The petitioner is B.A., B.Ed. The petitioner was made<br \/>\n\tpermanent on 2nd\/3rd June 1980 in the school<br \/>\n\trun by the respondent No.4. Thereafter, on 07th June<br \/>\n\t1982, the service of the petitioner was terminated by the respondent<br \/>\n\tNo.4-School by notice dated 26th April 1982 on account of<br \/>\n\tclosure of higher secondary classes.\n<\/p>\n<p>It<br \/>\n\tis further the case of the petitioner that thereafter the petitioner<br \/>\n\tpreferred Special Civil Application No.4647 of 1983 before this<br \/>\n\tCourt challenging her termination since she was not absorbed in any<br \/>\n\tother school. In pursuance of the order dated 23rd March<br \/>\n\t1992, the petitioner was absorbed in the secondary school of the<br \/>\n\trespondent No.4. In respect of the backwages, the respondent No.3<br \/>\n\twas directed by this Court to decide the same. The respondent No.3<br \/>\n\tthereafter on the representation made by the petitioner ordered the<br \/>\n\trespondent-School Management to pay back wages to the petitioner.<br \/>\n\tBeing aggrieved by the order of the respondent No.3-DEO, the<br \/>\n\trespondent-School made a representation to the respondent- State<br \/>\n\tGovernment. The respondent No.2-Commissioner of Schools heard the<br \/>\n\tparties and vide order dated 01st September 1999 held<br \/>\n\tthat since the petitioner has not worked for the said period, she is<br \/>\n\tnot entitled to salary and thereby, quashed and set aside the order<br \/>\n\tpassed by the respondent No.3-DEO. Being aggrieved by the same, the<br \/>\n\tpetitioner made a representation dated 06th October 1999<br \/>\n\tto the respondent-State Government, which ultimately came to be<br \/>\n\trejected vide order dated 17th November 1999. Hence, the<br \/>\n\tpresent petition.\n<\/p>\n<p>Mr.J.K.\n<\/p>\n<p>\tShah, learned Assistant Government Pleader, has relied upon the<br \/>\n\taffidavit-in-reply filed on behalf of the respondent-Commissioner of<br \/>\n\tMid-Day Meals and Schools and submitted that the orders passed by<br \/>\n\tthe respondent-authorities are just and proper since the petitioner<br \/>\n\thas not worked for the period in question in any educational<br \/>\n\tinstitution receiving grant-in-aid. The respondent-authorities have<br \/>\n\tpassed the orders after taking into consideration the pros and cons<br \/>\n\tof the matter and therefore, the present petition is required to be<br \/>\n\tdismissed.\n<\/p>\n<p>Having<br \/>\n\tconsidered the contentions raised by the learned advocates for the<br \/>\n\trespective parties, documents produced on record, the averments made<br \/>\n\tin the petition as well as reply affidavit filed by the<br \/>\n\trespondent-authority as well as the affidavit-in-rejoinder, it<br \/>\n\ttranspires that the petitioner has been ordered to be absorbed in<br \/>\n\tthe respondent-School vide order dated 23rd March 1992<br \/>\n\tpassed by this Court (Coram : N.J. Pandya, J) while dealing with<br \/>\n\tSpecial Civil Application No.4647 of 1983, wherein this Court in<br \/>\n\tparagraph 9 has categorically observed that for want of certain<br \/>\n\tdetails, the issue of deciding the backwages is left to be decided<br \/>\n\tby the respondent No.3. The respondent No.3 has decided in favour of<br \/>\n\tthe petitioner. However, as the respondent No.4-School made a<br \/>\n\trepresentation to the respondent-State Government, the respondent<br \/>\n\tNo.2 held that since the petitioner has not worked a period of more<br \/>\n\tthan 10 years, she is not entitled to any backwages. The respondent<br \/>\n\tNo.2 after taking into consideration the pros and cons of the matter<br \/>\n\thas decided the matter and he has assigned cogent and convincing<br \/>\n\treasons for not awarding backwages to the petitioner. Thus, when the<br \/>\n\tpetitioner has not worked for a period of about 10 years, she is not<br \/>\n\tentitled to any backwages as prayed for. It is required to be noted<br \/>\n\tthat there is nothing on record to show that the respondent-School<br \/>\n\tManagement has deliberately deprived the petitioner from resuming<br \/>\n\ther duty. Thus, the impugned orders passed by the<br \/>\n\trespondent-authorities are just and proper. I do not find any<br \/>\n\tillegality or material irregularity in the said orders. Thus, the<br \/>\n\tpresent petition is devoid of any substance and merit and the same<br \/>\n\tis required to be dismissed.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid observations and discussion, the present petition<br \/>\n\tfails and is, accordingly, dismissed. Rule is discharged with no<br \/>\n\torder as to costs.
