p>and demarcate the same. This the 1st respondent shall ensure and<\/p>\n<p>complete, as expeditiously as possible, at any rate within 4 weeks<\/p>\n<p>of production of a copy of this judgment. It is directed that once<\/p>\n<p>the land is identified and demarcated as above, the University<\/p>\n<p>shall   obtain   building    permit,   commence     and    complete<\/p>\n<p>WPC No. 32237\/10<br \/>\n<span class=\"hidden_text\">                                 :4 :<\/span><\/p>\n<p>construction and thereafter shift out its Teachers Training Center<\/p>\n<p>to the new premises. This process shall be completed at any rate<\/p>\n<p>within one year thereafter.\n<\/p>\n<p>      6.
