\nNo.4390\/2007 on the file of VI Additional SCJ &
\nMember, MACT, Bangalore, SCCH–2, partly allowing the
\nclaim petition for compensation and seeking
\nenhancement of compensation. ” <\/p>\n
This appeal coming on for <\/p>\n
the Court, delivered the following: ‘<\/p>\n

2. For the sake of  are referred to<\/p>\n

3. Briefhfacts~_oi’.th’e.’-ease are:<\/p>\n
 gffiiat on”0-505.2007, when the claimant was<\/p>\n
  the left side of l00ft. road near<\/p>\n
 all of a sudden a BMTC bus bearing<\/p>\n
 regis,trTation No.KA–01–F\u00bb2356 came in a rash and<\/p>\n
if ‘wnegligent manner and dashed against the claimant, as<\/p>\n
 a result, he fell down and sustained grievous injuries.<\/p>\n
H5’<\/p>\n
Hence, he \ufb01led a claim petition before the IVLACT,
\nBangalore, seeking compensation of Rs.4,O0V,.0_O0\/~.<\/p>\n
The Tribunal by impugned judgment and <\/p>\n
awarded a total compensation of Rs.  <\/p>\n
after deducting 5% towards contributyory  on<\/p>\n
the part of the claimant has iawlarded <\/p>\n
with interest at 7% p.a. Aggrieved by_l_tl1e? of V<\/p>\n
compensation awarded byfthe: Tribunal the claimant is
\nin appeal seeking enhafic_eni_erlt o’f..eoi:;pensation.<\/p>\n
4. As the’refis’ no-_ dispute regarding occurrence of<\/p>\n
aeciderit, .negligenr:e”–a11d liability of the insurer of the<\/p>\n
offending  “point that remains for my
\nconsiderlation   is:\n<\/p>\n

 After\ufb01.-hearing the learned Counsel for the parties<\/p>\n
 and perusing the award of the Tribunal, I am of the<\/p>\n
 yievtf that the compensation awarded by the Tribunal is<\/p>\n

not just and proper, it is on the lower side and therefore<\/p>\n
it is deserved to be enhanced.\n<\/p>\n
6. As per wound certi\ufb01cate EX. P 3 the claimant has
\nsustained the following injuries:\n<\/p>\n
1) Degloving injury on left elbow;<\/p>\n
2} Corriminuted fracture to_th.e__1eft oe1box};%:’y  ”<\/p>\n
As per wound certificate Ex 5 the <\/p>\n
sustained the following injur.i_es.:_
\ni] Degloving
\nii} Bones exposed   Lexposed<\/p>\n
Injuries sustained by   also evident from<\/p>\n
discharge”   with negative ex. P<\/p>\n
10, OPD   P__ IL ‘case sheet EX. P 12, Xmrays Ex. P<\/p>\n
  13._’:aind_supported’—by’oral evidence of the claimant and<\/p>\n
 as P.Ws.1 and 2 respectively. PW 2<\/p>\n
whoeis an orthopaedic doctor assessed 78% disability to<\/p>\n
e\ufb01the ‘land 26% to the Whole body.<\/p>\n
‘p”‘:–A.c\u00bb’A(}’0I1sidering the nature of injuries, Rs.30,000\/–<\/p>\n
 _’vawarded by the Tribunai towards pain and suffering is<\/p>\n
 on the lower side and it is deserved to be enhanced by<\/p>\n

another sum of Rs.10,000\/– and 1 award Rs.40,000\/~<\/p>\n
under this head.\n<\/p>\n
8. The claimant has not produced any bills regarding<\/p>\n
the amount spent by him towards treatment. Therefore<\/p>\n
Rs.3,000\/– awarded by the Tribunal <\/p>\n
expenses is just and proper and.._it d.oes'”nfot for’ it<\/p>\n
enhancement.\n<\/p>\n
9. Claimant was treated_V:as__ inpatient  in-L’<\/p>\n

  per.-:’day, but the same is not established. In<\/p>\n
the absence of proof of income, the Tribunal assessing<\/p>\n
 his income at Rs.3,000\/– per month and considering<\/p>\n
 period of treatment as 4 months, has rightly<\/p>\n
l\ufb02lawarded Rs.12,000\/– towards loss of income during<\/p>\n
