By virtue of the order dated<br \/>\n\t19.2.2008 ad-interim-relief was directed to be continued till<br \/>\n\tfurther order. The main petition, Special Civil Application No.24662<br \/>\n\tof 2007, was heard and rule was issued on 19.2.2008. Thereafter, the<br \/>\n\trespondent No.8 has moved Civil Application No.12128 of 2008 for<br \/>\n\tvacating of the interim relief on the ground that he was not heard<br \/>\n\twhen the ad-interim relief was granted.\n<\/p>\n<p>\tHaving heard learned<br \/>\n\tadvocates appearing for the parties and Mr. Prafulchandra N.<br \/>\n\tJaiswal- party in person the Court is of the view that without going<br \/>\n\tinto controversy between the parties or without going into the<br \/>\n\taspect as to whether the respondent No.8 was heard at the time of<br \/>\n\tgranting ad-interim relief, at the behest of the respondent No.8 no<br \/>\n\tinquiry can be conducted by the authority.  However, the authorities<br \/>\n\ton their own can certainly make inquiry in the matter and hence<br \/>\n\tad-interim relief granted earlier in terms of para-5(B) of Civil<br \/>\n\tApplication No.15248 of 2007 is modified to the extent that, it is<br \/>\n\topen for the respondent Nos.1 to 5 authorities to make<br \/>\n\tinquiry\/investigation in the allegations made against the<br \/>\n\tpetitioner.  The respondent No.8 has placed the bunch of documents<br \/>\n\tbefore this Court alongwith draft amendment.  This draft amendment<br \/>\n\tis granted.  It forms part of the main Civil Application No.12128 of<br \/>\n\t2008.  Copy is already served to the Assistant Government Pleader&#8217;s<br \/>\n\toffice. While making inquiry and\/or investigation the respondent<br \/>\n\tauthorities will go into these documents, which are produced before<br \/>\n\tthe Court and after  making detailed exhaustive inquiry either by<br \/>\n\tthe respondent No.5   Food Controller or by any Officer duly<br \/>\n\tauthorised by him and shall produce report on the record of the main<br \/>\n\tpetition i.e. Special Civil Application nO.24662 OF 2007.  The<br \/>\n\treport should be placed within the period of three months from the<br \/>\n\tdate of receipt of writ of this Court or from the date of receipt of<br \/>\n\tcertified copy of this order, whichever is earlier.  Office is<br \/>\n\tdirected to place this matter after the period of three months for<br \/>\n\tfurther hearing in the matter.\n<\/p>\n<p>\tBoth these Civil<br \/>\n\tApplications are accordingly disposed off.\n<\/p>\n<p>    (K.
