Dabhi, learned APP appears and waives service of notice of  Rule<br \/>\non behalf of  the respondent &#8211; State of Gujarat.\n<\/p>\n<p>3\tHaving<br \/>\nregard to the facts of the case,  the application is taken up for<br \/>\nhearing today.\n<\/p>\n<p><span class=\"hidden_text\">4\t<\/span><\/p>\n<p>The applicant &#8211;  convict prisoner, who vide judgment and order dated<br \/>\n14.5.2007,  rendered in Sessions Case No. 128 of 2005, by the learned<br \/>\nAdditional Sessions Judge,  Fast Track Court No.4,  Palanpur,<br \/>\nBanaskantha, has been convicted for the offence punishable under<br \/>\nSection 302, of the Indian Penal Code and sentenced to life<br \/>\nimprisonment,  has filed this Application, through jail authority,<br \/>\npraying  to enlarge him  on temporary bail, for a period of  45 days,<br \/>\n to enable him to get it repaired his  house which has become<br \/>\ndilapidated in the last monsoon.\n<\/p>\n<p>5\tWe<br \/>\nhave considered the submission made by Mr. L.B. Dabhi, learned APP<br \/>\nfor the respondent &#8211; State of Gujarat.  We have also perused<br \/>\nthe averments made in the application and the supporting document<br \/>\nthat form part  of the application.  We have also gone through the<br \/>\njail remarks sheet  forwarded by the jail authority  along with the<br \/>\napplication.\n<\/p>\n<p>6\tUpon<br \/>\nperusal  of the jail remarks sheet, we find that the applicant has<br \/>\nundergone   total period of  imprisonment of  5 years, 6 months and<br \/>\n26 days.  During he said period,  he was enlarged on temporary bail<br \/>\nfor a period of 15 days  in 2008.  He has surrendered  in time.<br \/>\nThere is no jail punishment.  Besides this, his  jail  conduct is<br \/>\ngood.  That apart,   the ground stated by the applicant is supported<br \/>\nby the document i.e. photograph which shows that his house has become<br \/>\ndilapidated in the last monsoon.  In view of the aforesaid, if the<br \/>\napplicant is released on temporary bail for a period of 15 days from<br \/>\nthe date of his actual release, the same would meet the ends of<br \/>\njustice.\n<\/p>\n<p>7\tFor<br \/>\nthe foregoing reasons,  the Application succeeds in part.<br \/>\nAccordingly,  it is partly allowed. The applicant  &#8211; convict prisoner\n<\/p>\n<p>&#8211; HINDUDABHAI ASHABHAI PARMAR<br \/>\nis ordered to be released on  temporary bail  for a period of 15 days<br \/>\n from the date of  his   actual  release on executing a personal bond<br \/>\nof Rs. 5,000\/- before the Jail Authority on usual terms and<br \/>\nconditions.  The applicant shall  surrender to the jail authority  on<br \/>\ncompletion of  15 days  from the date of his release<br \/>\n without fail.
