Thereafter, the<br \/>\npetitioner was transferred at different places from to time.  The<br \/>\npetitioner after putting into more than 33 years of service<br \/>\nvoluntarily resigned from the service w.e.f. 31.05.1999. Pursuant<br \/>\nthereto, respondent no. 4 vide order dated 25\/30.06.1995 fixed the<br \/>\npension and directed  respondent no. 3 to pay the pension and other<br \/>\nretirement dues to the petitioner. Thereafter, the respondent no. 4<br \/>\napportioned the amount of pension and other retiral dues and<br \/>\nforwarded the same to respondent no.3. The respondent no. 3 was<br \/>\nthereafter required to pay the amount of pension and other retiral<br \/>\ndues to the petitioner as apportioned by respondent no. 4. It is the<br \/>\ncase of the petitioner that till date respondent no. 3 has not paid<br \/>\nany amount to the petitioner. Hence, this petition.\n<\/p>\n<p>3.<br \/>\nThe learned counsel for the petitioner states at bar that<br \/>\nthe respondent-authority has paid the amount of pension and other<br \/>\nretiral benefits to the petitioner and now the only  grievance which<br \/>\nis required to be considered is with respect to interest for the<br \/>\ndelayed payment of pension and other allowances.\n<\/p>\n<p>4.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. From the record it appears that the petitioner has<br \/>\nvoluntarily retired from the service w.e.f. 31.05.1999. It is<br \/>\nrequired to be noted that at the relevant point of time i.e.<br \/>\n12.11.1975, at the time of inter-district transfer the petitioner had<br \/>\nnot asked for the contributory benefits and had not completed the<br \/>\nservice book accordingly. However, it was the duty of respondent no.<br \/>\n5 to complete the service book and give the contributory benefits to<br \/>\nthe petitioner.  Apart from that respondent no. 4 has credited the<br \/>\namount of pensionary benefits in the account of petitioner and<br \/>\ntherefore there is no delay on the part of the respondent.  The<br \/>\npetitioner is, therefore, not entitled for any interest on the<br \/>\npensionary benefits.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe result, the petition is dismissed. Rule is discharged.
